APPROVE PRELIMINARY PLANS, LAYOUT #2
SHADY OAK ROAD (CSAH 61) RECONSTRUCTION
(HENNEPIN COUNTY PROJECT 9112)
Proposed Action.
Staff recommends the following motion: Move that Council adopt Resolution
2012-015. Resolution approving preliminary plans, layout #2, for the
reconstruction of Shadv Oak Road from Excelsior Boulevard to north of Highway
7(Hennepin County Project 9112)
Overview.
Hopkins City Council approved preliminary layout #1 for this project in September
2006. However, subsequent withdrawal of potential Hennepin County
Community Works funding halted continued design work on the project. A
reduced level of Hennepin County Community Works funding has been restored
and a $7.3 million federal grant has been secured. Hennepin County directed a
redesign to reduce the project footprint as well as the associated right of way and
construction costs. This new preliminary layout reflects that design change.
Approval of the preliminary layout is required prior to the County commencing
final design or environmental work. A separate agreement detailing the city's
commitment on right of way funding will be brought to the City Council for
consideration in May 2012. Staff believes that the current layout represents a
necessary, feasible and lasting upgrade for this major roadway and that many of
the expressed project concerns can be worked out through the final
design/environmental review process. Staff is recommending that City Council
approve preliminary layout #2.
Hennepin County personnel and its consultant will be present at the Council
Meeting to present the layout, explain the project and answer questions.

Analysis of Issues
Detailed Background
Several meetings with project stakeholders have been held regarding the
redesign, including a January 24 public informational meeting. At this well -
attended meeting County and City personnel presented the revised design
plans to the project stakeholders, i.e. area property and business owners.
Many stakeholder comments on the project were received at or shortly after
the meeting. Many of these questions or comments will be addressed during
the final design and environmental work. A frequently asked questions sheet
addressing many of the common concerns was mailed to each stakeholder
along with the notice for this meeting. Some design changes were made
based on comments to -date. Hennepin County planning staff has reviewed
the current plans and has determined that the traffic capacity of the proposed
improvements will accommodate 2025 traffic levels including the expected
traffic increase created by the planned 2017/18 Shady Oak light rail transit
station.

Property impacts
The properties fronting Shady Oak Road north of 2nd Street (7 homes) will
be acquired due to the realignment of the Highway 7 intersection
approach + one additional property at north end of West Park Road.
Partial takings along the commercial properties to accommodate roadway
widening. Partial taking at residential properties: 11 21 st Ave N and 202
West Park Road. Temporary easements for construction at various
locations along the project. As design continues, staff will work with the
Hennepin County designers and property owners in an effort to minimize
both permanent and temporary easements and construction impacts.
Owners will be compensated for loss of trees, shrubs and, of course, for
the easements.
Project Cost and Schedule
• COST:
The current construction cost estimate is $21,051,124. The estimated
Hopkins share is $2,855,755. The 2012-2016 CIP has a city budget of
$2,805,000 from the municipal state aid account for this project. A
preliminary cost estimate is attached.
The current balance in the city's municipal state aid account is: $2,073,270.80
We are expecting an additional $1.5 million in State payments for the years
2013-2015.

SUBJECT: Shady Oak Road — Business Contacts
City of Hopkins and Hennepin County staff have met with the property owners most
significantly impacted by the proposed Shady Oak Road redesign. The properties include
all sites from Mainstreet to Bradford Road on the west side of Shady Oak Road. In the
meetings various scenarios have been discussed but one has been the focus and that is
depicted in the attached exhibit.
The following is a summary of the conversations:
Rick Johnson and his sister who own both the strip center and vacant lot at Mainstreet
and Shady Oak Road met with Hennepin County Transportation staff to discuss their.
concerns. They center around how the vacant parcel will be used and how the existing
cross -easements will be addressed. He also voiced concern over the loss of parking.
These concerns are being addressed through a possible redesign of the entrance and the
use of Community Works funds to off -set the parking loss.
We have had several discussions with Dan Dorholt and he is analyzing his options in
regards to selling his property under the Community Works -funded scenario including
the cost to rebuild a space for Snap Print and another tenant on the Leaman's/Nelson's
site, if it should become available. An appraisal of the property was shared and
discussed.
His tenants, Studio Tan and a lower -level tenant, have both had the opportunity to talk to
a relocation consultant about their benefits if the property was acquired. Jill Hammer
Johnson, owner of Studio Tan, expressed nervousness about the potential move but also
talked about being able to positively modify her business plan with a new space.
The VFW recently brought in a large contingent to review the appraisal conducted on
their property. We expressed to them that the scenario that seems to have the most
viability at this point would leave them in place, but with additional parking created with
an acquisition of the Syndicate Sales building. They seemed to support that concept.
Syndicate Sales owners were optimistic that they could reach agreement on a property
exchange if the Snap Print location was offered. They would like to stay on Shady Oak
Road and make the move as easy as possible.
Jim Mason, owner of Leaman's Liquor and the building also containing Nelson's Meats
& Bakery, has maintained a position that he does not want to remain in business during
construction. The appraisal on his property was shared and he has discussed a price he
feels is fair.
Rick Nelson, tenant of Mr. Mason, met with the relocation consultant and discussed some
of the options he has considered. He wants to stay in business but that his space needs
are different than what he currently leases so a move may allow him the opportunity to
right -size his space.

