Prior to tfie beginning of the construction process, the owner of Lot 2, Block 2, Oak Ridge Place Second Addition wilt put down 2�/2 feet af wood mulch to protect the root system of trees located near the Club's prvperty line. The 2 feet of wood mulch will be maintained throughout the construction process and heavy equipment will use the wood mu�ch base for movement of equipment during the construction of this project. The owner and his contracted workers will exhibit reasona.ble care to safeguard the fence owned " �y the Club� as�well fence. — 2. We are assuming tl2at the building quality of Oak Ridge Place Second Addirion will be of the same quality as that of the original Oak Ridge Place atready in e�stence. Hopkins, MN 55343 Hopkins, MN 55343 Dear Mayor Maxwell: Oak Ridge Country Club is in receipt of the letter sent to you and Ms. Nancy Anderson, City Planner from Mr. Michael Halley dated June 25, 2007. Since the time my original letter to you dated June 20, 2007, Oak Ridge Country Club has discussed some additional concerns with respect to the applications being considered for, as well as the construction and location of the project referenced as Lot 2, Block 2, Oak Ridge Place � Second Addition. First, if the project is built, Oak Ridge Country Club needs assurances that there will not be water runoff problems onto Club property from the construction site, building or property either during construction or after the project is completed. Any water runoff problems onto Club property from the construction site, building or property from Lot 2, Block 2, Oak Ridge Place Second Addition need to be the responsibility of the owner of that project and remediation of the water runoff problem should be at the expense of the owner of Oak Ridge Place Second Addition. Secondly, an article in the Sunday, June 24�' edition of the Star Tribune entitled, "Teed off: Golf course homeowners" is an example of another concern Oak Ridge Country Club raises. The article written by Bill Pennington of the New York Times describes problems that golf courses have had with neighbors as a result of errant golf balls coming from the golf course. According to the article, in one particular situation in Massachusetts the country club had to shorten the length of its 9 hole because so many golf balls were hitting the condominiums even though the club and golf course were there first. This is the type of situation that goes directly to part of our concerns regarding the location of the Oak Ridge Place Second Addition project. The proposed project for the construction of Oak Ridge Place Second Addition is in the immediate vicinity of the 9 tee of the Club's golf course. Placing this construction in such close proximity to the teeing area of the 9 hole significantly increases the possibilities of errant golf shots hitting the building, property or persons that may be in the area of the proposed project. We did mention a portion of this concern to Michael • Halley during our initial meeting with him to review the general area of the proposed project. Mr. Halley told us that the plan is to use a tempered glass for windows that will be difficult to break. The original Oak Ridge Place completed earlier is further down the • 9 hole and less likel to be struck b errant olf shots than the ro'ect that is now bein Y Y g p J g proposed. Oak Ridge Country Club needs to have the assurance that if this project is built knowingly within such close proximity to the Club's 9�' tee, that the owners of Lot 2, Block 2, Oak Ridge Place Second Addition as well as the owners and/or lease holders of the units being proposed for this location forever indemnify Oak Ridge Country Club from any and all claims of daxnage to the building, property or injury of persons in that area that where such claim may be the result of an errant golf shot(s). Further, Oak Ridge Country Club also feels that since the proposed building project is knowingly being located within such close proximity to the Club's 9 tee that the owner and subsequent owners of Lot 2, Block 2, Oak Ridge Place Second Addition as well as any purchasers or lease holders of the units in this project not bring any action against the Club in demand of renovations of the Club's golf course or properly. Finally, we are aware that many of the units located in the original Oak Ridge Place have not been sold. Is it appropriate to grant a permit for a project that may not ha�e a realistic expectation that it will actually.be built?
