06-25-1985A regular meeting of the Hopkins Zoning and Planning Commission was held on
Tuesday, June 25, 1985, at 7:30 p.m., in the Council Chambers of the City Hall.
Present were Chairman Folk, members Berg, Brandon, Janke, Kirscht and Milbert.
Also present were City Manager Rapp, City Engineer Strojan, Community Development
Director Kerrigan, and Community Development Analyst Anderson.
Item: Mr. Berg moved and Mr. Milbert seconded a motion that the minutes of the
May 28, 1985 meeting be approved and signed. Motion carried unanimously.
Case No: Review of landscape plan relating to the approved expansion of Rapid Oil
85 -09 Company, 1124 East Excelsior Avenue as referred by Council May 7, 1985.

Mr. Healy, Manager for Rapid Oil Company, reviewed the landscape plan
and stated that the tanks will be removed before construction is started.
The Commission suggested that a concrete curb be installed around the
planting area for protection.
Action: Mr. Janke moved and Mr. Berg seconded a motion approving the landscape
plan with a curb around the planting area and the space of ten feet
between Junipers should be reduced. Motion carried unanimously.
Case No: Hearing on an application.by Sojan Uppal for sideyard variances to allow
85 -29 construction of a ten unit townhouse development on 9th Avenue South,
49- just north of Nine Mile Creek.
Mr. Uppal reviewed the plans with the Commission and stated that he would
like to change the request from variances on each end of the project to
just one variance on the South end of the project. Said variances are
requested due to poor soil conditions which require piling and the need
to attach the units for stability.
Action: Mr. Milbert moved and Mr. Berg seconded a motion recommending to the Council
approval of a sideyard variance from the required 14 feet to 3'6" on the
Southerly portion of Lot 5 due to the poor soil conditions and the fact
that the property adjoins the park on the South. Motion carried;
Mr. Kirscht voting nay.
Case No: Hearing on an application by Sohan Uppal for a Conditional Use Permit to
85 -30 allow construction of a ten unit townhouse development on 9th Avenue South
-278 just North of Nine Mile Creek.
Action: Mr. Berg moved and Mr. Janke seconded a motion recommending to the Council
approval of the Conditional Use Permit subject to approval by the Watershed
District, coordinate grade changes with the Park Department on the Southerly
boundary where the property adjoins the park, approval by the Fire Marshal,
elevations approved by the Watershed District and that the lots be combined.
Motion carried; Mr. Kirscht voting nay.
Case No: Hearing on an application by Naegele Outdoor Advertising Company for a
85 -31 Variance to erect a sign to exceed the maximum height of 35 feet by 15 feet
279 -281 at Milwaukee Railroad right -of -way near County Road 18 and County Road 3.
Applicant requested that the application by withdrawn.
Case No: Hearing on a request to change the name of "Hazelane" to Hazel Lane ".

282 -305 Mr. & Mrs. Brubacher, 414 Hazelane reviewed the request with the Commission
stating that the street signs create confusion on deliveries and also when
directing people to their homes. All their legal papers state that the
name was stated as Hazel Lane, but the plat shows the name as Hazelane
which may have been an error that was not noticed.
Action: Mr. Milbert moved and Mr. Janke seconded a motion recommending to the
Council approval of the street name change as requested. Motion carried
unanimously.
Case No: Hearing on an application by Don LaMere of 611 - 13th Avenue South for a
85 -33 front yard setback variance to enclose the entry of the existing structure.

Mr. Tom Vucicevic explained to the Commission that the request was to
enclose the existing entry of the structure for safety purposes and
also to save energy.
Action: Mr. Berg moved and Mr. Kirscht seconded a motion recommending to the
Council approval of the variance to enclose the existing entry only.
Motion carried unanimously.
Case No: Hearing on an application by John Goodman for a Variance for off - street
85 -33 parking for the building located at 135 Shady Oak Road.

Mr. Bradley Fuller, attorney for the applicant, reviewed the request with
the Commission stating that it has been difficult to find a tenant for
the existing buidling due to the parking requirements and the fact that
the building is locked in. He also stated that the peak hours of operation
for a Fitness Center would work well in that particular area.
Action: Mr. Berg moved and Mr. Janke seconded a motion recommending to the Council
approval of the parking variance for a minimum of 31 parking spaces,
layout to the satisfaction of the staff, limited to a Fitness Center.
Motion carried; Mr. Folk voting nay.
Item: Review of sign ordinance relating to commercial uses in residential
671 -795 districts.
The Commission was satisfied with the staff proposal and directed staff to
draft an ordinance based on said report and have the City Attorney review
the draft so that a date for hearing can be set.
Item: Review of signs in windows.
Staff was directed to refer the proposal to the CCDC for comment before
setting a date for hearing.
Item: Request for change in the sign ordinance regarding projecting signs.
Mr. Kerrigan suggested that the proposed changes be dealt with at the same
time as the other two proposed changes in the sign ordinance are scheduled
for hearing.
The Commission concurred with Mr. Kerrigan to deal with all proposed sign
ordinance changes at one time but will allow Buds Music Center to hang a
sign of a larger size for trail purposes before the hearing date.
Review of changes in the Comprehensive Plan.
Mr. Kerrigan suggested to the Commission that changes be made to either
conform to the Comprehensive Plan or to the Zoning Ordinance. He also
stated that a seminar is being held on how to resolve such conflicts. He
suggested that a moratorium to restrict development of the listed parcels
be approved until the problem can be resolved.
Mr. Berg made a motion recommending to the Council that the Comprehensive
Plan changes be scheduled for hearing. Motion died for lack of a second.
The Commission concurred that a moratorium to restrict development of the .
listed parcels be adopted and asked staff to get an opinion from the
City Attorney.
Item: The Commission expressed a desire to view the properties listed for possible
change. A tour of the properties, by bus on a Saturday morning, was
suggested and also an invitation to be extended to the Council if they
would like to join them.
