Kearney, Building Official �at�: February 1, 2008 Re: Second Reading of Ordinance 2008-994 ORDINANCE 2008-994 RENTAL LICENSES Staff recommends that the Council approve the following motion: Move that the Hopkins Citv Council approve Ordinance 2008-994 for second readinq, approve the Summary Ordinance 2008- 994 order Summary Ordinance 2008-994 published and posted at the Hopkins Librarv and approve resolution 2008-003 amendinq license fees establishinq inspection fees, inspection point svstem for determininq inspection frequencv and substandard dwellinas. • This ordinance has not changed since the first reading. It requires a four-fifths vote of the City Council to approve the publication of the summary ordinance. The effective date has been set as February 14, 20Q8. The inspection requirements and fees would be implemented February 14 2008. City Attorney has reviewed the proposed ordinance. WHEREAS, the City Council has enacted City Ordinance Section 4Q7, which assures that rental housing in the City is decent, safe and sanitary; and VJ��REAS, the City Council has determined that regular inspections ensure that the - City's rental housing stock is decent, safe and sanitary; and • VJF�REAS, the City Council desires a system to determine substandaxd dwell,ings and to categorize dwellings into three groups whereby properties with very few deficiencies would be inspected on approximately a three-year cycle, properties with some deficiencies would be inspected on approximately a two-year cycle, and properties with many deficiencies would be inspected on approximately a one-year cycle; and WHEREAS, the City Council desires to establish fees to fund the inspectors who perform the annual rental license and the periodic rental license inspections; and W��REAS, the City Council desires to establish increased fees for multiple re- inspection of unresolved rental property deficiencies to defray the costs of multiple � inspections. � NOW, THEREFORE, BE IT RE50LVED that the City Cauncil adopts the Rental License classification system developed by the Inspections Division whereby: a) Def ciency points are associated with the severity of the deficiency; and b) Properties with average of 4 or fewer points will be classified as Category A and inspected on approximately a three-year cycle, properties with an average of 5 to 10 points wil.l be classified as Category B and inspected on approximately a two- yeax cycle, and properties with an average of 11 or more points will be classified . as Category C and inspected on approximately a one-year cycle; and c) Deficiency points will be also used in the determination of a substandard dwelling as defined in Section 407.10;.and • . .
