STAFF FINDINGS & COMMENTS: Kerrigan
1. 427.42(3) requires that signs conform to yard requirements. The subject
property is located on a County Road and thus requires a 20' front yard
setback.
2. The present sign located on the site is 6' from the property line, in
approximately the center of the subject. The applicant is proposing to
move the sign 47' south of the existing location. The relocated sign
would also be located 2' closer to the building than at the present, and
thus the setback area of the sign would be increasing.
3. 427.42(15) states that "applications for other proposed sign permits not
prohibited by Section No. 409 and involving a lesser setback than that
required by the Hopkins Zoning Ordinance, may be granted only by and under
a conditional use permit as defined in Section 427.04(26) and under the
applicable provisions and regulations of conditional use requirements set
forth in Section 427.26 of the Hopkins Zoning Ordinance which conditional
use permits may require periodic reviews and may be cancelled for cause ".
4. In conjunction with the relocation, the applicant will be requesting a
sign permit to change the existing faces within the 4 x 8 sign and add a
5 x 14' sign. The present height of the sign is 18' and would be increased
to 23' with the addition of the new sign.
