City Project 2013-10
Proposed Action.
Staff recommends adoption of the following motion: Move that Council adopt Resolution 2013-
043, Resolution Ordering Improvement after Public Hearing, 2013 Street and Utility
Improvement project, Project 2012-10, and companion Resolution 2013-044, stating City's
intent to sell bonds to fund this project.
This action continues an assessable project for street improvements.
Overview.
At the June 4, 2013 meeting, the Hopkins City Council authorized WSB and Associates, Inc. to
prepare a feasibility report concerning street and utility improvements on West Park Road and
21St Avenue North At its July 9, 2013 meeting, Council ordered a public hearing on the
improvements for August 5, 2013. Hearing notices have been mailed to all affected property
owners of record. In accordance with state statutes, City Council needs to conduct the public
hearing and determine authorization of the project. Following the public hearing, if the project is
ordered, City Council is asked to state the City's intent to sell bonds to fund the project.

Scope of Improvements
This project includes the reconstruction of the following:
• West Park Road from 2nd Street North to the northerly corporate limits
• 21St Avenue North from 1St Street North, south to the dead end.
• Water, Sanitary and Storm Sewer facilities
The pavement condition index for most of the project area is below 40, which indicates failed
pavement and warrants reconstruction.
Proposed street improvements include full reconstruction with new curb and gutter
throughout the project area.
Proposed water main improvements include the removal and replacement, valves and
hydrants in the project area. Additionally, all water services will be replaced from the main
to the property line unless they are copper and less than 10 years old. We have also included
relocating the 18" trunk water main in 21St Avenue because of the Shady Oak Road Project.
Sanitary sewer improvements include the removal and replacement of the main, manholes
and non -PVC service lines from the main to the property lines on 21St Avenue North only.
Proposed storm sewer improvements include adding new storm sewer and inlet structures to
improve water drainage.
Street signs will also be replaced in the project.
Public Input
A public information meeting was held on July 10, 2013. Eighteen property owners attended
and were generally supportive of the proposed improvements. We also sent a questionnaire to
all property owners in the neighborhood and received 5 responses. Drainage concerns were
the most notable comment in the responses.
Because of the Shady Oak Road project, many individual meetings with property owners
have occurred.
Assessments
The proposed street assessments are based on the City's Assessment Policy whereby 70% of
the street reconstruction cost and 50% of the water service and sanitary sewer service
replacements are assessed to the benefiting properties.

The assessment cap for residential properties is $78.98 per front foot for this project based on
adding 3% to the 2013 cap. Without the cap, the street assessments would be nearly double
the capped rate. The average total preliminary assessment is shown below. Larger parcels
will have larger street assessments and small lots will have smaller assessments.

The housing complex north of West Park Road is not being assessed for several reasons.
• The property is not in Hopkins, thus we do not have the statutory authority to assess
this property
• If it were in Hopkins, our assessment policy would not allow us to assess it.
• Property owners do not pay assessments on streets they regularly travel, just those
adjacent to their properties or designated assessment areas in the assessment policy.

The estimate costs for this project, which includes 15% contingency and 25% for legal,
administrative, engineering and fiscal costs, are as follows:

Notice is hereby given that the City Council will hold the Public Hearing in the City Council Chambers of the
Hopkins City Hall at 7:00 p.m. on Monday, August 5, 2013, to consider the making of an improvement on:
21" Avenue North — from Shady Oak Road (CSAR 61) to 1" Street North; and
West Park Road — from 2nd Street North to Wyndham Hill Drive
Improvements proposed along 21 st Avenue North and West Park Road include roadway reconstruction and
concrete curb and gutter replacement. These improvements consist of bituminous pavement replacement and
subgrade corrections.
• Cul-de-sac construction at the intersection of 21 st Avenue North and 1 st Street
• Cul-de-sac construction at the intersection of West Park Road and Wyndham Hill Drive
• Installation of the cul-de-sacs to the north will eliminate access to Shady Oak Road (CSAH 61) to the
west and maintain access to the residential roads to the east
• Both cul-de-sacs will provide additional parking with access to the trail located along Shady Oak Road
(CSAH 61)
• Proposed utility improvements on 21st Avenue North and West Park Road include some replacements
of the sanitary sewer, water main and services to the City right-of-way
pursuant to Minnesota Statutes, Section 429.011 to 429.111. The area proposed to be assessed for such
improvement is shown on the back side of this notice.
The estimated cost of the improvement is $730,000. A reasonable estimate of the impact of the assessment will
be available at the hearing. Such persons as desire to be heard with reference to the proposed improvement will
be heard at this meeting.

RESOLUTION NO. 2013-043
RESOLUTION ORDERING PUBLIC IMPROVEMENT, 2014 STREET
IMPROVEMENT PROJECT, PROJECT NO. 2013-10
WHEREAS, a resolution of the City Council adopted the 9th day of July, 2013 fixed a
date for a Council Hearing on the proposed street improvements to West Park Road and
21St Avenue North, including asphalt roadway, concrete curb and gutter installation and
water, sanitary and storm sewer improvements and all necessary appurtenances, and
WHEREAS, the City Council deems it appropriate and expedient to make such
improvements, and
WHEREAS, ten days mailed notice and two weeks published notice of the hearing was
given, and the hearing was held thereon on the 5th day of August, 2013 at which all
persons desiring to be heard were given an opportunity to be heard thereon.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Hopkins,
Minnesota:
1. Such improvement is necessary, cost-effective, and feasible as detailed in the
feasibility report.
2. Such improvement is hereby ordered as proposed in the Council Resolution
adopted the 17th day of January, 2012. The total estimated project cost is
$750,000.
3. WSB & Associates, Inc. is hereby designated as the engineer for this
improvement. The engineer shall prepare plans and specifications for the making
of such improvement.
Adopted by the City Council of the City of Hopkins this 5th day of August, 2013.

RESOLUTION NO. 2013-044
DECLARING THE OFFICIAL INTENT OF THE CITY OF HOPKINS
TO REIMBURSE CERTAIN EXPENDITURES FROM
GENERAL OBLIGATION IMPROVEMENT BOND PROCEEDS
TO BE ISSUED BY THE CITY OF HOPKINS
WHEREAS, the Internal Revenue Service has issued Treas. Reg. #1.150-2
providing that proceeds of tax-exempt bonds used to reimburse prior expenditures shall not
be deemed spent unless certain requirements are met; and
WHEREAS, the City expects to incur certain expenditures, which may be financed
temporarily from sources other than bonds, and reimbursed from the bond proceeds;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HOPKINS, MINNESOTA (THE CITY) AS FOLLLOWS:
1. The City intends to incur expenditures for the project described in Council Report
2013-079, for City Project 2013-10 (the "Project'), and intends to reimburse itself
for such expenditures from the bond proceeds to be issued by the City in the
maximum principal amount described in the "project".
2. The City Manager is authorized to designate additions to Project 2013-10 in
circumstances where time is of the essence, and any such designation shall be
reported to the Council at the earliest practicable date and shall be filed with the
official books and records of the City.
3. This resolution is intended to constitute a declaration of official intent for the
purpose of Treas. Reg. #1.150-2 and any successor law, regulation, ruling or
amendment pertaining thereto.
Adopted by the City Council of the City of Hopkins, Minnesota, this 5`" day of August,
2012.
