Variance-Exceed Max Sq. Footage for Sales LotSeptember 18, 1984 Case No: 84 -32 Applicant: Ryan Construction /Walser Properties Location: 314 Excelsior Avenue West Request: Variance to exceed the maximum square footage for sales lot STAFF FINDINGS AND COMMENTS: Anderson 1. Applicant is requesting a variance to exceed maximum area of an auto sales lot. Ordinance 427.36(A) requires the sale lot shall not be larger in square footage than the square footage of the building devoted to the related business. 2. The proposed building is 31,838 square feet and the sales lot is 58,218 square feet. 3. Applicant is requesting a variance to have a two month supply of new cars and a 45 day used car supply. The applicant has stated approximately 400 cars are needed to be stored on the site. 4. Ordinance 427.23 states that variances shall be approved only by circumstances unique to the property under consideration would cause undue hardship to owner. The applicant stated that if the lot was limited to the square footage of the building the project would be unfeasible by limiting show cars to 115 vehicles. 5. The applicant has met with the neighborhood association and received approval. • FOR VARIANCE APPLICATION ONLY NOTE: The purpose of a variance is to provide relief to a property owner when the strict enforecment of the Zoning Ordinance would cause.an undue hard - ship to the property owner or deny reasonable use of the.property.
