RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A SITE PLAN TO ADD A 3400 SQUARE FOOT ADDITION AND TO MAKE
IMPROVEMENTS TO THE EXTERIOR ABUTTING EXCELSIOR BOULEVARD AT 7900
EXCELSIOR BOULEVARD
WHEREAS, an application for Site Plan Review SPR11-2 has been made by Alex Ugorets;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a Site Plan was made by Alex Ugorets, on March 1,
2011;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on March 29, 2011: all persons present were given an opportunity
to be heard;
3. That the written comments and analysis of City staff were considered; and,
4. A legal description of the subject property is as follows:
Par 1: That part of the Northwest Quarter of the Southwest Quarter of
Section 20, Township 117, Range 21 described as beginning at the Northwest
corner of said Northwest Quarter of the Southwest Quarter; thence East along
the North line of said Northwest Quarter of the Southwest Quarter, to a point
885.3 feet West from the Northeast corner of said Northwest Quarter of the
Southwest Quarter; thence South deflecting to the right 89 degrees, 59
minutes, 31 seconds to the center line of Excelsior Boulevard; thence
Westerly along said center line to the West line of said Northwest Quarter of
the Southwest Quarter; thence North along said West line to the point of
beginning.
Par 2: That part of the Southwest Quarter of the Northwest Quarter of
Section 20, Township 117, Range 21 described as beginning at the Southwest
corner of said Southwest Quarter of the Northwest Quarter; thence East along
the South line of said Southwest Quarter of the Northwest Quarter, a distance
of 67.4 feet; thence North parallel with the West line of said Southwest
Quarter of the Northwest Quarter, a distance of 279.5 feet; thence Northerly
along a tangential curve to the right, having a radius of 1206.94 feet, a
distance of 136.57 feet; thence Northeasterly along a compound curve,
having a radius of 491.67 feet, a distance of 375.86 feet; thence Northeasterly
along a compound curve having a radius of 547.71 feet, a distance of 147.66
feet; thence North 25 degrees, 23 minutes West (assuming the West line of
Southwest Quarter of the Northwest Quarter as bearing North and South) a
distance of 8 feet more or less to the Southeasterly right-of-way line of the
Chicago, Milwaukee, St. Paul and Pacific Railroad company; thence South
64 degrees, 37 minutes West along said Southeasterly right-of-way line a
distance of 255.35 feet more or less to a point 155.2 feet Northeasterly along
said Southeasterly right-of-way line from the West line of said Southwest
Quarter of the Northwest Quarter; thence Southwesterly along a curve
concave to the Southeast having a radius of 521.67 feet to a point on the West
line of said Southwest Quarter of the Northwest Quarter, distant 108.8 feet
South along said West line from said Southeasterly right-of-way line; thence
South along said West line to the point of beginning.
Par 3: That a part of the southwest Quarter of the Northwest Quarter of
Section 20, Township 117, Range 21 described as beginning at a point on the
South line of said Southwest Quarter of the Northwest Quarter, distant 67.4
feet East from the Southwest corner of said Southwest Quarter of the
Northwest Quarter; thence North parallel with the West line of said
Southwest Quarter of the Northwest Quarter, a distance of 262.5 feet; thence
East parallel with said South line to the center line of Powell Road; thence
South along said center line to said South line; thence West along said South
line to the point of beginning.
NOW, THEREFORE, BE IT RESOLVED that the application for Site Plan Review SPR11-
3 is hereby approved based on the following Findings of Fact:
1. That the proposed use meets the requirements for site plan review.
BE IT FURTHER RESOLVED that application for Site Plan Review SPRI 1-3 is hereby
approved subject to the following conditions:
1. That three trees of the correct size be added.
2. That the signage on the building be removed when the applicant receives a
permit for a monument sign.
