Approve Engineering Services Agreement — Mainstreet Improvements
Proposed Action
Staff recommends adoption of the following motion: Move that Council approve the selection of
Bolton & Menk, Inc. for design and construction services for the Mainstreet Improvement
project and authorize the City Manager to execute the professional services agreement in the
amount of $509,589.00.
Overview
City staff would like to contract with Bolton & Menk to complete all facets of the 2015 Mainstreet
Improvement project design and construction management. The project area would include
Mainstreet from 51h Ave to 20th Ave. The design work can be broken down into five major
categories: roadway, crosswalk and pedestrian ramp design; streetscape rehabilitation design;
traffic signal & lighting design; stormwater design; and watermain design. In addition, the
scope of this contract includes facilitating several public engagement meetings and additional
work required by MnDOT to ensure that the project meets Federal Aid standards. The
proposed fees are reasonable given the above-mentioned scope - they are 13% of the
estimated $3.8M construction cost. Bolton & Menk has a proven track record in working well
with our residents, especially during the construction phase. This project will obviously require
close coordination, responsiveness and tact in working with the business owners along,
Mainstreet. The project schedule calls for completing the final design in the July/August 2014
timeframe, with construction occurring August — November 2015. As you know, the City has
been approved for a $660,900 Federal Highway Safety Improvement Program grant for this
project to construct traffic signal upgrades, pedestrian ramps reconstruction to meet ADA,
accessible pedestrian signals and countdown timers.

the City's current 2014-2018 Capital Improvement Plan, including this Mainstreet
Improvement project, is accounted for in the City's proposed financial management

and the information compiled in the Highway Safety Improvement Program (HSIP) application prepared
in Spring, 2013. We were excited to hear about the $660,900 grant the City has been selected to receive
for this project and look forward to assisting the City with achieving its goal to rehabilitate and improve
this vital corridor.
This proposal has been prepared in the form of our standard agreement. Upon your review and approval
of this agreement, please print and sign two (2) copies of each agreement, and return them both to our
office. I will return a fully executed copy to you.

This Agreement, made this 26th day of November, 2013, by and between CITY OF HOPKINS, 1010 1"
Street South, Hopkins, MN 55343, hereinafter referred to as CLIENT, and BOLTON & MENK, INC.,
12224 Nicollet Avenue, Burnsville, MN 55337, hereinafter referred to as CONSULTANT.
WITNESS, whereas the CLIENT requires professional services in conjunction with 2014 MAINSTREET
IMPROVEMENTS — FINAL DESIGN AND CONSTRUCTION PHASE SERVICES and whereas the
CONSULTANT agrees to furnish the various professional services required by the CLIENT.
NOW, THEREFORE, in consideration of the mutual covenants and promises between the parties hereto,
itis agreed:
SECTION I - CONSULTANT'S SERVICES
A. The CONSULTANT agrees to perform the various Basic Services in connection with the proposed
project as described in Exhibit I.
Upon mutual agreement of the parties hereto, Additional Services may be authorized as described
in Exhibit I or as described in Paragraph N.B.
SECTION H - THE CLIENT" S RESPONSIBILITIES
A. The CLIENT shall promptly compensate the CONSULTANT in accordance with Section III of this
Agreement.
B. The CLIENT shall place any and all previously acquired information in its custody at the disposal
of the CONSULTANT for its use. Such information shall include but shall not be limited boundary
surveys, topographic surveys, preliminary sketch plan layouts, building plans, soil surveys,
abstracts, deed descriptions, tile maps and layouts, aerial photos, utility agreements, environmental
reviews, and zoning limitations. The CONSULTANT may rely upon the accuracy and sufficiency
of all such information in performing services unless otherwise instructed, in writing, by CLIENT.
C. The CLIENT will guarantee access to and make all provisions for entry upon both public and
private portions of the project and pertinent adjoining properties.
D. The CLIENT will give prompt notice to the CONSULTANT whenever the CLIENT observes or
otherwise becomes aware of any defect in the proposed project.
E. The CLIENT shall designate a liaison person to act as the CLIENT'S representative with respect to
services to be rendered under this Agreement. Said representative shall have the authority to
transmit instructions, receive instructions, receive information, interpret and define the CLIENT'S
policies with respect to the project and CONSULTANT'S services.

