CONDITIONAL USE PERMIT - RENTAL OPERATION
Staff recommends the following motion: Move to adopt Resolution RZ10 -2, recommending
approval of a conditional use permit for a rental operation at 1702 Mainstreet.
1702 Mainstreet is located on the southwest comer of Mainstreet and 17 Avenue. 1702 was
previously a gas station and now it is a vacant lot. The owner of the property, Mr. Beugen,
owns and operates Affordable Auto, just south of the subject property.
TBG properties, Mr. Beugen's company, started operating a rental , operation of U -Haul
vehicles last year at 1702 Mainstreet. We notified the owner of the property, Todd .Beugen,_
that operating a rental operation requires a conditional use permit. Mr. Beugen has applied
for a conditional use permit to allow this operation to continue.

Primary Issues to Consider
• What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The subject property is zoned B -3, General Business. The Comprehensive Plan has
designated the site as commercial. The proposed use complies with both documents.
• What does the ordinance state regarding rental operations?
Rental service provided:
1. lot is graded and surfaced according to a plan submitted and approved by city
engineer;
2. the lighting shall be accomplished in such a way as to have no direct source visible
from the public right -of -way or adjacent land in the R district;
3. the front yard shall be landscaped and not less than ten feet in depth;
4. the exterior storage area shall be according to a plan submitted and approved;
5. the site shall provide off - street loading facilities to accommodate customers.
• Does the applicant meet the conditions for a conditional use permit?
The applicant will be surfacing the entire lot and the lot has existing lighting. The other
conditions have not been met fully. The applicant submitted a grading plan that is not
sufficient for the City Engineer to approve, the landscaping plan has been submitted, but
contains only four trees. No exterior storage plan has been submitted, nor has the location
for off - street loading facilities on the site. The applicant may meet the requirements when all
the information is submitted. Staff would recommend approval when all the required
information is submitted and approved. Staff would also recommend that the required
information be submitted by April 15. The staff also recommends a condition that all
improvements are completed by June 1, 2010. The applicant started a business without the
proper approvals from the City. Since being notified of the requirement for a conditional use
permit last summer, the applicant has not been eager to fulfill these requirements, and still
staff does not have the required information.
Alternatives
1. Recommend approval of a conditional use permit to allow a rental operation at 1702
Mainstreet. By recommending approval of the conditional use permit, the City Council
will consider a recommendation of approval.
2. Recommend denial of a conditional use permit to a rental operation at 1702 Mainstreet.
By recommending denial of the conditional use permit, the City Council will consider a
recommendation of denial. If the Planning Commission recommends this alternative,
