2012 STREET AND UTILITY IMPROVEMENTS

Proposed Action
Staff recommends the following motion: "Move that Council adopt Resolution 2011-028, Resolution Adopting
Assessment Roll, 2012 Street and Utility Improvements, City Project 2011-10 and Resolution 2011-029,
Resolution for Award of Bid, 2012 Street and Utility Improvements, Cily Project 2011-10"
This action continues an assessable project for street improvements.
Overview
The bid opening for the 2012 Street and Utility Improvements was held on April 11, 2012. The low bid was
$1,941,937.80. Assessment calculations were prepared based on the low bid submitted by S.M. Hentges &
Sons, Inc. At its April 17, 2012 meeting, the Hopkins City Council accepted the bids and ordered the
preparation of the assessment roll for the project. At that same meeting, the Council ordered an assessment
hearing for the project to be held May 15, 2012. This assessment hearing sets in motion levying of
assessments against benefiting properties. A public hearing notice has been published and mailed, along
with an assessment statement to every affected property owner. As of this writing, two written objections
contesting the proposed assessments have been submitted. Written objections to Council must be submitted
no later than the hearing date. Staff is recommending Adoption of the Assessment roll and award of the
project contract to S.M. Hentges & Sons, Inc. following the public hearing.

• Appeal procedure:
Property owners are given the opportunity to approach Council with their objections to the proposed
assessments during the public hearing. Standard forms for written objections have been available at City
Hall and need to be submitted no later than the hearing date.
• Appeals Received:
Attached are the two appeals we received from the property owners at 303 6th Avenue North and 600
Minnetonka Mills Road.
The 303 6th Avenue North property owner has requested a cancelation of his $2,242.57 assessment. His
assessment is based on the one block spread of assessments for Minnetonka Mills Road. We do not
recommend cancelling this assessment as it was arrived at through application of the City's assessment
policy.
This property owner also requested a senior citizen deferment based on age and income, if his cancellation
request was denied. He meets the criteria for the deferment, and as such, we recommend granting the
deferment.
The property owner at 600 Minnetonka Mills Road is requesting a revision of their assessment in the amount
of $7,341.61 due to added burden and asked about the equity of their assessment relative to neighboring
commercial and residential assessments. The neighboring commercial properties are paying $68,000,
$79,000, and $172,000 in assessments on this project.
This property has approximately 87 feet of frontage on Minnetonka Mills Road which is significantly larger
than the typical 55 foot lot seen on 6th, 8th and 9th Avenues. If the lot were to be treated as at 55 foot lot, the
assessment would be reduced to $4,919.00. The monthly payment for the proposed assessment, if paid
through the owner's taxes, would be approximately $46 beginning in May 2013. As the assessment was
arrived at through application of the City's assessment policy, we do not recommend revising this
assessment.
• Project costs and assessments:
Based on the low bid, 25% overhead costs (engineering, admin, legal), and a 5% construction
contingency the total estimated project cost is $2,548,800. This is considerably lower than the
preliminary total estimated project cost of $3,072,000. The cost saving are reflected in lower
assessments for those properties not subject to the assessment cap.
The assessable amount is calculated based on 70% of the assessable roadway costs and 80% of alley
reconstruction. The total amount to be assessed for street improvements on this project is $939,994.24.
Water service bids were favorable as well. The preliminary assessment amount for water services was
$1,000 per unit. The final amount is lowered to $824.25 based on 50% of the improvement cost.
Staff recommends applying an annual interest rate of 5% to this assessment. This interest rate is based

on recent bonding rates received by the City. Staff also recommends adopting a 15 year term for the
assessment as discussed at previous Council Meetings. The following table shows the anticipated
assessment rates (not including water services):

All bids were submitted with required bid security made by qualified contractors. S.M. Hentges is a
reputable and responsible contractor and has completed similar projects in the metro area.
Sometimes staff will recommend waiting with the award of a contract until the 30 day filing period for
appeals has expired. In this instance, due to the good bids the City received, and because limited appeals are
anticipated, staff is recommending award of the project contract to S.M. Hentges & Sons, Inc. at this time
unless any significant and unforeseen appeals are submitted at the Council meeting.

