CR 10-074 - Award Bid - 2nd St N Sanitary Sewer-.4m City of Hopkins August 2, 2010 Council Report 2010-074 AWARD OF BID Y''D STREET NORTH SANITARY SEWER IMPROVEMENTS CITY PROJECT 04-13 Proposed Action Staff recommends the following motion: "Move that Council adopt Resolution 2010-041, Resolution for Award of Bid, 2nd Street N Sanitary Sewer Improvements, City Project 04-13" Overview The bid opening for the 2nd Street N Sanitary Sewer Improvements was held on July 12, 2010. The low bid was submitted by Dave Perkins Contracting, Inc from Ramsey, MN in the amount of $265,345. We received 3 bids and all were high, indicating a small difficult project. The low bid is $56,000 over the engineers estimate. The contractor is a small reliable company with similar experience in the metro area. Staff is recommending award of the project contract to Dave Perkins Contracting, Inc. This agreement was reviewed by the City Attorney and approved by the City of Minnetonka. The agreement is attached. • Project costs: Based on the low bid, 25% overhead costs (engineering, admin, legal), and a 10% construction contingency the total estimated project cost is $364,000. This amount is approximately $100,000 above the previous estimated total project cost. The higher amount is due to the additional mill and overlay added to the project in addition to the project being small and difficult. We do not anticipate that rebidding the project would produce lower bids and the condition of the lift station to be abandoned by the project warrants proceeding as quickly as practicle. • Bid tabulation and analysis: Dave Perkins Contracting $265,345.00 Burschville $303,555.07 Kuechle Underground $485,162.00 All bids were submitted with required bid security made by qualified contractors. Hopkins and Minnetonka are adjacent cities with a common boundary line and with the power to provide public sewer and water services. Hopkins has requested that the following property in its jurisdiction be allowed to drain residential sewage into Minnetonka's sanitary sewer system (the "Park Road West Neighborhood" or the "Neighborhood"), as shown on attached Exhibit A: a. the residences on the east side of Shady Oak Road, from 201 to 249 Shady Oak Road; b. the residences from 201 to 250 Park Road West; and c. the residences from 201 to 239 21St Avenue North. 2. All of the residences in the Park Road West Neighborhood are to be served by a sanitary sewer pipe that is owned and maintained by Hopkins, but all of the sanitary sewer flow generated by the Neighborhood will discharge to the Minnetonka sanitary sewer system and will be measured by Metropolitan Council Environmental Services ("MCES"), together with other sanitary sewer flow of Minnetonka. 3. The parties have agreed that Hopkins will bill the residences in the Park Road West Neighborhood for sanitary sewer service, on the condition that MCES deducts the sanitary sewer connections to the Neighborhood residences and the sanitary sewer flow for the Neighborhood residences from Minnetonka's annual flow allocation volume and adds such connections and sanitary sewer flow to Hopkins's annual flow allocation volume. 4. MCES will make such allocation volume adjustments if Hopkins and Minnetonka provide MCES with an executed agreement providing for such allocation volume adjustments. THEREFORE, the parties agree as follows: 1. Minnetonka will allow the residential sewage from the Neighborhood to drain into the Minnetonka sanitary sewer system subject to the following conditions. 2. Hopkins will bill the residences in the Park Road West Neighborhood for sanitary sewer. The sanitary sewer connections to the Neighborhood residences and the sanitary sewer flow from the Neighborhood residences will be deducted by MCES from Minnetonka's annual flow allocation volume and added to Hopkins's annual flow allocation volume. 3. Hopkins will report to MCES each of the sanitary connections to the residences in the Neighborhood. This report will be done through the annual Sewer Use Service submitted by Hopkins to MCES and will also be reported as unmetered connections to Minnetonka. 4. \This Agreement may be executed in one or more counterparts and all of the parties' signatures need not appear on any one counterpart, provided all parties have, in fact executed a counterpart to this Agreement. All counterparts to this Agreement will constitute only one agreement and each party may rely upon a copy or facsimile signature of any other party to this Agreement. Date: CITY OF HOPKINS By.
