CR 10-026 Zoning Ordinance Amendement - Signs March 31, 2010 Council Report 10 -26 HOPKINS ZONING ORDINANCE AMENDMENT — SIGNS Proposed Action Staff recommends the following motion: move to adopt Resolution 10 -14A, denying proposed Ordinance 10 -1015, amending the sign ordinance to allow electronic changing signs to change every 12 seconds. At the Zoning and Planning Commission Mr. Jenny moved and Mr. Hatlestad seconded a motion to adopt Resolution RZ10 -1, recommending approval of proposed Ordinance 10 -1015, amending the sign ordinance to allow electronic changing signs to change every 12 seconds. The motion was approved on a 4 -1 vote. Ms. Newcomb voting nay. Overview The City has received an application for a zoning amendment from Holiday Companies for an electronic message center below the gas price sign. Although Holiday wants to change their sign, the amendment would affect more than their location. Holiday currently has a manually changeable sign on their pylon at the southwest corner of Excelsior Boulevard and 11 Avenue South. Holiday has submitted a proposed amendment, and it is narrowly focused on permitting this type of signage with limitations in the B -3 zoning district. The existing sign ordinance states the following: "Changeable copy sign — a sign or portion thereof with characters, letters, or illustrations that can be changed or rearranged without altering the face or the surface of the sign. Changeable copy signs do not include signs upon which characters, letters or illustrations change or rearrange only once in a 24 -hour period." Holiday could put up an electronic message center that allowed the sign to change once in a 24- hour period. Holiday is proposing that the sign change every eight seconds. Attached is the proposed language from Holiday. The proposed amendment would allow electronic changeable signs that change every eight seconds, and these signs would be allowed in the B -3 zoning district abutting State and County roads. The existing ordinance allows electronic signs, but they can change only once every 24 hours. What additional information has been submitted since the February meeting? Attached are the ordinances from Minneapolis and St. Paul. The ordinances allows electronic signs to change every eight and 12 seconds respectively. The ordinances also have areas where the electronic signs can change every hour or 20 minutes. Attached is a city news release from the City of Eagan allowing electronic signs to change every 20 minutes. This change in Eagan occurred in 2007. • What changes were made to the proposed ordinance? The following additional language was added: • Limit the operation of the sign to the hours when the business is open • Require that there is no sound emitted from the sign • Require the electronic sign to be the lowest panel on the sign • What is the staff recommendation? Staff is recommending denial of the proposed ordinance. The applicant can erect this type of sign now, and it can change once every 24 hours. • What was the discussion at the Zoning and Planning meeting? The Commission reviewed this item in February and continued it until March to get more information from the applicant. The applicant provided the Commission with Minneapolis and St. Paul sign ordinances relating to electronic signs. Mr. Cronin also provided information on where additional electronic signs can be constructed with the proposed ordinance. Ms. Anderson went over the additional information provided. Mike Cronin, representing Holiday Companies, and Dave Eduqist of Holiday Companies appeared before the Commission. The Commission discussed the various signs they had observed after the February meeting. Ms. Cummings, Mr. Skiermont, Mr. Jenny and Mr. Hatlestad were in favor of a 12 second interval for the sign changing. Ms. Newcomb favored a 60 minute interval. CR10 -26 . Page 3 Alternatives 1. Approve the amendment to the zoning ordinance. By approving the amendment to the zoning ordinance, the zoning ordinance will be amended. If the City Council considers this alternative, findings will have to be identified that support this alternative. 2. Deny the amendment to the zoning ordinance. By denying of the amendment to the zoning ordinance, the zoning ordinance will not be amended. 3. Continue for further information. Code Chapter 64, Signs, revising and updating 2 existing language, adding new language regarding signs with dynamic display, 3 removing redundant language regarding billboards with dynamic display, and 4 removing obsolete language regarding electronic message signs. 5 SUBSTITUTE ORDINANCE 6 WHEREAS, the Planning Commission, on March 27, 2009, released a draft Signs with Dynamic Display Ordinance 7 for public review, and set a public hearing for April 24, 2009; and 8 WHEREAS, a public hearing on the proposed Signs with Dynamic Display Ordinance was conducted by the 9 Planning Commission on April 24, 2009 at which all persons present were allowed to testify; and 10 WHEREAS, the Planning Commission considered the public testimony and recommendations of its Neighborhood 11 Planning Committee on the proposed amendments to Chapter 64, Signs, and made its recommendations to the 12 Mayor and City Council on August 21, 2009; and 13 WHEREAS, a public hearing before the City Council having been conducted on October 21, 2009, and December 2, 14 2009, at which all interested parties were given an opportunity to be heard, the Council having considered all the 15 facts and recommendations concerning the amendments; NOW THEREFORE, 16 THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: 17 18 Section 1 19 That Legislative Code Chapter 64 is hereby amended as follows: 20 Sec. 64.101. Intent and purpose. 