Case No: Hearing on an application by Edward Robbins for variances for side yard, 84 -40 rear yard, floor area ratio and for the expansion of a non - conforming use 328 -481 to construct an addition to the existing building at 62 - 6th Avenue South. Eric Robbins reviewed the request with the Commission and stated that with the proposed addition the entire building would be painted to give a new image. Mr. Kirscht moved and Mr. Berg seconded a motion recommending to the Council approval of the variances for side yard, rear yard, floor area ratio as the permanent structure would be an improvement to the property, the present arrangement is not conducive to year around use and the unique shape of the parcel. Motion carried. Mr. Folk voting nay as he feels there is no hardship involved and he is not in favor of enlarging a non - conforming use. Motion carried. • A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, November 27, 1984, at 7:30 p.m., in the Council Chambers of the City Hall. `- Present were Chair Eddy, members Berg, Folk, Janke, Kirscht and Milbert. Also present were City Engineer Strojan, Community Development Director Kerrigan and Community Development Analyst Anderson. Mr. Craig arrived at 8:30 p.m. Item: Mr. Berg moved and Mr. Milbert seconded a motion that the minutes of the 4 -5 October 30, 1984 meeting be approved and signed. Motion carried unanimously. Case No: Continued hearing to consider amending Hopkins Zoning Ordinance No. 77 -427 84 -38 regarding signs, advertising lights and devices. 6 -175 Dave Zak of Aztec Tanning favors 60 days to 30 days for temporary signs. It was also suggested that in the future window signs, overhanging signs and the materials used in signs should be reviewed. Mr. Berg moved and Mr. Folk seconded a motion that the wording in Section 427.42(7) be changed to read as follows: "Temporary Signs: Temporary signs, banners, pennants, and portable signs (excluding political, real estate and For Rent signs) shall not be erected or placed without a sign permit from the City of Hopkins. Such permits may be issued for a maximum of 30 days per year (30 days may be allocated throughout the year at the discretion of the applicant. A business under new ownership may have a temporary sign for up to an additional 30 consecu- tive days immediately following the opening for business." Motion carried unanimously. Case No: Hearing on an application by Howard Goltz of Landico, Inc. for a Conditional 84 -41 Use Permit to allow a parking lot on the vacant parcel of land between 509 488 -653 and 601 Second Avenue South. Terry Godoll of Data Sery and Howard Goltz of Landico Inc. reviewed the request for the parking lot on the vacant parcel with the Commission, and the future expansion plans for an additional 38 employees in 1985. Mrs. Mogush asked that Mr. Goltz explain who Landico is in relation to the Data Sery and Warrington properties. He stated that Landico is an Archi- tectural Design company working with Data Serv, occupant of the property at 509 Second Avenue South, owned by Lombard Properties. Mr. Folk moved and Mr. Berg seconded a motion recommending to the Council approval of the Conditional Use Permit to allow parking on the vacant parcel of land between 509 and 601 Second Avenue South. Motion carried unanimously. Case No: Hearing on an application by Michael Tait for a 10 foot rear yard variance 84 -42 to construct a grocery storage area at 25 -11th Avenue North. 655 -777 Mr. Tait explained the request to the Commission and stated that the re- quest is for additional storage that would also increase safety for employees. It was suggested that Mr. Tait obtain a maintenance easement from the First National Bank being that the building would be so close to the lot line. He stated that would be no problem. O __ 0 Mr. Janke moved and Mr. Berg seconded a motion recommending to the Council approval of the variance to construct a grocery storage area at 25 -11th Avenue North for the safety of employees and it would also lessen the traffic congestion on 11th Avenue North. Motion carried. Mr. Folk voting nay as he feels the use of the property was overbuilt and that there is no hardship. Item: Discussion regarding hone occupations and related parking problems. 778 -1097 Staff checked to see how Edina and Eden Prairie handle the problem. Their ordinances are more restrictive. Residents of Park Valley spoke in favor of making our ordinance more re- strictive in regard to home occupations. Mr. Craig explained the enforcement process. Staff was instructed to request a police report on the three properties mentioned as having car repair on their property and also to find out if the properties mentioned are owner occupaied or rental. Staff is to review the city ordinances in regard to this problem and report at the January meeting. Item: Discussion regarding the zoning of property in South Hopkins. 110 - Tape 2 The Commission discussed a number of possibilities in regard to the zoning 70 of the Hurley property. Mr. Tom Kordonowy asked for Commission opinion in order to give Steiner & Koppelman some indication of possible future Zoning and Planning action. The impact of the proposed road requested by the City of Minnetonka on the Hurley property and possible financial participation of the City of Hopkins was discussed.
