SUBJECT: Miscellaneous Assessment Hearing
Attached is revised Exhibit A for adoption that lists all proposed miscellaneous special
assessments remaining unpaid as of this date. Assessments that have been paid by
certified checks, money orders, cash or credit cards since publication and mailing of the
assessment statements have been notated on Exhibit A.
The following three items have been removed from Exhibit A prior to the adoption of the
• roll:
1. PID #24-117-22 22 0057 — Delinquent Citation
Citation was voided and two re -inspection fees were imposed instead which the
owner paid on August 4, 2010.
2. PID #24-117-22 43 0021 — Delinquent Citation
Citation was voided. The property owner met the terms agreed upon at the
Appeals Hearing.
3. PID #23-117-22 14 0112 — Delinquent Invoice
Invoice was voided. The property owner complied with written orders on June 3,
2010.
Staff recommends that the City Council adopt the Exhibit A as amended.

Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 2011-
051 Resolution for Adoption of Assessment Roll 2011 Miscellaneous Special Assessments.
Overview.
The proposed special assessments as described in Exhibit A are for delinquent utility bills,
citations, and invoices. Notices of this hearing have been published, and both notices and
assessment statements have been mailed to all affected property owners. Copies of the
delinquent invoices and citations were also included with the assessment statements. This year
we provided everyone with documents containing frequently asked questions, a copy of which is
attached.

Appeal process
If residents have not waived their rights to appeal, they are given the opportunity to
approach Council during the public hearing. Standard appeal forms have been available
at City Hall and are available at the public hearing. All appeal forms presented to the
Council during the public hearing must be completed and signed by the property owner.
Should appeals be presented to Council during the public hearing, Council may wish to
continue the hearing to the October 18, 2011 Council meeting to allow staff time to
examine the appeals and make a recommendation. This would still meet the statutory
requirement of allowing the 30 -day interest free period for payments prior to certification
on November 30, 2011.
• Owner appeals/staff recommendations
To date, our office has not received any appeals.

At the 2010 Miscellaneous Assessment Hearing the City Council requested information
concerning the total amounts to be assessed compared to past years and the percentage of the
assessments that are for delinquent utility bills. Following is a multi-year comparison as

NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in
the Council Chambers of the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota on
Tuesday October 4 2011 at 7:30 p.m., to consider, and possibly adopt, the proposed special
assessments for the costs of delinquent utility bills, for delinquent invoices, and for delinquent
citations. THE ATTACHED STATEMENT OF ASSESSMENT DETAILS THE AMOUNT TO BE
ASSESSED AGAINST YOUR PARTICULAR LOT, PIECE OR PARCEL OF LAND. '
The area to be assessed includes properties throughout the entire City of Hopkins. The
total amount of all the proposed assessments is $135,312.56 as of September 7, 2011.
The proposed assessment roll is on file with the City Clerk and is available for review.
• Property Owners may present their objections to proposed special assessments at this hearing
either orally or in writing. The Council will consider those objections. No appeal may be taken
as to the amount of any assessment adopted unless a written objection signed by the property
owner is filed with the City Clerk prior to the assessment hearing or presented to the presiding
officer at the hearing. Appeal forms will be available at the assessment hearing or at the Special
Assessment Clerk's office at the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota.
After the public hearing an owner may appeal an assessment to district court pursuant to
Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk
of the City of Hopkins within thirty (30) days after the adoption of the assessment and by filing
such notice with the district court within ten (10) days after service upon the Mayor and City
Clerk.
Under provisions of Minnesota Statutes Section 435.193 to 435.195 and Hopkins
Ordinance 703.05. the City may, in its discretion, defer the payment of assessments for any
homestead property owned by a person 65 years of age or older or a person retired by virtue of a
permanent and total disability for whom it would be a hardship to make the payments. The
procedures to apply for such deferment are available from the Special Assessment Clerk.
Deferment applications should be submitted to the Special Assessment Clerk by September 30,
2011.
The following information shall also apply:
•
1. The property owner shall have the right to prepay the entire assessment. Your
assessment may be paid without interest from October 4 2011 to November 3, 2011, to the
Special Assessment Clerk at City Hall, 10101st Street South, Hopkins, Minnesota. You may at
M time thereafter and prior to November 30 2011 pay to the Special Assessment Clerk the
entire amount of the assessment remaining unpaid with interest accrued from October 4, 2011._
to the date in which such payment is made. Such payment must be maderip or to November 30,
2011 or interest will be charged through December 31 of the succeeding year.
2. Partial prepayment of the assessment in excess of 25 percent of the total
assessment has been authorized by ordinance. A partial prepayment can only be made prior to
November 30, 2011 with interest accrued to the payment date. No interest shall be charged on a
partial payment if the partial payment is made by November 3, 2011. Partial prepayments must
be made to the Special Assessment Clerk at Hopkins City Hall 1010 1 St Street S, Hopkins,
Minnesota 55343.
3. In the case where accrued interest applies, the rate of interest to be accrued, if the
assessment is not prepaid within the required time period, is proposed to be 5 percent
commencing on the date of adoption by the City Council. Assessments shall be payable in one
annual installment unless otherwise specified in your Statement of Assessment.
4. The amount to be specially assessed against your property is shown on the
enclosed Statement of Assessment.
A $100.00 service charge has been added to the amount to be assessed for all
delinquent bills.
• The hearing on October 4, 2011 is an important hearing because this is your
opportunity to object to the proposed special assessment that affects your property. The
Council may adopt the proposed special assessment at this hearing. If you have any
questions regarding this assessment, please call the Special Assessment Clerk at 952-548-6310.