RESOLUTION APPROVING LAYOUT NO. 2, DATED MARCH 5, 2012, FOR THE
RECONSTRUCTION OF COUNTY STATE AID HIGHWAY NO. 61 (SHADY OAK
ROAD) BETWEEN CSAH 3 (EXCELSIOR BOULEVARD) AND HIGHWAY 7, AND
IMPOSING A PARKING BAN
WHEREAS, Hennepin County has prepared Layout No. 2, Hennepin County Project No.
9112, for the reconstruction of County State Aid Highway No. 61 (Shady Oak Road)
between County State Aid Highway No. 3 (Excelsior Boulevard) and TH 7 and,
WHEREAS, Hennepin County has requested that the City of Hopkins approve Layout
No. 2, and prohibit on -street parking within the project area and,
WHEREAS, Hennepin County has also requested that the City of Hopkins participate in
the right-of-way costs associated with this project and that the city agree to enter into a
Right of Way Agreement and a Construction Cooperative Agreement;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hopkins,
Minnesota that:
1. Layout No. 2, Hennepin County Project No. 9112, for the reconstruction of
County State Aid Highway No. 61 (Shady Oak Road) between County State
Aid Highway No. 3 (Excelsior Boulevard) and TH 7 is hereby approved.
2. The City of Hopkins agrees to enter into a Right of Way Agreement and a
Construction Cooperative Agreement which will define financial
responsibilities for the construction items, right-of-way, design, county
construction management and other related items associated with said project
3. The parking of motor vehicles is prohibited at all times on both sides of
County State Aid Highway No. 61 (Shady Oak Road) from County State Aid
Highway No. 3 (Excelsior Boulevard) to TH 7.

Dear Mr. Stadler:
Transmitted herewith for approval by the Hopkins City Council, please find Preliminary Layout
No. 2 (dated March 5, 2012) for the referenced project. In addition, please find a preliminary cost
estimate and schedule for your reference. The proposed project includes the reconstruction of
County State Aid Highway (CSAH) 61 from Excelsior Boulevard to north of Trunk Highway 7.
The proposed improvements include reconstructing CSAH 61 as a four lane urban roadway with
a new pavement structure, improved drainage facilities, safer pedestrian accommodations, and
new traffic signal systems at Main Street and at Trunk Highway 7.
Hennepin County is requesting Council approval of the layout:as an assurance that the City is in
agreement with the project concept prior to beginning detailed design and development of the
environmental analysis and construction documents. The preliminary layout is the "footprint" of
what the project will looklike. The footprint proposed in this layout is smaller than what was
shown in the layout previously approved by the Cities of Hopkins and Minnetonka in September
2006. The smaller footprint results in lower construction and right of way acquisition costs for
the county and the cities.
The County respectfully requests City Council approval of the preliminary layout, and that the
following be included in the Resolution of Approval:
e Approval of Preliminary Layout No. 2 (dated March 5, 2012).
® Authorization by the City for the County to acquire all rights -of way, permits, and/or
easements required for the improvements proposed in Preliminaiy Layout N0.2.
o Agreement by the City to ban the parking of motor vehicles at all times and to provide
enforcement for the prohibition of on -street parking for CSAH 6.1 and Main Street within.
Project No. 9112 limits and Hopkins' corporate limits.

Council approval of the preliminary layout sloes not obligate a financial commitment by the city
at this time. A Right of Way Agreement is being drafted that will. detail anticipated land
acquisition costs for the project. Execution of that Agreement will represent a financial

preliminary layout approval. Please note that the County has already acquired four properties in
anticipation of the project.
The City Council will also have the opportunity to approve the final construction plans and
Construction Cooperative Agreement, which will include construction cost. pail icipation and

