PARCE S OF RF�L ESTATE BETWEEN THE CITY OF HOPKINS
AND DERN MER(�tANDISING, INC. AND THE SIGNING
D EXEQlTION OF INSTRUMENTS OF COMIEYANCE
IN CONNECTION Tf-IEREWITH
WHEREAS the City of Hopkins is presently the owner of the following
described premise situated in Hennepin CotuZty, Minnesota, viz:
PARCEL A
Al1 that par of Government Lots 5 and 6 in Section 26, Township 117,
Range 22, ac ording to the U.S. Government survey thereof, described
as follows: Commencing at the point of intersection of the Easterly
line of Coim. y Road Nwnber 61 with the line dividing said Government
. Lot 5 from s'd Government Lot 6; thence following the Easterly line of
said Cowity oad Nwnber 61 in a Southwesterly, Southerly and Southeasterly
direction, t its intersection with the Northwesterly line of the main
line right o� way of the Chicago, Milwaukee and St. Paul Ra.ilway, said
line being p rallel with and distant 123.5 feet Northwesterly from the
center line 'f the most Northerly or Westerly bowld main track of said
Railway; the ce Northeasterly 600 feet parallel with said center line of
said track; hence Westerly parallel with said line dividing said Government
Lot 5 from s'd Government Lot 6, to the point of intersection of said
paraTlel lin with the Easterly line of said County Road Number 61; thence
Southwesterl along said Easterly line of said County Road Nwnber 61, to
the point of beginning, except that part of said Government Lots which lie
within a dis ance of 40.0 feet on each side of the following described
line: Begi ing at the Southeast corner of aforesaid Section 26; thence
West along t e South line thereof a distance of 1677.92 feet; thence
Northwesterl deflecting to the rig�t with an angle of 63 degrees 41 minutes
a distance o 293.62 feet to the actua.l point of beginning of the line to
be described thence Northeasterly deflecting to the rig�t with an angle
of 34 degree 48 minutes 30 seconds a distance of 1400.0 feet and there
terminating.

line to be scribed; thence Northeasterly, deflecting to the right at an

of Titles, Lmty of Hennepin, lying westerly of a line described as
follows:

Range 22 Wes of the 5th Principal Meridian; thence Westerly, along
the South li of said Section 26, a distance of 1677.92 feet; thence
Northwesterl deflecting to the rig�t at an angle of 63 degrees 41
minutes 00 s onds, a distance of 293.62 feet, to the point of beginning
of the line be described; thence Northeasterly, deflecting to the
rig�t at an gle of 34 degrees 48 minutes 30 seconds, a distance of
1400.00 feet d said line there terminating, and
WHEREAS, it is deemed in the best interests of both parties herein-
above mentioned, at an exchange of said parcels be made by appropriate deeds,
s aid parcels bein deemed and agreed to be of ec{ual values.
NOW, FORE, it is hereby resolved by the Council of the City of
Hopkins, as follo .
1. Tha the City of Hopkins by appropriate deed convey Parcel A
hereinabove descr' ed to Modern Merchandising, Inc. in consideration of and
exchange for Parc B which Modern Merchandising, Inc. shall by appropriate
deed convey to th City of Hopkins.
� Z. Tha the Ma.yor and the Clerk of the City of Hopkins be and the
same are hereby a orized and empowered for and in behalf of the City of
Hopkins to sign, ecute and deliver an appropriate deed as above set forth
to Modern Merchan sing, Inc.

Minnesota, at a r lar meeting held on the 5th day of July, 1978.