Frequent Questions with Answers about the Special Assessment Hearing
Notice and Statement of Assessment
DelinquentY notices for utility accounts, invoices and administrative citations have been
sent out. Your Notice of Assessment Hearing lets you know that your overdue bill will
be applied as a special assessment on your property taxes payable with the 2012
property tax statement. You have an opportunity to challenge this assessment at the
Assessment Hearing which will be held at Hopkins City Hall at 7:30 p.m. on Tuesday,
October 4.
Will I get another notice?
This is the only notice you will receive. If something changes at the assessment
hearing on October 4, 2011 you will be notified. You may call the Special
Assessment Clerk at 952-548-6310 to see if any changes were made.
Why am I charged a service charge?
This service charge is to cover administrative costs including but not limited to
postage, mailing supplies, and legal publication costs.
• What happens if I don't payMy assessment?
If a balance remains on November 29, 2011, your assessment will be certified to
Hennepin County for collection with the property taxes payable in 2012.
What if I can't pay the assessment amount in full?
Partial payments of at least 25% or more of the assessment amount are accepted.
Several partial payments can be made between October 4, 2011 and November
29, 2011, however each partial payment must be at least 25% of the remaining
balance. Interest charges will be added on any partial payment made after
November 3, 2011.
What are my payment options if I want to pay before the special assessment goes onto
my taxes?
Payments must be received by November 29, 2011. Only certified checks,
money orders, cash or credit cards will be accepted. Payments made after
November 3, 2011 will have interest charges added. Please call the Special
is Assessment Clerk at 952-548-6310 for interest owed or to make a credit card
payment by phone.
INFORMATION ON SPECIAL ASSESSMENTS
• HOW ARE SPECIAL ASSESSMENTS PAID?
1. If the assessment is not paid prior to November 30, 2011, it will automatically be included
with the real estate taxes payable beginning in 2012. The actual terms of financing are set by
the City Council at the Public Hearing. The interest rate is proposed to be 5%.
2. The assessment can be paid off in full or in part (at least 25%). The procedure and deadline
for payments will be as follows:
October 4, 2011 to November 3, 2011 (assuming adoption on October 4, 2011) — 30 day
interest free.
During this period, the owner may pay all or part of the total, interest free.
Partial payments must be at least 25% of the assessment.
November 4, 2011 to November 29, 2011— interest accrues from date of adoption on
any payment made during this time.
- After the 30 -day period, the total may be paid with interest prorated from
the date of adoption, October 4, 2011, to the date of payment, until
November 29, 2011.
- Partial payments of at least 25% are still accepted, although interest charges
will apply to the payment.
November 30, 2011— assessments are certified to Hennepin County.
• - Payments can no longer be accepted by the City of Hopkins.
On November 30, 2011, the assessments are certified to Hennepin County
for collection with the property taxes payable beginning in 2012 for a term
of one year.
15 months of interest is added to the assessments certified to the property
taxes payable in 2012.
NOTE: Pursuant to State Statutes, the City is required to follow the procedure and deadlines
listed above.
SPECIAL ASSESSMENT DEFERMENTS
The City Council may in its discretion defer payment of special assessments upon request. The property
must be homesteaded by the property owner. Also the property owner must be 65 years of age or older
or retired by virtue of a permanent and total disability. The income is not to exceed $34,353 as of
January 1, 2011. Income verification is required. Application for deferment must be made no later than
the hearing date.

RESOLUTION NO. 2011-051
ADOPTION OF THE ASSESSMENT ROLL
2011 MISCELLANEOUS SPECIAL ASSESSMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council
has met and heard and passed upon all objections to the proposed assessment for delinquent
utility bills, citations, and delinquent invoices, all as more fully set forth and described in Exhibit
A as attached to this resolution, and has amended such proposed assessment as it deems just,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named therein, and
each tract of land therein included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
• 2. Such assessments shall be payable in equal, annual installments extending over the
periods of years set forth in Exhibit A, the first of the installments to be payable on or after the
first Monday in January of 2012. Any deferred installments shall bear interest at the rate set
forth in said Exhibit A from the date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from October 4, 2011, until
December 31, 2012. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole or a partial payment of at least 25% of the
assessment on such property, with interest accrued to the date of payment, to the city treasurer,
except that no interest shall be charged if the entire assessment is paid within 30 days from the
adoption of this resolution; and he may, at any time thereafter, pay to the city treasurer the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made prior to November 15 or interest will
be charged through December 31 of the next succeeding year.
4. It is hereby declared to be the intention of the Council to reimburse itself in the future for
the portion of the cost of this improvement paid for from municipal funds by levying additional
assessments, on notice and hearing as provided for the assessments herein made, upon any
properties abutting on the improvement but not made, upon any properties abutting on the
. improvement but not herein assessed for the improvement, when changed conditions relating to
such properties make such assessment feasible.
5. To the extent that this improvement benefits nonabutting properties which may be served
by the improvement when one or more later extensions or improvements are made, but which are
not herein assessed, therefore, it is hereby declared to be the intention of the Council, as
authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion
of the cost so paid to the assessments levied for any of such later extension or improvements.
6. The clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County, and such assessments shall be
collected and paid over in the same manner as other municipal taxes.
