Front & Rearyard Variance-249 Interlachen Rd.May 23, 1984 • Case No: 84 -18 Applicant: Lloyd Swanson Location: 249 Interlachen Road Request: Front and Rear Yard Variance to Construct a Single Family Home STAFF FINDINGS & COMMENTS: Kerrigan 1. This request is in conjunction with a Waiver of the Platting Requirements. The applicant is proposing construction of a new single family home within an R -1 -C residential district. 2. The setback requirements for the subject property are as follows: Front yard 30' Rear Yard 35' Side Yard 1 story 10' 2 story 12' 3 story 14' The plans as proposed by the applicant call for the front yard setback off of Interlachen Road to vary from approximately 50' to 27', which thus would require a 3' variance. The rear yard setback varies to a minimum of 22' adjacent to the Meadowbrook Golf Course property, thus requiring a 13' variance. The subject structure would comply with the other requirements of the zoning ordinance. 3. Approval of this variance request would be contingent to the following prior action occuring a) approval by the Commission of the lot division and recording a said division with the Hennepin County Recorders Office. b) permission by the Hopkins City Council to allow the applicant to build 11'1" into a public utility easement. 4. The applicant has stated he will contact the property owners directly adjacent to the subject site concerning the requested action. • 0 FOR VARIANCE APPLICATION ONLY NOTE: The purpose of a variance is to provide relief to a property owner when the strict enforecment of the Zoning Ordinance would cause an undue hard - ship to the property owner or deny reasonable use of the property. Hardship to the applicant is the crucial test. Variances will be granted only in unusual situations which were not foreseen when the Zoning Ordin- ance was adopted. Economic situations are seldom unique and are rarely considered a valid hardship. Hardship A. Explain why strict enforcement of the Zoning Ordinance would cause undue hardship: • Conditions B.
