Cond. Use Permit-Construct a Share Health Clinic Bldg.• June 20, 1984 Case No: 84 -23 5 `V 2 - ?107 Applicant: Benson, Malkerson, Bradbury & Gabrielson, Inc. Location: Southeast corner of Second Avenue South & Seventh Street Request: Conditional Use Permit to construct a Share Health Clinic building STAFF FINDINGS & COMMENTS: Anderson - Kerrigan 1. Applicant is requesting a Conditional Use Permit to construct a medical clinic. 427.26(c) requires a Conditional Use Permit for new construction over $75,000. 2. The subject site is located at Seventh Street South and Second Avenue South. The site is zoned B -1, Limited Business. 3. The proposed building is to be 13,400 square feet and constructed of brick and cedar siding. The height of the proposed structure will be 22 feet. The building will have a canopy over the entrance extending in a northwest direction. The canopy is made of metal and will be painted a copper color. 4. The structure as presented would have a 251 foot front yard setback, a 20 -30 foot rear yard setback, a 156 -188 foot sideyard setback to the west and an • easterly side yard varying from 15 to 90 feet. These setbacks comply with the requirements of 427.35. 5. The nursing home is located to the south of the subject site, single family homes to the west, buffered by trees, an empty lot to the north, and Highway 18 to the east. 6. 134 parking stalls are to be provided with an entrance /exit from the southwest. 14 compact stalls are provided along with 5 handicap stalls. The number of parking stalls are in compliance with ordinance 427.45(13) which requires at least three (3) parking spaces for each staff doctor or dentist or one (1) space for each one hundred and fifty (150) square feet of gross floor area, whichever is greater. The ordinance requires 190 parking stalls based upon the square footage requirements. 7. Ordinance 427.23(7) requires parking space shall not be less than 9 feet in width and 20 feet in length. The requirements for compact cars are 8 feet by 16 feet. The parking spaces are 18 feet in length however the parking islands provide the additional length. 8. The parking lot is to contain five lights. Any lights will have to conform with ordinance 427.44(2) any lighting used to illuminate an off - street parking area shall be shaded or defussed so as to reflect the light away from the ad- joining property and away from abutting traffic. • 9. The interior of the parking lot will be landscaped with rocks and trees. The exterior of the parking lot will be screened with a variety of over and under - story trees. The retaining wall will be constructed along the north, northeast and northwest side of the site. • • 1�1 Case No: 84 -23 Page 2 10. The drainage plan has been reviewed by the City Engineer and has been found acceptable. Drainage will flow in a southwesterly direction on the site. 11. The Fire Marshal has reviewed the plans and noted that the building must be sprinkled, any other Fire Code requirements will have to be complied with at the building permit stage. 12. A sign is shown on the plan within the sideyard setback in violation of 427.42(3). If the applicant receives approval of a Conditional Use Permit for construction of the subject building, he would have to apply for a sign permit prior to erecting the sign, and at that time, if it was determ:i.ned that the sign did in fact not comply with any of the requirements of 427.42, Signs, Advertising Lights and Devices, the applicant would be required to receive approval of a variance or additional Conditional Use Permit. 13. Ordinance 427.35 requires a maximum Floor Area Requirements of 1.0. The pro- posed building has a F.A.R. of .12 which meets the requirements of the ordin- ance. 14. Trash storage is to be at the rear of the building and below ground level. This area is sheltered from the public view. 15. Access to the proposed site will be in the southwest corner from Second Avenue South. 16.
