Side & Frontyard Variance1 October 24, 1984 Case No: 84 -36 Applicant: Louis Gainsley Location: 428 Cottage Downs Request: Side yard and yard variance STAFF FINDINGS & COMMENTS: Anderson 1. Applicant is proposing to construct a 16 x 25 foot addition to an existing home at 428 Cottage Downs, an R -1 -D District. 2. The proposed addition will be approximately 9 feet from the side yard and approximately 21 feet from the front yard. Ordinance 427.31 requires in an R -1 -D district a side yard setback of 10 feet and a front yard setback of 35 feet. A variance of l foot is needed for the side yard and 14 feet for the front yard. r� 3. Ordinance 427.23(3) states a variance be granted in cases where literal enforcement of the ordinance would cause undue hardship to the owner due to circumstances unique to the property in question. The applicant has stated that he needs the variance because the home is angled on the lot. 4. The site of the proposed addition is approximately 16,000 square feet. Ordinance 427.07 makes the site a legal lot. However, the minimum re- quired lot size for a lot if it were platted in an R -1 -D District today is 20,000 square feet. 5.
