REAR YARD VARIANCE - 1 FARMDALE ROAD
Pronosed Action.
Staff recommends the following motion: Move to approve Resolution 94-21 approving a 13
foot rear vard setback variance at 1 Farmdale Road
Mr. Racek moved and Mr. Johnson seconded a motion to approve Resolution RZ94-3
recommending approval of a rear yard setback variance at 1 Farmdale Road. The motion
passed unanimously.
Overview
The applicant is proposing to construct an addition to the east side of the existing home at 1
Farmdale Road. The addition will be approximately 27 feet from the rear lot line. The R-1-D
zoning district requires a rear yard setback of 40 feet.
The proposed addition will be 14' x 26' and will be constructed on the east side of the e�sting
home. The applicant is proposing to relocate the existing gaxage to the north side of the home
• and convert the e�sting garage to a screen porch. The new addition will be used for a garage
and storage.
The existing home has, at the closet point, a 25.9' rear yard setback. The e�sting home meets
all of the other setbacks.
The staff reviewed the applicant's request with the Commission. The staff stated that several
neighbors called and spoke in favor of the variance. Jim Justus the applicant appeared before
the Commission. Mr. Justus stated that he would like to start the addition in April.

Primary Issues to Consider.
o What are the specifics of the applicants request?
The applicant is proposing to construct a 14' x 26 ' addition to the east side of the existing
home. The new addition will be approximately 27 feet from the rear property line. The
required rear yard setback is 40 feet. The applicant is also filling in a small 7 foot area along
the rear of the home to create a straight building line.
The existing home is closer to the rear property line than the new addition will be.
" o What are the requirements for a variance?
The Zoning Ordinance defines a variance as the following: a modification or variation from
the provisions of this code or variation from it provisions granted by the board and applying to
a specific parcel of property because of undue hardship due to circumstances peculiar and
unique to such parcel.
o Does the applicants property have a hardship?
The applicants property is unique because of the odd shape. In this case the applicants lot is
. wider than the depth. Because of this situation the setbacks do not provide a normal situation.
Most of the lot is taken up by the required setbacks, which leaves only a very small area for a
home to be placed. The applicants entire existing home does not meet the 40 foot rear year
setback.
The applicant could construct a detached building because the required setbacks are only 3
feet from the side and rear lot line.
o What is the staff recommendation?
The applicant has an odd shaped lot and because of the odd shaped lot the staff is
recommending approval of the variance.
Alternatives.
1. Approve the rear yard variance. By approving the variance, the applicant will be able
to construct the addition as proposed.
2. Deny the rear yard variance. By denying the variance, the applicant will not be able
to construct the addition as proposed.
� 3. Continue for further information. If the City Council indicates that further information
is needed the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND
APPROVING A REAR YARD VARIANCE AT ONE FARMDALE ROAD
WHEREAS, an application for a variance, VN 94-1, was made by
James A. Justus to allow him to construct an addition to,the east
side of the existing home at One Farmdale Road.
WHEREAS, the procedural history of the application is as
follows:
1. That an application for a variance VN 94-1 was filed
. with the City of Hopkins on January 21, 1994.
2. That the Hopkins Planning Commission, pursuant to
mailed notices, held a meeting on the application and
reviewed such application on February 22, 1994: all
� persons present were given an opportunity to be heard.
3. That the written comments and analysis of the City
staff and the Planning Commission were considered.
NOW THEREFORE, BE IT RESOLVED that the application for
variance VN 94-1 is hereby approved based on the following
Findings of Fact:
1. That the applicant has a hardship due to the
unique shape of the lot.