F. The CLIENT shall provide such legal, accounting, independent cost estimating and insurance
counseling services as may be required for completion of the consultant services described in this
agreement.
G. The CLIENT will obtain any and all regulatory permits required for the proper and legal execution
of the project.
H. The CLIENT will lure, when requested by the CONSULTANT, an independent test company to
perform laboratory and material testing services, and soil investigation that can be justified for the
proper design and construction of the project. The CONSULTANT shall assist the CLIENT in
selecting a testing company. Payment for testing services shall be made directly to the testing
company by the CLIENT and is not part of this Agreement.

SECTION III - COMPENSATION FOR SERVICES
A. FEES.

2. Total estimated cost for the services itemized under Section I.A (Basic Fee) is $509,589.00.
Itemization of this cost is as shown in the attached DETAILED WORK PLAN and PROJECT
FEES tables.
3. In addition to the foregoing, CONSULTANT shall be reimbursed at cost plus an overhead fee
(not -to -exceed 10%) for the following Direct Expenses when incurred in the performance of the
work.
a. CLIENT approved outside (facilities not owned by CONSULTANT) computer services.
b. CLIENT approved outside professional and technical services.
C. Outside reproduction and reprographic charges.
d. Expendable field supplies and special field equipment rental.
e. Other costs for such additional items and services that the CLIENT may require the
CONSULTANT to provide to fulfill the terms of this Agreement.
4. Additional services as outlined in Section LB will vary depending upon project conditions and
will be billed on an hourly basis at the rate described in Section III.A.1.
B. The payment to the CONSULTANT will be made by the CLIENT upon billing at intervals not
more often than monthly at the herein rates.

SECI'ION IV - GENERAL
A. STANDARD OF CARE
Professional services provided under this Agreement will be conducted in a manner consistent with
that level of care and skill ordinarily exercised by members of the Consultant's profession currently
practicing under similar conditions. No warranty, express or implied, is made.
CHANGE IN PROJECT SCOPE
In the event the CLIENT changes or is required to change the scope of the project from that
described in Section I and/or the applicable addendum, and such changes require Additional
Services by the CONSULTANT, the CONSULTANT shall be entitled to additional compensation
at the applicable hourly rates. The CONSULTANT shall give notice to the CLIENT of any
Additional Services, prior to furnishing such additional services. The CLIENT may request an
estimate of additional cost from the CONSULTANT, and upon receipt of the request, the
CONSULTANT shall furnish such, prior to authorization of the changed scope of work.
C. LIMITATION OF LIABILITY
CONSULTANT shall indemnify, defend, and hold harmless CLIENT and its officials, agents and
employees from any loss, claim, liability, and expense (including reasonable attorneys' fees and
expenses of litigation) arising from, or based in the whole, or in any part, on any negligent act or
omission by CONSULTANT'S employees, agents, or subconsultants. In no event shall CLIENT
be liable to CONSULTANT for consequential, incidental, indirect, special, or punitive damages.
CLIENT shall indemnify, defend, and hold harmless CONSULTANT and its employees from any
loss, claim, liability, and expense (including reasonable attorneys' fees and expenses of litigation)
arising from, or based in the whole, or in any part, on any negligent act or omission by CLIENT'S
employees, agents, or consultants. In no event shall CONSULTANT be liable to CLIENT for
consequential, incidental, indirect, special, or punitive damages.
Nothing contained in this Agreement shall create a contractual relationship with or a cause of action
in favor of a third party against either the CLIENT or the CONSULTANT. The CONSULTANT'S
services under this Agreement are being performed solely for the CLIENT'S benefit, and no other
entity shall have any claim against the CONSULTANT because of this Agreement or the
performance or nonperformance of services provided hereunder. The CLIENT agrees to include a
provision in all contracts with contractors and other entities involved in this project to carry out the
intent of the paragraph.
The CONSULTANT agrees to maintain, at the CONSULTANT'S expense, statutory worker's
compensation coverage.
The CONSULTANT also agrees to maintain, at CONSULTANT'S expense, general liability
insurance coverage insuring CONSULTANT against claims for bodily injury, death or property
damage arising out of CONSULTANT'S general business activities (including automobile use).

