September 28, 1984 M E M O TO: Hopkins City Council FROM: George Magdal, Fire Marshal SUBJECT: Pines Mobil Home Community Please find attached results of inspections done at the Pines on September 25th through 27th, 1984. Nearly all the items listed on these reports are "NEW" and have not been cited on previous in- spections. The State Health Department was unable to attend these inspections, as previously scheduled. They hope to reschedule their inspection for the first week in October. It is this inspector's opinion that the park has made marked improvement in the past year. The house has been painted, outside storage has been reduced, the fire lanes have been widened, and additional paved off - street parking has been provided. Although there is still a ways to go, improvements are being made. The following is a break down of the agreement and the action taken by the Pines to comply. Item #1 - Plot Plan : This is not due until July 1, 1985. Item #2 - Mobile home compliance with set -back requirements : This is not due until July 1, 1985. Item #3 - The city and the Pines pledge to cooperate to achieve the requirements of item number 2 above. The reasoning behind allowing nearly two years for compliance of the set -back requirements was that the city did not want to see any hardship placed on residents of the park who currently have non- complying homes. The intent is to place homes a safe distance apart from each other, which may or may not change the density of the park. The three ways to achieve this are: 1. Remove a non - complying home from the park. 2. Reposition the home on its existing lot. 3. Move the home to a larger lot within the park. Page 2 Removing a home, although legal by state statute, is a last resort. Most of the homes are too old to be allowed into other parks. Without a lot; these homes would become nearly worthless. Repositioning a home will work, but not in all cases. Moving a home to a larger lot within the park is the only way some of these people can keep their homes. To do this, the park must have a vacancy. There have been three vacancies since the signing of the agreement in November of 1983. In all three cases, the park management has elected to bring in additional homes from outside the park. The park may have a plan to meet all set -back requirements by July 1, 1985. This is something we will not know until we receive the plot plan due on that same date. It is my opinion that the Pines is counting on the city to be lenient in our enforcement of that section and not displace any residents. I question whether the Pines is in compliance with Section 3 of the agreement, which states that they will take reasonable effort to achieve compliance with set -back requirements. Item #4 - Provide 15' wide fire lanes. This item has been com- pleted. Items #5 & 6 - Provide 1 -1/2 parking spaces of approximately 9' by 20' per home and paving the same. Due July 1, 1984. This item looks nearly complete. Since the striping has either worn off or been paved over, it was impossible to count the number of spaces. It appears they will meet this require- ment. The parking for unit numbers 202 through 208 was recently re- striped, giving 8' wide spaces per car. The assistant manager of the park stated he was unaware the measurements were incorrect, and he would re- stripe it correctly. Orders have been issued to insure compliance with the above. Item #7 - The park rules and regulations are to include lot and exterior home maintenance. This has been completed and a copy is attached. Craig City Manager Hopkins, Minn 55343 September 25, 1984 Dear Bill; At your request I inspected the Pines Mobile Home Community today. This was done in cooperation with the Fire Marshall, the Plumbing Inspector, and the Sanitation Officer for junk cars,who also did their inspections at the same time. I found the following violations of Ordinance 1030 which deals with Garbage, Rubbish, Sanitation, Litter, and Open Storage Regulations. 1.An old mattress up against the north outside wallcof the office building. 2.A garage- maintenance building is across from the office. Around this building I found a pile of brush and old lumber, logs and pieces of old power poles, ladders, two bicycles, one small home made two wheel trailer,a cement mixer, fireplace wood, a barrel, pails, an old reel lawn mower, steel posts, and a garden tractor, and asmall street sweeper. Motor vehicle parts in the same area are two bucket seats, three tires and wheels, four engines, two hoods, and one drive shaft,and one front frame. On the roof of the buildingwas one auto bumber, a metal frame for a sign or something similar, and three steel rods with box ends which are used to shut off water mains. All this material is in an area of about fifty square feet. 