PRELIMINARY/FINAL PLAT — 21St AVENUE NORTH
Proposed Action
Staff recommends the following motion: Move to adopt Resolution I1-58, approving a
preliminary/final plat for the empty lots between 349 and 337 - 21st Avenue North.
At the Zoning and Planning meeting Ms. Naef moved and Ms. Allard seconded a motion to
adopt Resolution RZI 1-16, recommending approval of a preliminary/final plat for the empty
lots between 349 and 337 - 21st Avenue North. The motion was approved unanimously.
Overview
A.K.A.R.E. Companies LLC, the applicant, has purchased two lots on 21" Avenue North. A
single family home is proposed to be constructed on this property. The existing parcels
consist of a 40 -foot and a 35 -foot lot. Homes are not allowed to straddle lots, and so the lots
need to be combined into one. A detached garage exists on the lots at this time. The garage
will be razed for the new home to be constructed.

Primary Issues to Consider
• What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is R -1-A, Single and Two -Family High Density. The
Comprehensive Plan has designated this site as Residential. The proposed uses will comply
with both documents.
• Do the lots meet the zoning requirements?
A lot in the R -1-A zoning district is required to have a minimum size of 6000 square feet and
a minimum lot width of 50 feet. The proposed lot will be 75 feet in width. The proposed lot
size is 9855.50 square feet.
• What are the specifics of the plat?
The lot will be 75' x 131'. This lot is consistent with the other parcels in the area.
• Does the proposed plat meet the subdivision requirements?
• The plat, as proposed, meets the subdivision requirements.
• Will a park dedication fee be required?
A park dedication fee will not be required because no additional lots will be created.
• What was the discussion at the Zoning and Planning meeting?
Ms. Anderson reviewed the proposed plat. Rob Eldrich, the applicant, appeared before the
Commission. Mr. Eldrich stated that they are marketing the lot for a proposed single family
home. No one appeared at the public hearing.
Alternatives
1. Approve the preliminary plat/final plat. By approving the preliminary/final plat, the
applicant will be able to re -plat the lot as proposed.
2. Deny the preliminary/final plat. By denying the preliminary/final plat, the applicant will
not be able to re -plat the lot as proposed. If the City Council considers this alternative,
findings will have to be identified that support this alternative.
• 3. Continue for further information. If the City Council indicates that further information is
needed, the item should be continued.

WHEREAS, an application for a preliminary/final plat SUBD11-3 has been submitted by
A.K.A.R.E. Companies L.L.C;
WHEREAS, the procedural history of the application is as follows:
That an application for preliminary/final plat was submitted by A.K.A.R.E. Companies
L.L.C. on September 22, 2011;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and published
notice, held a public hearing on the application and reviewed such application on October
25, 2011: all persons present were given an opportunity to be heard; and
• 3. That the written comments and analysis of City staff were considered.

NOW, THEREFORE, BE IT RESOLVED that the application for a preliminary/final plat
SUBD 11-3 is hereby approved based on the following Findings of Fact:
1. That the preliminary/final plat meets the subdivision requirements.
BE IT FURTHER RESOLVED that application for preliminary/final plat SUBDI 1-3 is hereby
approved based on the following condition:
1. That the applicant must provide current evidence of title, in the form of a connnitment for
title insurance, to the City Attorney.