The liability insurance policy shall provide coverage for each occurrence in the minimum amount
Of $1,000,000.
During the period of design and construction of the project, the CONSULTANT also agrees to
maintain, at CONSULTANT'S expense, Professional Liability Insurance coverage insuring
CONSULTANT against damages for legal liability arising from an error, omission or negligent act
in the performance of professional services required by this agreement, providing that such
coverage is reasonably available at commercially affordable premiums. For purposes of this
agreement, "reasonably available" and "commercially affordable" shall mean that more than half of
the design professionals practicing in this state in CONSULTANT'S discipline are able to obtain
coverage. The professional liability insurance policy shall provide coverage for each occurrence in
the amount of $1,000,000 and annual aggregate of $1,000,000 on a claims -made basis.
Upon request of CLIENT, CONSULTANT shall provide CLIENT with certificates of insurance,
showing evidence of required coverages.
E. OPINIONS OR ESTIMATES OF CONS'T'RUCTION COST
Where provided by the CONSULTANT as part of Exhibit I or otherwise, opinions or estimates of
construction cost will generally be based upon public construction cost information. Since the
CONSULTANT has no control over the cost of labor, materials, competitive bidding process,
weather conditions and other factors affecting the cost of construction, all cost estimates are
opinions for general information of the CLIENT and the CONSULTANT does not warrant or
guarantee the accuracy of construction cost opinions or estimates. The CLIENT acknowledges that
costs for project financing should be based upon contracted construction costs with appropriate
contingencies.
F. CONSTRUCTION SERVICES
It is agreed that the CONSULTANT and its representatives shall not be responsible for the means,
methods, techniques, schedules or procedures of construction selected by the contractor or the
safety precautions or programs incident to the work of the contractor.
G. USE OF ELECTRONIC/DIGITAL DATA
Because of the potential instability of electronic/digital data and susceptibility to unauthorized
changes, copies of documents that may be relied upon by CLIENT are limited to the printed copies
(also known as hard copies) that are signed or sealed by CONSULTANT. Except for
electronic/digital data which is specifically identified as a project deliverable by this
AGREEMENT or except as otherwise explicitly provided in this AGREEMENT, all
electronic/digital data developed by the CONSULTANT as part of the PROJECT is acknowledged
to be an internal working document for the CONSULTANT'S purposes solely and any such
information provided to the CLIENT shall be on an "AS IS" basis strictly for the convenience of
the CLIENT without any warranties of any kind. As such, the CLIENT is advised and
acknowledges that use of such information may require substantial modification and independent
verification by the CLIENT (or its designees). Provision of electronic/digital data, whether
required by this Agreement or provided as a convenience to the Client, does not include any license
of software or other systems necessary to read, use or reproduce the information. It is the