3.The following twenty four trailer lots had these violations. Lot 106 Brush and litter Lot 115 Litter Lot 121 Brush Lot 209 Garbage Lot 305 Old Tires Lot309 Litter Lot312 Tires and an old air conditioner Lot 321 Brush Lot 405 Litter and an old carpet Lot 412 Tires and litter Lot 504 Old Furniture and litter Lot 518 The remains of an old storage shed Lot 520 Firewood scattered all over the yard Page two Lot 524 This yard is full of many stored items which should all be in a building. Lot 528 Litter Lot 530 Old Tires Lot 537 Old carpet and a bathtub Lot 542 Litter and ladders, sheets of plastic, cement blocks, boxes, old storm windows, andpieces of metal. Lot 544 Brush Lot 548 An old car and an engine Lot 549 Brush Lot 556 An old dead tree about thirty feet high Lot 559 Litter It appears the brush is from the trimming of bushes and trees. It should be removed soon before someone falls over it in the dark. It is amazing that this place is not full of rats due to the many places they would have to live and feed. Due to changes in the police records system, I do not have accurate records about the Pines Park. But I can say the place has been a constant problem since the present owners took over. The person I have delt with mostly is Dick Mathews. He has received many citations about garbage and litter. He always complains that he was not properly warned about the violation but the courts hold that the previous citation was warning enough. The most frequent problem has been the old truck used to haul awaytrash and rubbish. It would sit by the maintenance building until it was over- flowing. Often it contained garbage and the smell was unbearable in the summer. Mr. Mathews always believes he is cooperating fully with me and expresses himself as being picked on. These present violations have been presented to the Pines resident manager. One thing omitted is that most of the resident garbage cans have no covers and in many cases there are not enough garbage cans. tted by: 7 Weckman Sanitation Officer City of Hopkins George Magdal Fire Marshal City of Hopkins LEA /ceu CITY OF HOPKINS 1010 FIRST STREET SOUTH • HOPKINS, MINNESOTA 55343 • 612/935 -8474 September 25, 1984 Dear Mr. Magdal, Upon your request; I was asked to accompany you on an inspection of the Pines Trailer Court at 2012 Excelsior Avenue West, Hopkins, in regard to violations of City Ordinance 1035 - Junk Auto's. At approximately 1100 hours; 9-25-84; I checked the Pines Trailer Court for any and all violations of Ordinance 1035 - Junk Auto's, and found the following: 1. License EKK768, a green 2 door Ford Mustang which had its motor removed, hood off, and expired tabs. Citation 384 - 004459 was written for Certain Vehicles Declared a Nuisance. 2. License BJX940, a light green, 4 door Ford Galaxie, which had expired tabs. This is the same auto that was in violation on May 25; 1984, and at that time photos were taken. Nothing had been done. Citation 384- 004460 was written for Certain Vehicles Declared a Nuisance. 3. By Lot 548, an old car body was standing next to the trailer home. The engine was out of the auto and lying on the grass. 4. By Lot 554, a Ford Station Wagon, license ESJ191, was parked in the driveway by the trailer house. This is the same auto that was parked along trailer house 553 on May 25, 1984. Again nothing was done. The auto was moved from alongside, to across the driveway from Lot 554, as a parking lot was made from Lots 545/547. 5. I. Overhead distribution system meets requirements of National Electrical Code. See page 22 of N.S.P. Electric service equipment which is an extract from this tandare. Conductors do not have to be insulated, but are weather proof and not `considered insulated. This system was installed about 30 years ago and covering has fallen off. Clearances.meet requirements of #1 and #7 of diagram II. Hazardous conditions noted in park. 1. Dead branches lying on overhead conductors back of unit 537. 2. T. V. Aerial to close to wires on unit 401. 3. Supply cord to Unit 543 lying on top of ground and walkway. 4. Conductors twisted together above unit 551 5. Wire outside outlet property - unit 551 6. Replace Romex with proper cord unit - 546. III. Cords laying on top of units are permissable as they are all "Heavy Duty 41 1 ,, A copy of item II was given to park manager for correction. • - .