CR 2012-073 Repeal of Cable Franchise Regulatory Ordinance�m July 2, 2012 Council Report 2012-073 Repeal of Cable Franchise Regulatory Ordinance Proposed Action Staff recommends adoption of the following motion: Approve Ordinance 2012-1052 for first reading. This action will begin the process of repealing Ordinance 96-792, Cable Regulatory Ordinance. Overview In 1996, the City of Hopkins, along with the other four cities in the Southwest Suburban Cable Commission (SWSCC), granted a cable franchise to KBL Cablesystems of the Southwest, Inc. effective January 1, 1997. At that time the City adopted two ordinances. Ordinance 96-790 was the franchise ordinance which granted the franchise to KBL. Ordinance 96-792 regulated construction and operation of any cable system in the City. In 2000, the Hopkins along with the other SWSCC Cities approved a transfer of the Existing Franchise to Time Warner, Inc. In June of 2005, Time Warner transferred the Existing Franchise to Comcast Communications ("Comcast"). During these transfers, Ord. 96-792, the regulatory ordinance, remained in effect. Ordinance 2012-1051, which renews the cable franchise for Comcast, incorporates the provisions of the Regulatory Ordinance into a renewed franchise — resulting in one governing document addressing cable regulations in each SWSCC City. Supporting Information • rdinance 2012-1052 James Genellie Assistant City Manager CITY OF HOPKINS COUNTY OF HENNEPIN ORDINANCE NO. 2012-1052 AN ORDINANCE REPEALING THE CABLE TELEVISION REGULATORY ORDINANCE Whereas, Hopkins Ordinance 96-792 ("Regulatory Ordinance") governs the provision of cable services by cable operators in the City of Hopkins, Minnesota ('City"); and Whereas, the City Council adopted Ordinance No. 2012-1051 granting a Cable Television Franchise ('Franchise") to Comcast of Arkansas / Florida / Louisiana / Minnesota / Mississippi / Tennessee, Inc., ("Comcast") to provide cable services and maintain and operate a cable communications system within the City; and Whereas, the Franchise incorporates all of the key provisions of the Regulatory Ordinance that the City may still enforce under applicable law thereby eliminating the need to maintain the Regulatory Ordinance. Now therefore, the City of Hopkins, Minnesota hereby ordains: Section 1. Cable Television Regulatory Ordinance No. 96-792 is hereby repealed in its entirety. Section 2. The effective date of this ordinance shall be August 1, 2012.