responsibility of the CLIENT to verify compatibility with its system and long-term stability of
media. CLIENT shall indemnify and hold harmless CONSULTANT and its Subconsultants from
all claims, damages, losses, and expenses, including attorneys' fees arising out of or resulting from
third party use or any adaptation or distribution of electronic/digital data provided under this
AGREEMENT, unless such third party use and adaptation or distribution is explicitly authorized by
this AGREEMENT.
H. REUSE OF DOCUMENTS
Drawings and Specifications and all other documents (including elecltonic versions of any
documents) prepared or furnished by CONSULTANT pursuant to this AGREEMENT are
instruments of service in respect of the Project and CONSULTANT shall retain exclusive
ownership and property interest therein whether or not the Project is completed. The
CONSULTANT shall be deemed the author of these documents and shall retain all common law,
statutory and other reserved rights including the copyright. CLIENT may make and retain copies
for information and reference in connection with the use and occupancy of the Project by CLIENT
and others; however, such documents are not intended or represented to be suitable for reuse by
CLIENT or others on extensions of the Project or on any other project. Any reuse by CLIENT or
any other entity without written verification or adaptation by CONSULTANT for the specific
purpose intended will be at CLIENT'S sole risk and without liability or legal exposure to
CONSULTANT and CLIENT shall indemnify, defend and hold harmless CONSULTANT from all
claims, damages, losses and expenses including attorney's fees arising out of or resulting therefrom
Any such verification or adaptation will entitle CONSULTANT to further compensation at rates to
be agreed upon by CLIENT and CONSULTANT.
PERIOD Or AGREEMENT
This Agreement will remain in effect for the longer of a period of two years or such other explicitly
identified completion period, after which time the Agreement may be extended upon mutual
agreement of both parties.
PAYMENTS
If CLIENT fails to make any payment due CONSULTANT for services and expenses within thirty
days after date of the CONSULTANT'S, invoice, a service charge of one and one-half percent
(1.5%) per month or the maximum rate permitted by law, whichever is less, will be charged on any
unpaid balance. In addition after giving seven days' written notice to CLIENT, CONSULTANT
may, without waiving any claim or right against the CLIENT and without incurring liability
whatsoever to the CLIENT, suspend services and withhold project deliverables due under this
Agreement until CONSULTANT has been paid in full all amounts due for services, expenses and
charges.
K. TERMINATION
This Agreement may be terminated by either party for any reason or for convenience by either Party
upon seven (7) days written notice.

In the event of termination, the CLIENT shall be obligated to the CONSULTANT for payment of
amounts due and owing including payment for services performed or furnished to the date and time
of termination, computed in accordance with Section III of this Agreement.
L. CONTINGENT FEE
The CONSULTANT warrants that it has not employed or retained any company or person, other
than a bona fide employee working solely for the CONSULTANT to solicit or secure this Contract,
and that it has not paid or agreed to pay any company or person, other than a bona fide employee,
any fee, commission, percentage, brokerage fee, gift or any other consideration, contingent upon or
resulting from award or making of this Agreement.
M. NON-DISCRIMINATION
The provisions of any applicable law or ordinance relating to civil rights and discrimination shall be
considered part of this Agreement as if fully set forth herein.
The CONSULTANT is an Equal Opportunity Employer and it is the policy of the
CONSULTANT that all employees, persons seeking employment, subcontractors, subconsultants
and vendors are treated without regard to their race, religion, sex, color, national origin, disability,
age, sexual orientation, marital status, public assistance status or any other characteristic protected
by federal, state or local law.
N. CONTROLLING LAW
This Agreement is to be governed by the law of the Slate of Minnesota.
O. DISPUTE RESOLUTION
CLIENT and CONSULTANT agree to negotiate all disputes between them in good faith for a
period of 30 days from the date of notice of dispute prior to proceeding to formal dispute resolution
or exercising their rights under law. Any claims or disputes um-esolved after good faith
negotiations shall first be submitted to mediation utilizing the Minnesota District Court Rule 114
Roster. Disputes not resolved by mediation shall then be submitted to arbitration in accordance
with provisions of the Construction Industry Arbitration Rules of the American Arbitration
Association. CONSULTANT and the CLIENT agree to require an equivalent dispute resolution
process governing all contractors, sub -contractors, suppliers, consultants, and fabricators concerned
with this project.
SURVIVAL
All obligations, representations and provisions made in or given in Section IV of this Agreement
will survive the completion of all services of the CONSULTANT under this Agreement or the
termination of this Agreement for any reason.

Q. SEVERABILITY
Any provision or part of the Agreement held to be'void or unenforceable under any law or
regulation shall be deemed stricken, and all remaining provisions shall continue to be valid and
binding upon CLIENT and CONSULTANT, who agree that the Agreement shall be reformed to
replace such stricken provision or part thereof with a valid and enforceable provision that comes as
close as possible to expressing the intention of the stricken provision. .

SECTION V - SIGNATURES
THIS INSTRUMENT embodies the whole agreement of the patties, there being no promises, terms,
conditions or obligation referring to the subject matter other than contained herein. This Agreement may
only be amended, supplemented, modified or canceled by a duly executed written instrument signed by
both parties.

