ZONING ORDINANCE AMENDMENT - OVERLAY DISTRICT DESIGN
Proposed Action
Staff recommends the following motion: Move to adopt Resolution RZ10 -6, recommending
approval of Ordinance 10- 1017, placing an overlay district from 13 Avenue to Shady Oak
Road along Mainstreet for design standards.
Overview
In 2003 the City Council placed an overlay district for design standards on the area from the
south side of First Street North to :north side of, First Street South and the west side of 6
Avenue to the east side of 13th Avenue. These design standards were the product of business
owner and community leaders on a committee. Since the design standards were approved in
2003 and have worked in the specific area, there has been a desire to expand them to Shady
Oak Road.
Over the last year the Planning Commission has been reviewing various language to expand .
the overlay district. The proposed language will be a separate overlay, since the expanded .
area does have different characteristics than the original overlay district.

Primary Issues to Consider
• What are the proposed boundaries of the overlay new district?
The existing boundaries of the overlay district are: the south side of First Street North to
north side of First Street Southand the west side of 6th Avenue to the east side of 13
Avenue. The proposed expansion is the west side of 13 Avenue to Shady Oak Road for the
properties abutting Mainstreet zoned B -3.
• What is the difference between the overlay districts?
The following are the main differences between the overlay districts:
• allows small monument signs
• allows a flexible setback area along Mainstreet for buildings
Alternatives
1. Recommend approval of the amendments to the zoning ordinance. By recommending
approval of the amendments to the zoning ordinance, the City Council will consider a
recommendation of approval.
2. Recommend denial of the amendments to the zoning ordinance. By recommending denial
of the amendments to the zoning ordinance, the City Council will consider a
recommendation of denial. If the Planning Commission considers this alternative,
findings will have to be identified that support this alternative.
3. Continue for further information. If the Planning Commission indicates that further
information is needed, the item should be continued.
