10-30-1984A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, October 30, 1984, at 7:30 p.m., in the Council Chambers of the City Hall Present were Chair Eddy, members Berg, Kirscht and Milbert. Also present were City Manager Craig, City Engineer Strojan, Community Development Director Kerrigan and Community Development Analyst Anderson. Item: Mr. Berg moved and Mr. Milbert seconded a motion that the minutes of the September 25, 1984 meeting be approved and signed. Motion carried. Case No: Hearing on an application by James Justus for a variance to exceed the 84 -29 allowable square footage for signage at 330 11th Avenue South continued 30 -155 from the September 25, 1984 meeting. Mr. Justus reviewed the revised plans with the Commission. Action: Mr. Kirscht moved and Mr. Berg seconded a motion recommending to the Council approval of the revised request of 1765 sq. ft. of signage based on use of County Road 3 as frontage for the business in figuring the allowable signage. Motion carried. Ms Eddy voting nay. Case No: Hearing on an application by Ryan Construction /Walser Properties for a 84 -33 variance to erect a sign which exceeds the maximum allowable height and 156 -650 a variance for three signs to exceed the maximum area, continued from the September 25, 1984 meeting. Mr. Jerry Wayne of Walser and Mr. Jim Zahn of Ryan Construction reviewed the revised plans with the Commission. Action: Mr. Berg moved and Mr. Kirscht seconded a motion recommending to the • !y: .a. Council approval of a variance for a sign not to exceed 53' in height; facia signs on east and south sides of the building not to exceed 308 sq. ft. each, based on the need for adequate visibility both from County Roads 3 and 18; and enter /exit signs not to exceed 2k'x6'. Motion carried unanimously. Case No: Continued hearing regarding the Conditional Use Permit for construction 84 -31 of the Walser building that the applicant was to submit a fencing and 947 -1139 landscape plan at a subsequent meeting for the northerly parcel to be used as a storage lot. Mr. Zahn stated that the chain link fence would be on the west property line, 4 "x4' post and chain fence on the front property line, perimeter lighting, resodding of 10' setback and repair of lot surfacing. Action: Mr. Milbert moved and Mr. Kirscht seconded a motion recommending to the Council approval of the fencing and landscape plan for the northerly parcel as presented. Motion carried unanimously. Case No: Hearing on an application by Ryan Construction /Walser Properties for a 84 -37 Conditional Use Permit to locate a fuel storage tank at 314 Excelsior 651 -945 Avenue West. The applicants stated the need for a fuel storage tank on the premises and the-fact that the Conditional Use Permit granted previously stated that there would not be fuel storage tank on the site. Action: Mr. Berg moved and Mr. Kirscht seconded a motion recommending to the Council approval of the Conditional Use Permit to locate a fuel storage tank at 314 Excelsior Avenue West subject to review and approval of the Fire Marshal and a location other than to the north of the structure based on necessity to the use of the property and was not included as a condition of the previous Conditional Use Permit. Item: Review of previous Planning and Zoning action regarding the U -Haul 1149 variance to allow residential use on first floor within a business 1223 district. Action: Mr. Berg moved and Mr. Kirscht seconded a motion recommending to the Council that the residential use be continued and that the annual review be deleted. Motion carried unanimously. Case No: Hearing on an application by Louis Gainsley for a side yard and front 84 -36 yard variance to construct an addition to the existing structure at 1225- 428 Cottage Downs. Tape 2 0 -30 Mr. Gainsley reviewed the request with the Commission and stated that he had talked with the neighbors and that they were in agreement with his plans. Action: Mr. Milbert moved and Mr. Kirscht seconded a motion recommending to the Coucil approval of the variances due to the irregularity of the lot and the fact that the neighbors have no objections to the request. Motion carried unanimously. Case No: Hearing to consider amending Hopkins Zoning Ordinance 77 -427 regarding 84 -38 signs, advertising lights and devices. 35 -215 Mr. Berg stated that he thought the CCDC and the Chamber should be contacted regarding the changes in the ordinance and that they should have some discussion with the businesses in the city. Action: Mr. Milbert moved and Mr. Berg seconded a motion that Chair send a letter with a copy of the proposed ordinance to CCDC and Chamber and the hearing be continued to the November 27th meeting. Motion carried. Case No: Hearing to consider amending Hopkins Zoning Ordinance 77 -427 by the 84 -39 addition of performance standards detailing landscaping requirements. 229 -452 Mr. Kirscht suggested two changes be made in the proposed ordinance. Action: Mr. Berg moved and Mr. Kirscht seconded a motion that subsection (a) under Section (10) be deleted. Motion carried. Mr. Kirscht moved and Mr. Berg seconded a motion that subsection (2) under (b) be changed from Coniferious to Evergreen. Motion carried. Mr. Kirscht moved and Mr. Milbert seconded a motion that Chair include the landscape ordinance with the sign ordinance to the CCDC and Chamber and continue the hearing to the November meeting. Motion carried. Item: Mr. Tom Kordonowy of Steiner and Koppelman and Mr. John Uban of Dahlgren 456- Associates explained the proposal for South Hopkins including the landfill Tape 3 site and the Hurley property. 0 -41 It was the feeling of the Commission that they should discuss the zoning of the entire area before any action could be taken. Item: Mr. Paul Lund of 614 West Park Valley Drive spoke to the Commission in 43 -500 regard to home occupations in residential areas. He stated that auto repair is taking place at 5th Street & 5th Avenue South; 6th Street & ?1 5th Avenue South; and 7th Street & 7th Avenue South. He asked that the l� Ue City staff investigate the areas mentioned and also that they check to see how Eden Prairie and Edina ordinances handle the parking problem related to home occupations. Mr. Greg Smith at 5th Street & 5th Avenue stated that he conforms to the ordinance in that he contains all vehicles in his garage and keeps things clean and neat and he also had a letter from the neighbors that they do not object to his working on cars in his garage. • '24!; .a, Page 3 of Zoning & Planning minutes of October 30, 1984.