EXHIBIT I
FINAL DESIGN, CONSTRUCTION OBSERVATION, ADMINISTRATION & STAKING
2015 MAINSTREET IMPROVEMENTS
CITY OF HOPKINS, MINNESOTA
A. BASIC SERVICES
In accordance with the City of Hopkins Capital Improvements Plan, the City has designated
Mainstreet, from Shady Oak Road to 5'h Avenue N, for rehabilitation in 2015. Based on available
record drawings, the streetscape elements along Mainstreet were installed in 1991.The City has
expressed desire to rehabilitate Mainstreet to keep its downtown area in good condition and
aesthetically pleasing as construction of the SWLRT approaches.
Understanding the City was considering traffic signal and pedestrian crossing improvements to
Mainstreet per its Capital Improvements Plan, Bolton & Menk approached the City in May, 2013
with a Highway Safety Improvement Project grant opportunity. The City applied for and is
currently recommended by MnDOT to receive $690,960 in Federal Funding in MnDOT Fiscal
Year 2015 (begins July, 2014). The funding is earmarked specifically for the construction cost of
traffic signal, pedestrian ramp, and pedestrian push button improvements between 5`h Avenue N
and 13'h Avenue N on Mainstreet.
With the success of this grant application, City Staff has continued to develop and define the
scope of the project. We understand the major elements the City desires to address with this
rehabilitation are:
• Mill and overlay pavement from 5`h Avenue N to Shady Oak Road
• Upgrade the existing traffic signals between 5'h Avenue N and 13`h Avenue N, including
pedestrian push buttons, countdown timers, and signal interconnection
• Upgrade pedestrian crosswalks and ramps from 50' Avenue N to Shady Oak Road
• Remove and upsize watermain from 5"' Avenue N to I Ph Avenue N
• Rehabilitate the existing streetscape, including replacement of deteriorated elements
• Address spot drainage issues, including spot curb replacement and addition drainage
structure addition or modification
• Replacement of all street signage
Detailed tasks associated with the work are itemized in the attached Detailed Work Plan and are
described as follows:
Task I: Public Engagement & Project Development
Understanding the project's success will hinge on buy in and ownership of the local community
members, Bolton & Menk will engage the property owners along Mainstreet with a multifaceted
approach. The following process is proposed:
Inviting owners and tenants of properties along Mainstreet to an initial open house
explaining the intended scope of the project with the intent to identify specific needs or
concerns regarding the corridor.

2. Soliciting input from owners and tenants of properties along Mainstreet through the
aforementioned open house, preparing and distributing a questionnaire, and maintaining
availability to discuss specific questions or concerns with individuals throughout the
project:
3. Conducting a second public open house to provide further detail on the proposed
improvements, including a proposed phasing and traffic control plan, for the public
comment.
4. Holding a third, final public open house a month in advance of 2015 construction to
provide detail on the construction operations to be employed in the coming months.
During the project development phase, Bolton & Menk will also meet with and walk the
Mainsheet corridor with City staff to review the conditions and scope of improvements. Bolton &
Menk will also procure the services of a qualified geotechnical engineering consultant for the
project's design. Preliminary cost estimates will also be provided to the City for Capital
Improvement Plan level budgeting.
Task 2: Final Design, Preparation of Plans & Specifications
Prior to designing the proposed improvements Bolton & Menk will collect the necessary data
representing Mainstreet. Topographic survey of Mainsheet will be conducted to support the
design elements including:
• Signal pole locations and existing service cabinets between 5'4 Avenue N and Shady Oak
Road
• Curb, sidewalk, paver, building, and other structure locations at intersection corners
between 5'h Avenue N and Shady Oak Road
• Identification of the right of way location based on existing monumentation located in the
field, past survey information on file with and provided by the City, and the location of

Following collection of field data and confirmation of the intended scope, Bolton & Menk will
prepare a Project Memorandum (PM) meeting the requirements of MnDOT as the delegated
agency providing oversight to assure the project meets Federal Aid Standards. The PM will be
drafted to detail the proposed scope, purpose, need, cost, schedule, funding, and related impacts.
We understand the current project scope can be contained within the right of way and therefore
social, environmental, and economic impacts to adjacent properties.

