SUBJECT: Vacant lot between Data Sery and Warrington
The following actions were taken in 1980 by the Zoning and Planning Commission
and the City Council regarding the granting of Conditional Use Permit to
construct an office building at 509 Second Avenue South. The minutes of the
April 29, 1980 Zoning and Planning Commission showed that a motion carried
that recommended to the Council approval of the Conditional Use Permit and
interim maintenance of the middle lot. The application went to the City
Council Meeting of May 6, 1980. The motion carried to approve an application
by Wayzata Leasing for a Conditional Use Permit to construct an office building
at 509 Second Avenue South, subject to maintenance of the middle lot, as
recommended by Zoning and Planning.

PETITION TO VACATE
. Lombard Investments Inc. (hereinafter called "Petitioner ") is the
owner of Lot 3, Block 1, Warrington Addition, Hennepin County,
Minnesota, according to the duly recorded plat thereof. Said Lot 3
abuts upon Fifth Street South of Second Avenue South as shown on the
drawing attached hereto as Exhibit A and hereby made a part hereof.
Petitioner respectfully petitions the City Council of the City of
Hopkins to vacate, pursuant to the authority vested in it by Minnesota
Statutes, Section 440.135 (1978), the following described segment of
Fifth Street South, which segment is outlined in red on the attached
Exhibit A:
The South 33 feet of Fifth Street South lying westerly of the
extension northerly of the east line of Lot 3, Block 1, WARRINGTON
ADDITION, Hennepin County, Minnesota, according to the recorded
plat thereof, and easterly of the following described line:
Commencing at the southwest corner of said Lot 3; thence northerly
along the west line of said Lot 3 a distance of 167.65 feet;
thence continuing northerly along said west line on a tangential
curve concave to the west, having a radius of 234.00 feet, a
distance of 180.82 feet to the point of beginning of line to be
is described; thence continuing northerly along the extension of last
described curve a distance of 53.84 feet, more or less, to the
intersection with the north line of said south 33 feet of Fifth
Street South, and there terminating.
(hereinafter called the "Proposed Vacated Segment ").
For the following reasons, Petitioner believes that the vacation
of the Proposed Vacated Segment will be in the public interest:
1. Petitioner has acquired ownership said Lot 3 with a long term
lease back with Datasery Equipment, Inc. Petitioner desires
to acquire fee ownership to construct surface parking for
building user(s).
a. Said surface improvements would allow access for the City
of Hopkins to the fire hydrant situated at the Northeast
corner of vacation parcel.
b. We would relieve the City of Public Liability and
Maintenance of surface parcel.
c. Parcel would be taxable, therefore revenue producing.

granted, shall be subject to the right of any person, corporation or
municipality owing or having control of any electric light, telephone
poles or lines, sewer or water pipes, or mains or hydrants existing upon
or under the Proposed Vacated Segment at th,e time of the vacation to
enter upon the Proposed Vacated Segment for the purpose of repairing the
same or otherwise attending thereto.

Dear Mr. Kerrigan:

I have received the notice of Hearing relating to the vacation of the South
one - half of Fifth Street South.
It seems impractical to me to vacate one half of the street without vacating
the other. I therfore request that both halves of said street be vacated
at the same time.