� -��- FROM David Fischer SUBJECT Pines Trailer Court: CITY OF HOPKINS INTER- OFFICE MEMO TO William Craig DATE September 25 19 84 During my inspection on September 25, 1984 and all my other appearances in the past few years I have come across a lot of serious problems at this trailer court. Number one is the sewer. Everytime there is a plug or clogging of the sewer there is raw sewage running over the ground and down the street which is a very insanitary and unenvironmental condition. According to the Minnesota Plumbing Code, Minnesota Health Department Rules and Regulations MHD 120 Basic Plumbing Principles: "This code is founded upon certain basic principles of environmental sanitation and safety through properly designed, acceptably installed and adequately maintained plumbing systems. Some of the details of plumbing construction may vary but the basic sanitary and safety principles desirable and necessary to protect the health of the people are the same everywhere. (h) The drainage system shall be designed, constructed and maintained to conduct the waste water with velocities which will prevent fouling, deposition of solids and clogging. (j) The drainage system shall be provided with an adequate number of cleanouts so arranged that in case of stoppage the pipes may be readily cleaned." (t) Plumbing systems shall be maintained in a safe and serviceable condition from the standpoint of both mechanics and health." When I was making my inspection there was a sewer cleaning company cleaning out a plugged sewer again. While I was watching they pulled out a large mass of roots on the sewer cleaning rod. The Pines Trailer Court does not have the proper clean outs for the sewerage system. The manholes are just a concrete ring laying over the hole and when the sewer is plugged the sewerage seeps out and runs over the ground. Also, the sewer connections between the trailers and sewerage system are not sealed so the sewerage also runs under the trailer. ti William Craig The result of the rest of my inspection is as follows: #104 and 106 - sewer cleaning in process. #101 - parking stall blacktopped over sewer connection. For the safety of all residents of the park break in the top of the old septic tank, fill in with clean fill and then blacktop. All work to be done by a licensed and bonded company. • PINES MOBILE HOME COMMUNITY 2012 EXCELSIOR AVENUE HOPKINS, MN 55343 938 -8826 March 27, 1984 To Our Pines Mobile Hone Community Residents: Enclosed with this letter you will find a copy of our new revised park rules and regulations, and a revised park rental agreement, both of which will become effective on June 1, 1984. We encourage each of you to read these documents carefully since you will be expected to comply with these new rules and regula- tions commencing on June 1, 1984. This letter will also serve to introduce our new Assistant Park Manager, Dave Gustafson, who will be living in the park office /hone as of April 1, 1984 at which time he will be replacing Dave Caner as Assistant Manager. Dave Gustafson has just completed his time of duty in the United States Air Force. He was formerly employed at our St. Paul mobile home park and has considerable experience in mobile have park maintenance and management. This year we are committed to seeing an improvement in park maintenance and the general appearance of the park and residents lots. You will note that the new revised park rules requires residents to maintain their lots and if the resident fails to do this the park management will have the right to do so and to charge the resident for this work. We are planning to start sprucing up the park this spring with an intensive lot by lot clean up campaign. Once we get the park cleaned up it will be much easier to maintain it in this conaition. We want to ask each resident to cooperate with this program, as it will benefit all of us. GENERAL PURPOSE: These rules and regulations have been adopted to provide for the orderly and attractive maintenance of the mobile home park and to comply with the state statutes and regulations. Failure to abide by these rules and regulations may result in eviction from the park. II. PETS: There will be no dogs or cats permitted in the park under any circumstances. Tenants ignoring this rule will be subject to an eviction notice. III. PLANT AND USE OF MOBILE HOME: 1. The mobile home parked on said lot shall be used only for single family dwelling purposes. A limit of no more than two children will be permitted in a single family mobile home at time of entry. 2. All mobile homes shall he parked on or pulled from the lots under the supervision of the park owner or manager. At least 48 hours written notice shall be given the park owner or manager. 3. No mobile home shall be placed on the space rented in the park except the original unit for which the lot was rented unless consent is given by the lessor in writing. IV. RESIDENT' S. CONDUCT: 1. Residents will be held responsible for the conduct of their children and guests, and for any damage caused by them. Streets and vacant lots are not play— grounds and your children should not use them for that purpose. 2. No peddling, soliciting or commercial enterprise is allowed in the mobile home community without first obtaining the written consent of the Lessor. 