In regard to the assessment to my property at 600 Minnetonka Mills Rd.
I lost my job of 15 years in 2011, slashing my income to barely half of what it was. With the
fall of property values and the rise of property taxes, it's all I can do to make ends meet.
Currently, I work 2 part-time jobs that help to JUST make ends meet, not to mention
healthcare costs!
I had hoped the City of Hopkins would have taken a closer look at the cost to its residents
when beginning this project and made an attempt to alleviate the burden to its citizens. In
this tough economic time, it's difficult enough just to make ends meet and now we're slapped
with this assessment.
This project couldn't come at a worse time for most people as far as the economy goes unless
you are fortunate enough to be among the affluent population.
Minnetonka Mills Road is heavily traveled by mostly commercial vehicles - semis, service
vehicles, buses, etc. - serving Chapel View, Gethsemane, the grade school. Not to mention the
traffic of regular vehicles generated by Chapel View, Gethsemane and the grade school. The
majority of the wear and tear to the bituminous street, curb and gutter past my house is
commercial related and that those named above should be responsible for the majority of
repair.
Are there not government funds available for the improvement of infrastructure? We pay
taxes on EVERYTHING so it would seem there would be some monies available somewhere.
Has that been examined?
My neighbors are being assessed significantly less than I. They may have less footage (not
much!) but they don't have nearly the traffic as Minnetonka Mills Rd experiences and they
don't have to live with the increased traffic noise and wear and tear from commercial
vehicles.
I sincerely request that the City of Hopkins re-evaluate my assessment. This assessment will
definitely be a burden to me. I am searching for work and hope to increase my income back
to where it was. I am 57 years old and the competition is intense as I struggle to compete
against younger people also looking for work. And like it or not, there is definitely age
discrimination out there.

RESOLUTION NO. 2012-028
RESOLUTION ADOPTING ASSESSMENT ROLL
2012 STREET AND UTILITY IMPROVEMENTS
CITY PROJECT 2011-10
WHEREAS, pursuant to proper notice duly given as required by law, the City Council
has met and heard and passed upon all objections to the proposed assessment for the
improvement of 2012 Street and Utility Improvement Project, as described in the files of the City
Clerk as Project 2011-10.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hopkins,
Minnesota:
1. Such proposed assessment, as may be amended and a copy of which is attached
hereto and made a part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein included is
hereby found to be benefited by the proposed improvement in the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a
period of fifteen years, the first of the installments to be payable on or after the first
Monday in January 2013, and shall bear interest at the rate of 5 percent per annum
from the date of the adoption of this assessment resolution. To the first installment
shall be added interest on the entire assessment from May 15, 2011, until December
31, 2011. To each subsequent installment when due shall be added interest from one
year on all unpaid installments.
3. It is hereby declared to be the intention of the Council to reimburse itself in the future
for the portion of the cost of this improvement paid for from municipal funds by
levying additional assessments, on notice and hearing as provided for the
assessments herein made, upon any properties abutting on the improvement but not
made, upon any properties abutting the improvement but not herein assessed for the
improvement, when changed conditions relating to such properties make such
assessment feasible.
4. To the extent that this improvement benefits non -abutting properties which may be
served by the improvement when one or more later extensions or improvements are
made, but which are not herein assessed, therefore, it is hereby declared to be the
intention of the Council, as authorized by Minnesota Statutes Section 429.051, to
reimburse the city by adding any portion of the cost so paid to the assessments levied
for any of such later extension or improvements.

5. The clerk shall forthwith transmit a certified duplicate of the assessment to the
County Auditor to be extended on the property tax lists of the County, and such
assessments shall be collected and paid over in the same manner as other municipal
taxes.

RESOLUTION FOR AWARD OF BID
2012 STREET AND UTILITY IMPROVEMENTS
CITY PROJECT 2011-10
BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA, that
the lowest bid of S.M. Hentges & Sons, Inc.. in the amount of $1,941,937.80 is the lowest
responsible bid for the 2012 Street and Utility Improvements, City Project 2011-10, and the
Mayor and City Manager are hereby authorized and directed to enter into a contract with said
bidder for and on behalf of the City;
BE IT FURTHER RESOLVED, that Bolton and Menk, Inc. will perform the
construction services for this project and the City Manager is hereby authorized and directed to
enter into a contract with said firm for and on behalf of the City.
