SUBJECT: SUBDIVISION MORATORIIIM

As a result of recent discussion concerning potential property
divisions there has been a concern raised by staff concerning the
adequacy of the City's existing subdivision ordinance. This
ordinance, which details the process and requirements for
dividing property, has not been updated for many years. In
reviewing this ordinance with the City Attorney it is felt that
this document contains inconsistencies and standards which are no
� longer appropriate. Also, in certain sections the language is
confusing.
If the Council concurs with staff concerning this issue it would
be proposed that a moratorium be implemented concerning the
division of property within the City. This will allow staff time
to research the ordinance in more detail and make appropriate
changes. The moratorium action would insure that the City is not
placed in a position to approve any divisions prior to the
appropriate changes being made to the subdivision regulations.
If moratorium action was pursued the Council would need to adopt
• an ordinance. A first reading of an ordinance should be able to
be .done at the April 19 Council meeting. Additional information
from the City Attorney and staff will be available during the
City Council meeting.
