Variance-45 19th Ave. N.July 24, 1984 • Case No: 84 -25 Applicant: Dennis Donat - Durabilt Garages Location: 45 19th Avenue North Request: Variance to allow a garage vehicle entrance 16 feet from the property line. STAFF FINDINGS & COMMENTS: Anderson - Kerrigan 1. The subject property is zoned R -1 -A. The applicant is requesting a yard vari- ance of 4 feet to construct a detached garage. Ordinance 427.08 requires that the vehicle entrance side to such building shall be not less than 20 feet from any such yard line. All other setbacks are within the minimum setback require- ments. 2. The proposed garage is 572 square feet. Ordinance 427.08(3) states accessory buildings to a residential structure shall not exceed an aggregate area of 528 square feet per dwelling unit except the aggregate area may be extended to the following percentage of lot area for the zoning district designated provided the area does not exceed 1000 square feet. The percentage of lot area is 5494 square feet. The proposed garage is within the maximum requirements of 121. . 3. The applicant has stated in the application that a variance is required so that the entrance can be on First Street so that he would not use up his entire yard with the garage. 4. Ordinance 427.13 states that variance shall be approved only by circumstances unique to the property under consideration would cause undue hardship to owner. • �J • FOR VARIANCE APPLICATION ONLY NOTE: The purpose of a variance is to provide relief to a property owner when the strict enforecment of the Zoning Ordinance would cause an undue hard ship to the property owner or deny reasonable use of the property. Hardship to the applicant is the crucial test. Variances will be granted only in unusual situations which were not foreseen when the Zoning Ordin- ance was adopted. Economic situations are seldom unique and are rarely considered a valid hardship.
