RESOLUTION NO. 83 -3010
A RESOLUTION ORDERING ABATEMENT OF NUISANCE
BY REMOVING CERTAIN INFECTED ELM AND /OR OAK
TREES IN VARIOUS LOCATIONS IN THE CITY OF
HOPKINS.
WHEREAS, pursuant to City of Hopkins Ordinance No. 79 -467 and pursuant to
M.S.A. Chapter 18, and pursuant to Chapter 4, Rules and Regulations of the Department
of Agriculture (AGR- 101 -120), the forester of the City of Hopkins has found conditions
indicating the presence of Dutch Elm or Oak Wilt infestation exist and have existed
upon the following properties:

29 - 17th Avenue North $156.00
418 - llth Avenue North $156.00
234 - 8th Avenue North $210.00
134 - 5th Avenue North $162.00
500 - 6th Avenue South $150.00
602 - 6th Avenue South $132.00
202 - 20th Avenue North $138.00
237 - 9th Avenue North $186.00
WHEREAS, notice of such findings has been given to the owners of record of the
WHEREAS, no part of said infected trees has been removed or otherwise treated.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Hopkins, as follows:
That the premises of said infected trees, which are in number as listed and have
been and are duly marked and are located as listed, constitute a public nuisance as more
fully set forth in the provisions of Hopkins Ordinance No. 79 -467 H.S.A. Chapter 18, and
Rules and Regulations of the Department of Agriculture (AGR 101 -120), and such nuisances
are hereby ordered to be immediately abated by the cutting and removal of all such infected
trees thereon.
It is further ordered that a Notice of the intention of the Council so to abate
said nuisance shall be published once and a copy thereof mailed to the affected property
owners, which Notice shall specify that action upon this Resolution shall be taken,at a
special meeting of the City Council to be held on July 20, 1982, such publication to be
not less than one week prior to the date of such meeting.
The Council at such meeting shall hear all property owners with reference to the
above matter. It is further resolved that a copy of this Resolution shall be mailed
immediately to the owners of the property involved herein.
Passed and adopted by the Council of the City of Hopkins, Minnesota at a regular
meeting held the 20th day of July, 1982.