3. Residents are expected to see that children under their custody obey these rules and regulations at all times and do not trespass on other resident's lots without permission of such residents. Repeated violations by resident's children of these rules and regulations of the park after written notice by the park owner or manager to resident shall be deemed to constitute a substantial annoyance to other residents. 4. No person shall engage in noisy or unruly abusive behavior on the park premises and no person shall interfere with the quiet enjoyment of other residents of the park or be drunk or under the influence of alcoholic beverages or controlled substances in public in the park. Such behavior shall be deemed to constitute a substantial annoyance to other residents. 5. If a resident has a complaint against another resident which they can not work out together, then said complaint or complaints by resident must be in writing to the park manager and signed by the complaining resident. V% HOME AND LOT MAINTENANCE: 1. it shall he the responsibility of residents to maintain their yards. The planting of flowers, shrubs and trees is encouraged. However, before doing any extensive planting or digging, residents should check with the office for proper locations. 2. Lots must be kept neat and clean at all times. If any articles must be kept outside, impairing good appearance of the yard, residents may be required to remove the article or else purchase an approved storage building. As amended, residents planning to build a storage shed must first submit a plan to the park for approval and obtain a building permit from the City of Hopkins. The storage shed cannot be closer than 10 feet from the next neighboring mobile home. 3. Lawn:, are to he mowed and watered, plus kept free from rubbish and debris by residents when necessary. if this is not done, the park manager will be instructed to do the necessary work and the resident will be billed up to $25.00 per time for the work. Excessive watering, causing runoff, will not be allowed. If necessary, the park may request that even and odd watering days be enforced. 4. No fences will be allowed unless written permission is obtained from the park manager. 5. Only umbrella night. 6. All porches and meeting the Minnesota State Building right to approve or disapprove plans Residents must also obtain a building permit from improvements. Any additions to your home must be the closest neighboring mobile home. 7. Air Conditioners. Window air conditioners must be supported by either metal straps or brackets, not wooden stands. No air conditioner shall be placed so that it occupies air or ground space other than that over the resident's leased space unless otherwise approved by the management in writing. It shall not be the park's financial responsibility to provide any modification in the electric service available to the lot to accomodate the resident's air conditioning unit. 8. Skirting must be of metal and approved by management to match or harmonize. Residents may be required to remove any unapproved skirting material or to repair existing skirting. Ventilation should be provided. There must be a door giving direct access to the water and sewer connections. If the skirting must be reproved for any kind of maintenance purpose, it will be the resident's responsibility to immediately replace the skirting. 9. Each mobile home shall have a ground support system meeting the requirements of Minnesota Statutes 327.31 to 327.34 and the Department of Administration, Building Code Division Rules for Mobile Home Support and Tie -])own Systems. Residents shall have the right to use, in common with other residents, the roads and all other facilities provided by the park owners for the use of the residents of The Pines Mobile Home Community. VIII. WATER AND SEWER SERVICES: Disposable diapers, sanitary napkins, paper towels and other large items must not be flushed down your toilet. Residents are also responsible for keeping their sewer pipe free from icing up during the winter months. Any expense incurred by the park management to open up such sewer stoppages will be charged to the resident causing the stoppage. Residents shall also be responsible for maintaining their exterior water line - keeping it free from leaks, having it properly insulated and heat taped, having a shut off valve in the line, and having the water riser pit area properly insulated. IX. OTHER MATTERS: 1. Emergency Evacuation Plan. All residents living in the 100 and 200 rows should exit the park via the main park entrance. Al] other residents should exit the park via the main park street exit at the end of the 500 row to Excelsior Avenue. 