02-26-1985A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, February 26, 1985, at 7:30 p.m., in the Council Chambers of the City Hall. Present were Chair Eddy, members, Berg, Folk, Milbert and Kirscht. Also present were City Engineer Strojan, Community Development Director Kerrigan and Community Development Analyst Anderson. Item: Approve and sign minutes of the January 29, 1985 meeting. 2 -4 The Commission moved to approve and sign the minutes of the January 29, 1985 meeting. Motion carried unanimously. Case No: Hearing on an application by Richard Ludwig for St. Therese Home Inc. for 85 -02 a Concept Review to construct a Nursing Home and Housing for the Elderly 4 -276 at Smetana Road and Feltl Court, continued from the January 29, 1985 meeting. Mr. Ludwig and Mr. Swedberg, architect, reviewed the plans with the Commission. They had met previously with the Westbrooke neighborhood and reviewed many of their concerns regarding the height of the buildings, berm of sufficient height to hide parking. The revised plans are for building heights of 9, 7 and 5 stories. It was the feeling of the Commission that the applicant had worked well with the neighborhood and they looked favorably on the proposed development. The applicant will be at the April 30, 1985 meeting with their final plans for a Conditional Use Permit hearing. Case No: Hearing on an application by Lawrence Signs Inc. for R & W Properties for a 85 -04 Conditional Use Permit to locate a sign in a lesser setback than required 286 -420 at 502 North Blake Road, continued from the January 29, 1985 meeting. Mr. Kernan, representing R & W Properties, explained the request to the Commission and stated that they had remodeled the interior of the building and with spring approaching they would be doing some exterior improvements. The request to move the sign is for safety reasons and also to add some landscaping to the front of the property. The Commission asked that they try to locate the sign at the north entrance to the property rather than the south entrance to avoid confusion when entering the property. Mr. Kernan stated he didn't think it would be a problem and they would check it out. Mr. Berg moved and Mr. Folk seconded a motion recommending to the Council approval of the Conditional Use Permit to locate the sign with a ten foot setback with the stipulation that before going to Council they check the feasibility of locating the sign to the north entrance rather than the south as requested and that they consider some landscaping in their new plan. Motion carried unanimously. Case No: Hearing on an application by Walser Corporation for a Conditional Use Permit 85 -05 to locate a sign in a lesser setback than required at 314 West Excelsior 425 -476 Avenue, continued from the January 29, 1985 meeting. The applicant was instructed at the January meeting to check the feasibility of flagging the sign the opposite direction thereby staying within the ordinance. The applicant was not preset at the meeting. Mr. Folk moved and Mr. Milbert seconded a motion recommending to the Council denial of the request to lcoate a sign in a lesser setback. Motion carried unanimously. Case No: Hearing on an application by First Federal Savings of 690 -16th Avenue South 85 -06 for a Conditional Use Permit to erect a 6 foot fence for outdoor storage 477 -664 of repossessions. Mr. Richard Hager of First Federal reviewed the request with the Commission stating that the request was due to a letter from the City stating the need for fencing for outside storage of property. He also stated that this is an unusual case in that property is not usually stored for a length of time and that the spring would be the best time for sale of the mobile home. Zoning and Planning Commission minutes of February 26, 1985 continued. Mr. Folk moved and Mr. Berg seconded a motion recommending to the Council that if the mobile home is not sold within 180 days the fence is to be constructed of 6' cyclone material. Motion carried unanimously. Case No: Hearing on an application by Janet Perbix Hood of 318 -11th Avenue North 85 -08 for a side yard variance to construct an addition to the existing structure. 667 -707 Janet Hood explained the request to the Commission and presented a letter from the property owner to the north stating that he is in favor of granting the variance as requested. Mr. Berg moved and Mr. Kirscht seconded a motion recommending to the Council approval of the side yard variance due to the location of the house on the lot and also it is in keeping with the neighborhood. Motion carried unanimously. Case No: Public Hearing on consider amending the Hopkins Zoning Ordinance No. 77 -427 85 -07 and Section 409:00 of the 1977 Hopkins Code of Ordinances pertaining to 708 -939 Billboards and Signs, and additional language pertaining to overhanging signs in the B -2 District. Mr. Folk moved and Mr. Berg seconded a motion recommending to the Council approval of the proposed Ordinance No. 85 -548 "REPEALING SECTION 409 OF THE HOPKINS CODE AND AMENDING ZONING ORDINANCE 427 PERTAINING TO SIGNS AND BILLBOARDS ". Motion carried unanimously. Item: Five Year Capital Budget Workplan. The Commission reviewed the proposed Five Year Workplan. Staff was asked to check on grant money for bike trails and also invite someone from the Recreation Department to the March meeting to review the park program. Mr. Folk moved and Mr. Berg seconded a motion that the meeting be adjourned. Motion carried.