21 The purpose of this chapter is as follows: 22 (a) To regulate the time, place, and manner in which signs may be exhibited; 23 (b) To protect the right of information transmittal; 24 (_X-a) To promote the public health, safety and general welfare of the community; 25 (d)(b)TQ encourage a concern for the visual environment which makes the city a more desirable place to live; 26 fe Ee) To identify and promote business and industry in the city; 27 (f)(d) To reduce hazards which may be caused by signs projecting over public rights -of -way; 28 (g)(e)To protect open space and areas characterized by unique environmental, historical and architectural resources; 29 s b _ • 30 (h)(g)Along advanced speed arteries, to promote the safety, convenience and enjoyment of public travel, to protect 31 the public investment in highway beautification, and to preserve and enhance the natural scenic beauty or the 32 aesthetic features and roadways in scenic and adjacent areas; 33 fl(h) To reduce the number of nonconforming signs in the iety city, particularly billboards; 34 (j)(i) To control the quality of materials, construction, electrification and maintenances of all signs; and 35 (k)(i) To provide for the administration of this chapter.; and, 36 09 -1015 37 Sec. 64.104. Nonconforming advertising signs; conversion to billboard with dynamic display. 58 (b) Except in a B4 or B5 zoning district, a legally nonconforming, illuminated billboard may be converted to a 59 billboard with a dynamic display if the following conditions are met: 60 (2) The billboard is located at least one (1) mile measured lineally along the freeway from any other 61 billboard with dynamic display designed to be read by drivers heading in the same direction on the 62 highway. 63 (c) In addition to the other regulations in this chapter, a billboard with a dynamic display shall conform to the 64 following operational standards: 65 (1) All alpha- numeric copy must be at least fifteen (15) inches high. 66 (2) The images and messages displayed must be static, and the transition from one static display to another 67 must be direct and immediate without any special effects. ( Each image and message displayed must 68 be complete in itself, and may not continue on the subsequent one. Signs with dynamic display. 88 (a) Location and orientation. Business signs with dynamic display shall be at least seventy -five (75) feet, as 89 measured along the road, from a residential district, and shall be at least fifty (50) feet from a residential 90 district, measured radially. No sign with dynamic display may be of such intensity or brilliance that it interferes with the 106 effectiveness of an official traffic sign, device, signal or the safety of the public, or located where it would do 107 so as determined by the city traffic engineer. If there is a violation of the brightness standards, the adjustment 108 must be made within one (1) business day_upon notice of non - compliance from the city. 109 (d) Malfunction, Signs with dynamic display must be designed and equipped to freeze the sign face in one 110 position if a malfunction occurs. Signs with dynamic display must also be equipped with a means to 111 immediately discontinue the display if it malfunctions, and the sign owner or operator must immediately turn 112 off the display when notified by the city that it is not complying with the standards of this ordinance. 113 (e) Image characteristics, duration, and transition. The following standards shall apply to image duration, 114 transition, and other characteristics of signs with dynamic display. As we agreed when we met last Thursday I have done an initial analysis for you to review and pass on to the Commissioners. The first attachment uses the City of Hopkins Zoning Map from the website to identify the locations of the areas in the City zoned B -3. The following pages provide a more detailed look, including parcel information from the County, at the five areas and the sites in those areas that would be potentially eligible for effective use of an EMC. The five areas are: 1 11th Avenue & Excelsior Blvd. 2 Shady Oak & Main Street 3 Hwy & Hopkins Crossroads 4 Hwy ? &Blake Road 7 Walser Detailed reviews were not prepared for the other areas in the City zoned B -3 for these reasons: Area 3 south of Hwy 7. The B -3 district is south of Hwy 7 on 17th Avenue. Cty 73 does not extend south of Hwy 7. Area 5. None of these parcels have 370 ft of frontage. The auto repair north of 2nd Street has a combined 337 ft of frontage on Blake Rd and 2 Street. The Oasis has a combined 224 ft of frontage. The Bakers Square has 206 ft of frontage on Blake Rd. If the