2. Storm Shelter. In case of severe weather warnings the nearest shelter is St. Joseph's Church of Hopkins, 1310 Excelsior Avenue, Hopkins. 3. Rental Payments. All rental payments are to be mailed to the following address: Inland Realty, Inc., 5200 wiilson Rd., Suite 401, Edina, MN 55424. By signing it you and the PARK agree to be bound by everything it contains. You also agree to follow any reasonable Rules and Regulations the PARK has in effect when you sign the Lease. Those Rules and Regulations are as binding as this Lease. Before you sign this Lease, make sure you understand both it and the Rules and Regulations. After you sign, ask for and keep a copy of this Lease and the Rules and Regulations. 1. DEFINITIONS: In this Lease "PARK" means the owner of THE PINES Mobile Home Perk and anybody working for the owner or acting on the owner's behalf. "RESIDENT" means the adults who have signed this Lease and anybody living with those adults. 2. RENTAL OF THE LOT: By this Lease the Resident rents from the park from month to month of approximate 5000 sq. feet, located at HOPKINS MN. Make: _ Model: Year. (THIS NOTICE IS DIFFERENT FROM THE NOTICE THE RESIDENT MUST GIVE TO TERMINATE THIS LEASE AND END HIS OR HER OBLIGATION TO PAY RENT. READ PARAGRAPH 18 OF THIS LEASE.) The PARK has the right to supervise the installation or removal of the RESIDENT's home, The PARK may give the RESIDENT reasonable instructions concerning installation or removal in order to protect the PARK's facilities or safeguard the homes of other residents. The RESIDENT must comply with these reasonable instructions. The PARK must not require the RESIDENT to use the PARK's services when the RESIDENT moves the home in or out of the mobile home park, unless the PARK provides those services without charge. If the PARK and the RESIDENT agree to have the PARK install or remove the mobile home, that agreement must be in writing, must state the price, if any, for the services and must be signed by the PARK and the RESIDENT. 7. SECURITY DEPOSIT: Before beginning to live in the mobile home park, the RESIDENT must pay the PARK $ 50.00 as a security deposit. The PARK must give the RESIDENT a written receipt for the deposit. When the RESIDENT moves from the mobile home park, the RESIDENT will give the PARK a forwarding address. Within 3 weeks of receiving the address, the PARK must either. - refund the RESIDENT's security deposit plus interest of 5% simple interest per year, or -write the RESIDENT stating that the PARK is keeping some or all of the deposit and explainging why The PARK will keep security deposit money only if the RESIDENT has moved out owing rent or it the RESIDENT has wrongfully damaged the PARK's property. The PARK must not hold the RESIDENT responsible for ordinary wear and tear or for damage due to extreme weather or other unusual causes beyond the control of the RESIDENT 8.USE OF THE LOT: The RESIDENT must use the lot only for residential purposes. The RESIDENT must not build improvements on the 101 or put a different home on the lot unless the PARK first agrees in writing. 9.AUTOMOBILES: The RESIDENT must register with the PARK office all automobiles regularly kept in the mobile home park. Only automobiles which can be parked in the area in front of the home are allowed. 10.LOT MAINTENANCE: The RESIDENT must maintain the lot according to the PARK's reasonable Rules and Regulations. The PARK must maintain the streets and common areas of the mobile home park and must obey all health. safety and building code regulations which apply to the mobile home park. If the RESIDENT fails to do lot maintenance work required by this Lease or by the PARK Rules and Regulations, such as cutting grass, removing garbage or debris, the PARK may tell the RESIDENT in writing that the work must be done If the RESIDENT does not do the work promptly alter receiving written notice, the PARK may do the work for the RESIDENT The PARK may then charge the RESIDENT for the reasonable costs of doing the work The PARK must make this charge in writing • • 11. EMERGENCY MAINTENANCE WORK: 11 undone maintenance work causes an immediate danger to the PARK facilities or 10 the health or safety of other residents, the PARK may tell the RESIDENT to do the necessary maintenance work immediately If the RESIDENT does not do the work Immediately, the PARK may do the work and charge the reasonable costs to the RESIDENT. The PARK must make this charge to the RESIDENT in writing. 