1999 Street Improvements
Project 98-09
Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 99-45,
Resolution for Adoption of the Assessment Roll, Pro'ect 98-09, 1999 Street Improvements and
adopt Companion Resolution 99-46, Resolution Declaring the Official Intent of the City of
Hopkins to Reimburse Certain Expenditures From Bond Proceeds to be Issued by the City of
Hopkins•
Overview.
Council at its May 4 meeting considered the proposed assessment roll for street, alley, and utility
improvements on 12th and 13th Avenues South and 1st Street South. A public hearing for
special assessments was set for June 1. This hearing sets in motion levying of assessments
against benefiting properties. A public hearing notice has been published and mailed, along with
an assessment staternent, to every affected property owner.
As of this writing, one written objection contesting the proposed assessments has been
submitted. Written objections to Council must be submitted no later than the hearing date.

Property owners are given the opportunity to approach Council with their objections to the
proposed assessments during the public hearing. Standard forms for written objections
have been available at City Hall and need to be submitted no later than the hearing date.
Staff wi11 make recommendations on all objections.
• Assessment policy
Staff has adhered to the City's legislative policy 8-B concerning special assessment
policies and formulas as they pertain to this project. In the case of street reconstruction on
12th Avenue South and lst Street South, 70% of street reconstruction costs will be
covered by assessing the benefiting adjacent properties. 12th Avenue South from ist to
2nd Street will be assessed as if a partial reconstruction with 70% of curb replacement
costs being assessed. The City's assessment policy 8-B 11.03 will govern in the case of
1 st Street South assessments. The street will be treated as a side street and costs passed
off to the blocks north and south of particular segments. No assessments will be levied in
the case of 13th Avenue South reconstruction which is generated by a major storm sewer
installation and not by street conditions. Again this year, an assessment cap at 120% of
the average per"foot assessment on the previous three similar street reconstruction projects
will prevail on IZth Avenue South between Mainstreet and 1st Street.
In the case of the alley reconstruction between 12th and 13th Avenue South, 80% of the
� total project cost will be recovered with special assessments against benefiting properties.
• Project costs and assessment rates
Computations used to derive the�proposed assessment are found on the assessment
worksheets found near the end of this report. The worksheets are premised on what was
�hought to be the low contractor bid at the time of the bid opening. The assessable
conshuction costs for each of the streets was established using the bid of C.S. McCrossan,
5% in construction contingencies and prorated engineering costs were aaded, a 5%
admin./legal, finance fee was applied, and lastly a 70% share for assessing was calculated.
In the case ofthe alley, an 80% share was calculated. The assessable project cost was
divided by the assessable footage to derive the assessment rate. The final assessment roll
summary sheets reflect the proposed assessments for each lot.
After Council had accepted the preliminary assessment roll (one based on the C.S.
McCrossan bid) at the May 4 meeting and ordered a hearing, it was determined in
conference with the City's attorney that the actual low bid was submitted by Barbarossa
and Sons. Council action would have been required to revise the preliminary roll for
purposes of hearing notices and assessment statements: This would have added two
weeks to an already marginal constraction schedule. In addition, even though the City
would save an estimated $31,000 with the Barbarossa bid, clearly assessments would have
been almost $4,000 higher. Staff felt justified in calculating assessments based on C.S.
McCrossan and having the City still realize a net savings of $27,000.

The following is an objection concerning special assessments for Project 98-09.
1. Address: 133 12th Avenue South
Assessed Amount: $2,137.51
Appeal for revision of assessment by reason of no benefits to improvements in 1 st
Street South and that work dQne in conjunction with County Road 3 is unsatisfactory.
Recommendation: �
Deny appeal on the basis that 1 st Street South assessments are based on an established
City policy concerning improvements on side streets and that County Road 3
improvements and their current status are not germane to this particular assessment
procedure.
� • Recommendation
Staff recommends adoption of Resolution 99-45 approving the special assessment roll for
Project 98-09 and of companion resolution 99-46 concerning intent of reimbursement
through revenue bond sales.

NOTICE OF ASSESSMENT HEARING
NOTICE IS HEREBY GIVEN that the City Council of Hopkins, Minnesota, will meet in
the Council Chambers of the Hopkins City Hall, 1010 lst Street South, Hopkins, Minnesota at
7:30 p.m. on Tuesday, June 1, 1999, to hear all persons concerning the adoption of the
assessment roll for Public Improvement Project 98-09 and to adopt the assessment roll as
presented or amended. This hearing is scheduled pursuant to Minnesota Statutes Chapter 429.
The assessment roll as herein described is on file in the office of the City Clerk.
AREA TO BE ASSESSED:
Those properties abutting 1 lth, 12th and 13th Avenues South from
Mainstreet to 2nd Street South, those abutting lst Street South from l lth
to 13th Avenues South, those abutting the a11ey in the #10 block between
12th/13th Avenues South.
� TOTAL AMOUNT TO BE ASSESSED IS $174,213.35
All persons who wish to be heard, or to object with reference to this matter may present
their cases at this hearing, either orally or in writing. No appeal may be taken as to the amount of
any assessment adopted unless a written objection signed by the property owner is filed with the
Assessment Clerk prior to the assessment hearing or presented to the presiding officer at the
hearing. Even though appeals are due by the hearing date on June 1, 1999, the City Clerk
strongly recommends that appeals be submitted to the Assessment Clerk's office by May 26,
1999. Appeal forms will be available at the assessment hearing or at the Assessment Clerk's
office at the Hopkins City Hall, 1010 1 st Street South, Hopkins, Minnesota.
An owner may appeal an assessment to district court pursuant to MSA Section 429.081
by serving notice of the appeal upon the Mayor or City Clerk of the City of Hopkins within thiriy
(30) days after the adoption of the assessment and by filing such notice with the district court
within ten (10) days after service upon the Mayor and City Clerk.
Under provisions of Minnesota Statutes Section 435.193 to 435.195 the City may, at its
discretion, defer the payment of assessments for any homestead property owned by a person 6S
years of age or older for whom it would be a hardship to make the payments. The procedures to
� apply for such deferment are available from the Assessment Clerk. Deferment applications
should be submitted to the Assessment Clerk by May 26, 1999.