Frequently Asked Questions (FAQ)
1. Will property access be maintained throughout construction?
Maintaining access to both properties and businesses will be a top priority during construction.. The contractor will be
required to ensure property access is always maintained.
2. Will school bus stop safety be maintained throughout construction?
Yes, safety on the roadways, including bus stops, is of great importance and will be maintained throughout construction.
The project team will coordinate with the school district and bus company(s) during detailed design of the project.
3. How will pedestrians be accommodated at the Mainstreet/Shady Oak Road intersection?
The Mainstreet/Shady Oak Road intersection design proposes a new, highly visible pedestrian crossing to increase
safety. Based on comments from the public informational meeting, the layout has been modified to reflect a more
pedestrian friendly environment at the crossing location.
4. How will pedestrian and bicycle travel through the corridor be improved? Will sidewalks or trails be added to
both sides of Shady Oak Road?
The proposed design of Shady Oak Road will incorporate a trail along the east side of the roadway and a sidewalk along
the west side of the roadway. Once the trail along Shady Oak Road is constructed, users will have improved access to
the regional trail system. During the recent reconstruction of Shady Oak Road south of Excelsior Boulevard, the trail
along Shady Oak Road was connected to the Minnesota River Bluffs LRT Regional Trail 0.3 miles south of Excelsior
Boulevard. A future trail connection has also been proposed between the Shady Oak Road trail and the Lake
Minnetonka LRT Regional Trail along the south side of Trunk Highway 7, a distance of approximately 0.3 miles.
5. What will be done to reduce neighborhood cut -through traffic during construction?
Shady Oak Road will remain open to two-way traffic during construction. Significant neighborhood cut -through traffic
related to the construction activities is not anticipated. If cut -through traffic is experienced, it will be addressed through
signage and enforcement as much as practicably possible.
6. Will noise walls be constructed as part of this project?
The proposal of noise walls depends upon a noise analysis, per federal guidelines, as part of the environmental review
related to the project. If the analysis determines a noise wall should be proposed, feedback from affected property
owners will be solicited.
7. With the existing nearby highways (TH 169,1-494, TH 62 and TH 7), why does Shady Oak Road need to be widened
to four lanes?
Shady Oak Road is classified as an A -Minor Arterial, and as an A -Minor Arterial it is intended to serve medium length
trips within the county and provide connections to the principal arterial system (freeways). The traffic on Shady Oak
Road is forecast to increase over the next 20 years as a result of new development in Minnetonka and Hopkins, and
construction of the Southwest LRT line. Traffic from this area, destined to 1-494, must use Shady Oak Road to Trunk
Highway 7, because Excelsior Boulevard does not have access to 1-494. With the current two lane section, the
intersection of Main Street and Shady Oak Road is forecast to operate at an unacceptable level of service "F" during
peak hours by 2030 and traffic would back up from Main Street to Excelsior Boulevard. The analysis of 2030 traffic
forecasts indicates that a four lane section with left -turn lanes is required to maintain an acceptable level of service.

8. Why is there a median at the Bradford Road/Shady Oak Road intersection?
In an attempt to improve safety at the Bradford Rd/Shady Oak Road and Excelsior Blvd/Shady Oak Road intersections, a
median at the Bradford Road intersection -was incorporated, thus reducing the number of conflict points within a short
distance of the Excelsior Boulevard/Shady Oak Road intersection and improving safety.
9. Why is it necessary to redesign the Shady Oak Road/Trunk Highway 7 intersection and acquire homes along the
east -side of the roadway?
The Shady Oak Road/Trunk Highway 7 intersection was redesigned for three reasons:
• Additional capacity was needed to maintain acceptable traffic operations for the forecast traffic
volumes.
• The current direct residential access to Shady Oak Road near the TH 7 intersection is not safe and is
frequently blocked by traffic queuing back from the TH 7 intersection.
• The sight distance on Shady Oak Road between Lake Street and TH 7 is not adequate.
A number of alternatives were considered to address these issues, but the best alternative was to realign Shady Oak
Road to provide: a more perpendicular intersection with TH 7, additional turn lanes, and a frontage road for private
access. This required acquisition of the homes on the east side but significantly improves safety in this area.
10. Why does the TH 7 North Service Drive need to be realigned to meet Shady Oak Road?
The North Service Drive realignment is necessary to provide additional spacing between the TH 7 intersection and the
North Service Road intersection and to improve traffic signal operations and safety. Separating these intersections will
still provide access to the adjacent neighborhood while providing needed storage space for vehicles queued at the traffic
signal.
11. Will business parking spaces along Shady Oak Road be impacted?
Yes, some of the existing parking spaces are within the right-of-way and must be removed. We are working with
individual property owners to identify how to adequately provide parking for their properties. All access to and from
Shady Oak Road will be from designated driveway access points.
12. Will the road reconstruction alleviate the flooding on the roadway and adjacent streets?
The roadway is being designed to provide a connection from the pond on the east side of Shady Oak Road between 1st
Street and 2nd Street (duck pond) to the storm water system on the west side of Shady Oak Road which will alleviate the
flooding that has occurred in this area. Currently when water in the duck pond reaches flooding levels it flows over
Shady Oak Road to the wetlands on the west side of Shady Oak Road. The new pipe will allow storm water to flow
under the road before it reaches a level that floods the adjacent streets and properties.
13. Will the duck pond(s) be protected during construction and accessible after construction?
The duck pond will be protected from sedimentation during construction through an erosion control plan. The current
grassy area along Shady Oak Road, between 1st and 2nd Streets, is proposed to be eliminated with the project and is
proposed to be replaced on the south side of the pond. This area will be accessible from either 1st Street or the trail
along the east side of Shady Oak Road.
