APPROVE QUITCLAIM DEED
Proposed Action
Council Report 2013-050
Staff recommends the following motion: "Move that Council adopt Resolution 2013-027,
Resolution Approving Quitclaim Deed to Redgren Properties."
Overview
In 1991, the City received a blanket easement over two properties, 820 Mainsteet and 5 -- 9"' Ave
S, in order to allow for the conversion of overhead electrical service to new underground services
to the buildings on these properties. Upon completion of the new electrical service work a new
easement was acquired over the southerly 10' of these properties. However, for unknown
reasons the original blanket easement was never vacated. The land is for sale and final
disposition of the easement is needed prior to a closing scheduled for later this month.

RESOLUTION APPROVING QUITCLAIM DEED TO REDGREN PROPERTIES
REGARDING 820 MAINSTREET AND 5 — 9TH AVE S PROPERTIES
Whereas, a certain perpetual easement over the entire properties at 820 Mainstreet and 5
— 9`' Ave S for installation of underground utilities was created and recorded in 1991, and
Whereas, the easement over the properties is no longer needed by the City or public
utility companies, and
Whereas, an easement covering only the southerly 10' of these properties is being
retained for utility purposes,
NOW, THEREFORE, BE IT RESOLVED that the City conveys and quitclaims to
Redgren Properties the perpetual easement covering the above described properties
except to retain a perpetual easement for utility purposes covering the southerly 10 feet of
said properties.