The following information shall also apply:
1. The property owner shall have the right to prepay the entire assessment. Your
assessment may be paid without interest from June 1, 1999 to June 30, 1999, to the Assessment
Clerk at City Hall, l Ol O lst Street South, Hopkins, Minnesota. You may at any time thereafter,
pay to the Assessment Clerk the entire amount of the assessment remairiing unpaid, with interest
accrued to December 31 of the year in which such payment is made. Such payment must be
made by November 30, 1999 or interest will be charged through December 31 of the succeeding
year.
2. Partial prepayment of the assessment in excess of 25 percent of the total
assessment has been authorized by ordinance. A partial prepayment can only be made prior to
November 30, 1999 with interest accrued to the payment date, except that no interest shall be
charged if such partial payment is made by June 30, 1999.
3. In the case where accrued interest applies, the rate of interest to be accrued, if the
assessment is not prepaid within the required time period, is proposed to be 8 percent
commencing on the date of adoption by the City Council. Assessments shall be payable in
annual installments over a period of 10 years.
• 4. The amount to be specially assessed against your property is shown on the
statement of assessment sent to you by mail.
This is an important hearing because this is your last opportunity to be heard on the
matter of this assessment which affects your property. If you have any questions regarding this
assessment, please call the Engineering Department or the Assessment Clerk at 935-8474.

RESOLUTION NO. 99-45
ADOPTION OF THE ASSESSMENT ROLL
PROJECT 98-09
1999 STREET AND ALLEY IMPROVEMENTS
WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met
and heard and passed upon all objections to the proposed assessment for the
reconstruction of 12th and 13th Avenues South from Mainstreet to 2nd Street South, lst
Street South between l lth/13th Avenues South, and an alley in the #10 block between
12th/13th Avenues South, as described in the files of the City Clerk as Project 98-09.
NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF HOPKINS,
MINNESOTA:
1. Such proposed assessment, as may be amended and a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein included is
� hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a
period of ten years, the first �of the installments to be payable on or after the first
� Monday in January, 2000, and shall bear interest at the rate of 8 percent per annum
from the date of the adoption of this assessment resolution. To the first installment
shall be added interest on the entire assessment from June 1, 1999 until December 31,
2000. To each subsequent installment when due shall be added interest from one year
on all unpaid installments.
3. It is hereby declared to be the intention of the Council to reimburse itself in the
future for the portion of the cost of this improvement paid for from municipal funds
by levying additional assessments, on notice and hearing as provided for the
assessments herein made, upon any properties abutting on the improvement but not
made, upon any properties abutting the improvement but not herein assessed for the
improvement, when changed conditions relating to such properties make such
assessment feasible.
4. To the extent that this improvement benefits non-abutting properties which may be
served by the improvement when one or more later extensions or improvements are
made, but which are not herein assessed, therefore, it is hereby declared to be the
� intention of the Council, as authorized by Minnesota Statutes Section 420.051, to
reimburse the city by adding any portion of the cost so paid to the assessments levied
for any of such later extension or improvements.
� 5. The clerk shall forthwith transmit a certified duplicate of the assessment to the
County Auditor to be extended on the property tax lists of the County, and such
assessments shall be collected and paid over in the same manner as other municipal
taxes.

RESOLUTION 99-46
DECLARING THE OFFICIAL 1NTENT OF THE CITY OF HOPKINS TO
REIMBURSE CERTAIN EXPENDITURES FROM BOND PROCEEDS TO BE
ISSUED BY THE CITY OF HOPKINS
WHEREAS, the Internal Revenue Service has issued Treas. Reg. #1.150-2 providing that
proceeds of tax-exempt bonds used to reimburse prior expenditures shall not be deemed
spent unless certain requirements are met; and
WHEREAS, the City expects to incur certain expenditures which may be financed temporarily
from sources other than bonds, and reimbursed from the bond proceeds;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
HOPKINS (THE "CITY") AS FOLLOWS:
1. The City intends to incur expenditures for the project described in Council Report
� 99-103 for Project 98-09 (the "Project"), and intends to reimburse itself for such
expenditures from the bond proceeds to be issued by the City in the maximum principal
amount described in the "pro�ect".
2. The City Manager is authorized to designate additions to Project 98-09 in circtunstances
where time is of the essence, and any such designation shall be reported to the Council at
the earliest practicable date and shall be filed with the official books and records of the
City. �
3. This resolution is intended to constitute a declaration of official intent for the purposes of
Treas. Reg. #1.150-2 and any successor law, regulation, ruling or amendment pertaining
thereto.
