STAFF FINDINGS AND COMMENTS: Kerrigan - Rafferty
1. The applicant has requested a ten foot side yard variance in an I -2 District
which requires 20 foot side yard setback. The applicant has stated poor soil
conditions between the existing structure and the proposed structure as a
reason for granting the variance. The applicant meets the other lot require-
ments of the ordinance.
2. The Engineering Department has identified a ten foot utility easement on the
easterly portion of the property in question. The applicants request to con -
struct their structure 10 feet from the property line should not obstruct the
utilities now in place.
• 3. The existing structure was granted a 15 foot side yard for poor soil at the
time of construction.

A regular meeting of the Hopkins Zoning and Planninq Commission was held on
• Tuesday, March 31, 1981, at 7:30 o.m. in the Council Chambers of the City Hall.

Present were Chairman Miller, members Folk, Loberg, McDonald, Milbert and Reinehr.
Also present were City Manager Craig, Zoning Administrator Kohnen and Assistant
Community Development Director Rafferty.
Item: Approve and sign minutes of the Special Meeting of March 11, 1981.
Ms..Reinehr moved and Mr. Milbert seconded a motion that the minutes
of the March 11, 1981 meeting be approved and signed. Motion carried.
Case No:
81 -03 Hearing on an application by Super Valu Stores Inc. and the Chicago,
Milwaukee, St. Paul & Pacific Railroad Company to vacate parts of
Washington Avenue, Milwaukee Street, Second Street, Jefferson Avenue
and the abandoned Minneapolis, St. Paul Suburban Railway Company,
continued from the February 24, 1981 meeting.
Mr. Lowell Janke of Super Valu reviewed the request with the Commnission
and stated that they have been working with Millwork and General Resources
in regard to possible relocation. He also stated that the landfill site
is not feasible for their garage facility.
Mr. Deaver representing Millwork Inc. stated that they were not against
the vacating of Second Street South &Jefferson South but that they were
opposed to the vacating of Washington Avenue and Milwaukee Street.
Mr. Bruce Lieberman representing General Resources, East End Bottle Shop,
Gertzens Restaurant, Dairy Queen, Surge Water Conditioning, Spur Service
Station and Viking Identification Products. fie stated that all of these
• businesses were concerned over the a r ' tl_
Washington. They had noted a decrease their businesswiththe con-
struction of County Road 18. Mr. Lieberman also presented to the Commission
a petition signed by residents, business places and patrons against the
vacation of these streets.
Action:: Ms. Reinehr moved and Mr. McDonald seconded a motion recommending to the
Council approval of the proposed vacation. Ms. Reinehr, Mr. McDonald and
Mr. Miller voting yea; Mr. Folk, Mr. Loberg and Mr. Milbert voting nay.
Motion defeated.
Case No:
81 -05 Hearing on an application by 601 Investment Company to consider vacating
Van Buren Avenue North from Excelsior Avenue to the Chicago, Milwaukee,
St. Paul & Pacific Railroad right -of -way.
Being that no one was present in regard to this request, Mr. McDonald moved
and Mr. Folk seconded a motion to deny the request. Mr. Milbert, Mr. Folk
and Mr. McDonald voting yea; Mr. Loberg, Ms. Reinehr and Mr. Miller voting
nay. Motion defeated.
Action: Mr. Loberg moved and Ms. Reinehr seconded a motion to continue this case
to the April 28, 1981 meeting. Motion carried.

81 -06 Hearing on an application b Mr. Briggs ggs for a Conditional Use Permit for a
Planned Unit Development to construct an office on Lot 1, Block 1,
Napco Industrial Park also known as 1615 5th Street South.
Mr. Reinertson, architect, and Mr. Briggs, owner, presented plans to the
Commission.
Action. Mr. Milbert moved and Mr. Folk seconded a motion to recommend to the Council
approval of the Conditional Use Permit for a Planned Unit Development for
the construction of an office - warehouse at 1615 5th Street South. Motion
carried.

Case No:
81 -0 7 Hearing on an application by Mr. Briggs for a variance to reduce the side
yard setback requirement ok 20 feet to 10 feet for construction of an office
warehouse at 1615 5th Street South.
Mr. Briggs stated that the reason for the variance is due to poor soil
conditions in the middle of the lot.
Action:
Mr. Loberg moved and Ms. Reinehr seconded a motion recommending to the
Council approval of the variance due to the poor soil conditions in the
middle of the lot. Motion carried.
Case No:
81 -08
Hearing on an application by Hansord Agency for a Conditional Use Permit
for parking and storage at 21 8th Avenue North in conjunction with the
auto sales operation at 7th & Excelsior Avenue.
Mr. Gordon Nelson, Manager of Hopkins Honda and Mr. David Carlson, real
estate agent, presented the proposal to the commission for the 15 feet_
of railroad right -of -way and the Dr. Stahr property for storage of new
cars and customer cars.
Mr. Roger Kopp of 18 7th Avenue North wanted to see complete plans for the
project and stated that he had some problem with trespassing on his property.
Mr. Thomas Quinn of 19 8th Avenue North stated that he would like some
type of fencing so he would not be looking at these cars.
Action:
Mr. McDonald moved and Mr. Loberg seconded a motion recommending to the
Council granting of the Conditional Use Permit to improve the property at
21 8th Avenue North to be used for additional parking and storage in con-
junction with the auto sales operation on the corner of 7th & Excelsior
Avenue known as Rudy Luthers Hopkins Motors Inc., including landscaping and
fencing on 8th Avenue as drawn on the survey with a six foot wrought iron
fence set back six Feet and landscaped with shrubs, six foot open cyclone
fence on the north property line, and six foot cyclone fence with slats on
the south property line, curb cut at the northerly 15 feet of the property,
and drainage to be approved by the City Engineer. Motion carried.
Item:
Special Planning Meeting with Mr. Hawks scheduled for April 22, 1981, at
7:30 p.m. in the Council Chambers. The Downtown Committee and the City
Council invited to attend.
Action:
Mr. Folk moved and Ms. Reinehr seconded a motion that the meeting be
adjourned. Motion carried.