redevelopment of the currently vacant Oasis and Baker's Square sites combines these parcels, the redevelopment would have more than 370 ft of frontage. Area 6. Blake Schools has acquired this limited B -3 area (what I recall as a former service station site) and combined it into their parcel. The Blake parcel has more than 370 ft of frontage on Excelsior Blvd. Blake would be eligible to relocate their sign from their entrance to the corner of Blake Rd. and Excelsior Blvd. Area 8. This part of Main Street is not a County or State Highway as required by the amendment. Area 9. l lth Avenue is not a County or State Highway as required by the amendment. Also, we respectfully request an amendment to our request to reduce the minimum frontage from the initially proposed minimum of 500 ft of frontage to 370 ft. As I was calculating the frontage for the Auto Mall and Wendy's I realized I did not use the correct frontage for the Holiday Stationstore. The reduced minimum of 370 ft rather than 500 ft will allow effective use of an EMC at Holiday and Tuttle's on Shady Oak Rd. Reducing the minimum qualifying frontage further would include the additional properties as noted in the descriptions of the qualifying areas. I am encouraged by the results of the review. There were no surprises at the 370 ft minimum frontage. I think we have been conservative and accomplished our goal of restricting the initial effective EMC's to only the most commercially developed districts and to only the most compatible sites in those areas. That an application for zoning amendment was made by Holiday Companies on January 22, 2010; 2. That the Hopkins Zoning and Planning Commission published notice, held a public hearing on the application and reviewed such application on February 23, 2010 and March 30, 2010: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered. Maxwell, Mayor Terry Obermaier, City Clerk CITY OF HOPKINS Hennepin County, Minnesota ORDINANCE NO. 10-1015 AN ORDINANCE ALLOWING DYNAMIC SIGNS THE CITY COUNCIL OF THE CITY OF HOPKINS HEREBY ORDAINS AS FOLLOWS: 570.05 Subd. 66. Dynamic changeable copy sign. An electronic changeable copy sign capable of displaying and by remote or automatic means changing or rearranging the words, symbols, figures or images it displays. Other definitions listed in Section 515.07 are to be renumbered accordingly. 570.44 Dynamic Changeable Copy Sign Subd. 1. District. A site within the B -3 district with frontage on a state or county highway. Subd. 2. Frontage. Frontage on a public right -of -way at least 370 ft. Subd. 3. Type. The dynamic sign may be located on a freestanding sign and shall be the lowest on sign. Subd. 4. Direction. The face or display of the dynamic sign must be perpendicular to the boundary of any adjoining residential district. Subd. 5. Number of dynamic signs. There shall not be more than one (1) dynamic sign located on a lot. Subd. 6. Maximum display area of dynamic signs. The sign area of a dynamic display sign shall not exceed thirty -two (32) square feet. The area of dynamic signs shall be included in the calculation of the total permitted sign area for the site. Subd. 7. Character of the message and display. Signs with dynamic display must contain only static and stable text and /or images. Other modes of displaying messages, including scrolling, are prohibited. Modes of display that cause the message to flash are prohibited. Subd. 8. Duration of the message. Any message on the display shall remain static or stable for a period of not less than twelve (12) seconds. The interval between serial messages or changes of the display shall be at least twelve (12) seconds. Subd. 9. Transition between messages. The transition from one static and stable display to another must be direct and immediate without any special effects including fading and dissolving. Subd. 10. Sound. Signs with dynamic display shall not emit sound. Subd. 11. Time. Dynamic display signs shall be turned off when the business is closed. Subd. 12. Maximum brightness and illumination. Dynamic signs shall be restricted in their illumination and brightness so that no sign with dynamic display may exceed a maximum illumination of .3 foot candles above ambient light levels as measured from one hundred (100) feet from the sign's face. All signs with dynamic displays must be equipped with an automatic dimmer control or other mechanism that automatically controls the sign's brightness to comply with this requirement. If there is a violation of the brightness standards, the adjustment must be made within one (1) business day upon notice of noncompliance from the city Subd. 13. Malfunctioning dynamic signs. Signs with dynamic displays must be designed and equipped to freeze the sign face in one position if a malfunction occurs. Signs with dynamic displays must also be equipped with a means to immediately discontinue the display if it malfunctions. Subd. 14. Noncompliance. Operation of a dynamic sign not in compliance with these regulations. The sign owner or operator must immediately turn off the display within one (1) hour of notification by email from the city that it is not complying with the standards of this ordinance.
