A RESOLUTION PRAYING HENNEP* COUNTY
DISTRICT COURT TO FILL V' ' CIES
IN THE HOPKINS CITY CHARTER 4l SSION
WHEREAS, by Order of the Hennepiri County District Court
dated March 25, 1976, pursuant to M.S.A, 410.05, the said Court
appointed Frank E. Adams, then a resident f the City of Hopkins,
for a four year term as a member of the Ho kins Charter Commission,
and further appointed Warner P. Blake, Ri and L. Brubacher, Paul W.
Lohmann, Erling E. Rice, and Dr. F. J. Kud ra as members of said
Charter Commission for a two year period d encing March 25, 1976,
which term has now expired, and
WHEREAS, the above named Franc Adams is no longer a
• resident of the City of Hopkins and the said Warner P. Blake and Paul
W. Lohmann cannot now qualify as members of said Commission.
NOW, THEREFORE, it is hereby resolved by the City Council of
the City of Hopkins, as follows:
1. That a proper Order of the District Court of Hennepin
County, Minnesota, be obtained appointing substitutes
for those persons who are no longer qualified to act as
members of said Charter Commission, and further to appoint
qualified persons to fill vacancies upon said Charter
Commission.
Passed and adopted by the Council of the City of Hopkins,
Minnesota, at a regular meeting held or_ tIe 16th day of May, 1978.

The City of Hopkins purchased same land owned by the Chicago,
Milwaukee, St. Paul & Pacific R.R. • assure the City that it would
have sufficient landfill cover mate ial available in the event our pre-
sent sources was cut off (Mason gra -1 pit on Shady Oak). This was a
distant possibility as this land was proposed to be developed into
residential use by Al Fazendin.
Since the land the City purchas -d from the R.R. was land the
developer wanted for building purpos-s, an agreement was negotiated
under which the City would allow the developer to purchase the R.R. land
and the developer would guarantee t - City that 30,000 cu. yds. per year
of fill material would be available o the City for 3 years. The need
for this cover material and the period of time in which it would be
needed has been reevaluated. It is •ur determination that we will need
60,000 cu. yd. over a period of 18 •nths. This change in the agreement
would assist the developer in his de elopment and financing plans by
• having a more realistic and up -to -da e estimate of the needs of the City
and would still protect the interes s of the City in assuring sufficient
cover to finish the landfill operati•n.
Therefore, we would recommend f•r'Council consideration that the
second to the last paragraph of the . ggeement be modified to read as
follows: (see copy of agreement att.ched).
"It is further understood . . . . . . . amounting to 60,000 cubic
yards of such material over a period of 18 months from the date of the
sale said site ".