12. PRIVACY: The PARK must not come into the RESIDENT's mobile home except if invited. or if it is necessary to respond to an emergency or prevent damage to the mobile home park. The PARK may come onto the RESIDENT's lot only by invitation or to inspect the lot, make necessary or agreed upon repairs or improvements, supply necessary or agreed upon goods or services, or to show the lot to prospective or actual buyers. residents, workers, contractors or mortgagees. The PARK must not come onto the RESIDE NT's lot at unreasonable times, or in a way that unreasonably disrupts the RESIDENTS use of the lot. 13. PERSONAL PROPERTY: The PARK is not responsible for damage to the RESIDENT's property unless the PARK causes the damage. The PARK is not responsible for any damage to the RESIDENT's property due to the interruption of service by any public utility. The PARK is not responsible for any damage to the mobile home or its contents due to vandalism, burglary or similar causes 14. STORAGE AREA: Before storing any property in the PARK's storage area, the RESIDENT must register the property with the PARK and show the PARK in writing either that the property is Insured or that the property has no insurable valu . The Rules and Regulations explain what types of property may be placed in the storage area if the park provides an area. 15. PROPERTY LEFT BEHIND: If the RESIDENT leaves the park and abandons his or her personal property (Including th mobile home), the PARK may remove the property and store it. If the PARK does store the property, the RESIDENT is responsible for the reasonable costs involved. Sixty days atter it reasonably appears that the RESIDENT has abandoned the property, the PARK may sell the property. The Park must make a reasonable effort to notify the RESIDENT by certified mail and by posting a notice in the park at least fourteen days before the sale. The PARK may use the money it gets from the sale to pay the reasonable costs involved in removing and storing the property and to pay any claims the PARK has against the RESIDENT for non - payment of rent or for damage to the park facilities. If there is money left over, and the RESIDENT make a written request to the PARK, the PARK must return the remaining money to the RESIDENT. If anytime before the sale, the RESIDENT demands in writing that the PARK return the property. and the property is on the park grounds, the PARK must allow the RESIDENT to get the property within 24 hours. It the property is stored elsewhere, the PARK must allow the RESIDENT to get the property within 48 hours, not counting weekends and holidays. 16. SUBLETTING: The RESIDENT must not sublet or assign this Lease or the lot to anybody without the park' r it ten permission . The RESIDENT does not have to inform the PARK of overnight visitors or other short-term guests who stay less than two weeks. But if any adult comes to live or stay regularly with the RESIDENT alter this Lease is signed, the RESIDENT must have that adult come to the PARK office to apply to become a resident and to sign this Lease. Unless the PARK has a good reason not to do so, the PARK must accept the application and allow the adult to sign this Lease. The PARK must not reject any application for any reason prohibited by federal, state or local law. The PARK must not apply stricter standards to the applicant than the PARK aplies to other prospective residents. If the PARK rejects an applicant and the applicant asks for a written explanation of the PARK's decision, the PARK must within three days give the applicant a written statement of the reasons. 17. You have a right to sell the home In the park. But the sale is not final until the park owner approves the buyer as a new resident, and you must advise in writing anyone who wants to buy your home that the sale Is subject to final approval by the park owner. You must also disclose in writing certain safety information about your home to anyone who wants to buy it In the park. You must give this information to the buyer before the sale, in writing, on the form that Is attached to this notice. You must completely and ac- curately fill out the form and you and the buyer should each keep a copy. Additional blank copies are available at the park office for a fee. 18. If the RESIDENT does not pay rent or utility charges on time: the PARK must give the RESIDENT written notice and allow the RESIDENT ten days to pay the full amount due The PARK must also give written notice to anyone the PARK knows has a mortgage on the RESIDENTS home If neither the RESIDENT nor the mortgage-holder pay the amount due within ten days after receiving the notice, the PARK may take the RESIDENT to Court B. If the RESIDENT refuses or fails to obey a law or government regulation relating to mobile homes or mobile h me parks: the PARK must tell the RESIDENT in writing what the RESIDENT is doing wrong If the law or regulation gives the RESIDENT a certain time to obey. then the RESIDENT must obey within that time If the law or regulation does not set a specific time limit, then the RESIDENT must obey within a reasonable amount of time.
