Variance-To Construct Grocery Storage AreaNovember 20, 1984 Case No: 84 -42 Applicant: Michael Tait Location: 25 - 11th Avenue North Request: Variance to construct grocery storage area STAFF FINDINGS & COMMENTS: Anderson I. Applicant is requesting a rear yard variance to construct a grocery storage area at 25 - 11th Avenue North, the present site of Taits Super Valu. The sub- ject site is zoned B -2. 2. The applicant is proposing to construct a 2352 square foot addition at the rear of the existing building. The proposed addition would be constructed of cement block and sprayed to go with the current decor. 3. Ordinance 427.35 requires a rear yard in a B -2 District of 10 feet. The appli- cant is requesting a 10 foot variance and thus there will be no rear yard set- back. 4. Ordinance 427.23 states that a variance be granted in cases where strict enforce- ment of the ordinance would cause undue hardship due to circumstances unique to the property. The applicant has stated that he needs the variance for safety reasons and also without this added space the store is really hard to maintain with the volume we are at, this added room would solve a lot of those problems. 5. The subject site has a liquor store to the east, First Bank Drive -in to the north, the library to the west and a parking lot to the south. 6. The applicant has contacted six neighbors; none were opposed to the proposed addition. I* • FOR VARIANCE APPLICATION ONLY NOTE: The purpose of a variance is to provide relief to a property owner when the strict enforecment of the Zoning Ordinance would cause an undue hard ship to the property owner or deny reasonable use of the property. Hardship to the applicant is the crucial test. Variances will be granted only in unusual situations which were not foreseen when the Zoning Ordin- ance was adopted. Economic situations are seldom unique and are rarely considered a valid hardship. Hardship A. Explain why strict enforcement of the Zoning Ordinance would cause undue hardship: The biggest reason I am asking for this variance is saftpy, Without this added space the store is really hard to mainta • with the volume we are at. this added room would sol n a lot of those problems. Conditions B. What are the special conditions (shape of lot, exceptional topographic conditions, etc.) of this request that are unique to this property and do not apply generally to other properties in the district?
