Request: Vacate south one -half of Fifth Street South between the east line
of Second Avenue South and the west line of County Road 18.
STAFF FINDINGS & COMMENTS: Anderson - Kerrigan
1. The subject right -of -way is presently the unused south portion of Fifth Street
South bordering the north property line of Data Serv. There are no plans to
improve this into a public roadway in the future.
2. The application for vacation is being requested to facilitate additional
parking as needed.
3. The existing street contains gas, electric and water. An appropriate easement
acceptable to the City, NSP and Minnegasco will have to be maintained should
the vacation be approved.
• 5. Subsequent to the petition by the applicant, we were contacted by Hennepin
County and informed that at the same time as the subject request is being
reviewed, they would like to have the vacation of the north side of Fifth
Street abutting their property also considered.

I have received the notice of Hearing relating to the vacation of the South
one - half of Fifth Street South.
It seems impractical to me to vacate one half of the street without vacating
the other. I therfore request that both halves of said street be vacated
at the same time.