Upon approval of the PM, Bolton & Menk will design the project and produce bidding documents
in compliance with Federal Aid and State Aid requirements as needed to maintain external
funding sources as well as the City of Hopkins' Engineering Guidelines. The design of
improvements has been broken into five categories for the purpose of this proposal: watermain
design, roadway design, stormwater design, streetscape rehabilitation design, and traffic
signal/lighting design. All designed improvements will be prepared in CAD software.
For replacement of the watermain between 5'h Avenue N and 11th Avenue N, Bolton & Menk will
review the existing data collected through topographic survey and records provided by the City.
We will coordinate with City staff to verify the desired services to be replaced and evaluate best
practices for reconstruction of these services. We understand the City desires to increase the
watermain size from the existing 8" main to a new 12" main. Bolton & Menk will produce plans
to aid in bidding and construction of the new watermain as well as reconstruction of the new
services. Consideration will also be given to the impact and duration of temporary water service
disruptions, the potential necessity for a temporary water system, and the phased construction the
project in phases. Bolton & Menk will weigh these factors to determine an acceptable solution for
the City and its residents.
Roadway improvements for the 2015 Mainstreet Improvements are primarily defined by:
• Patching of bituminous non -wear pavement within areas impacted by watermain (51h Ave
N to I1 I. Ave N), spot storm sewer construction, and spot curb replacement
• Reconstruction of pedestrian ramps to meet ADA requirements so as to maintain federal
funding
• Design and installation of decorative crosswalks from Yh Avenue N to Shady Oak Road
• Mill and overlay of Mainstreet from 51h Avenue N to Shady Oak Road
• Replacement of curb and gutter and sidewalk along the west side of 9"' Avenue N, from
Mainstreet to V Avenue N and connection of existing building downspouts to the storm
sewer
As pavement surface elevations are not proposed to change due to the intended scope of the
project, construction plans will be prepared illustrating plan views of the proposed street
rehabilitation improvements. The need for cross sections and profile views are not anticipated.
Required construction details will be included in the final plan set. Individual plan sheets for
pedestrian ramp construction will be provided consistent with Federal Aid plan standards. This
task will also involve development of phasing and traffic control plans to facilitate appropriate
access to the Mainstreet businesses during construction.
Somewhat overlapping with elements of the proposed roadway design are elements of the
streetscape rehabilitation. Streetscaping rehabilitation considerations will be provided within the
reconstruction of pedestrian ramps, but additionally considerations will be given to rehabilitation
of existing pavers, sidewalk, tree grates, and trees along the corridor. A tree assessment and
condition survey will be conducted by an arborist and its results utilized for implementation with
the project. Critical to the project's success will be proper identification of the best approach for
addressing paver deterioration that has been observed. Bolton & Menk will review the history of
the pavers utilized for the original 1991 streetscape to provide a recommendation for mass
replacement, spot replacement, or other best practices. Bolton & Menk will implement the
recommended approach in the project plans.

A design of stormwater features will be prepared to identify the necessary rehabilitations to the
existing system and solutions to reported drainage issues. We understand that reported drainage
issues relate to the flatness of Mainstreet as opposed to flooding which may indicate the
underlying storm sewer system is over capacity. To address these drainage issues, Bolton &
Menk will make'recommendations for and implement in the plan spot storm sewer improvements.
It is anticipated these improvements will be limited to spot replacement and/or rehabilitation of
catch basins in poor conditions, the addition of storm sewer to 1 or 2 blocks, and/or the spot
installation of catch basins along existing storm pipes where additional inlets are needed. A
spread analysis of the storm sewer along Mainstreet will be conducted to determine whether
additional inlets are warranted.
The project includes signal revision to seven traffic signals along Mainstreet. The signal revisions
include the addition of Accessible Pedestrian Signals (APS), LED pedestrian countdown timers, a
new controller cabinet, and the revision of the pedestrian facilities and push-button locations to
meet ADA. Signal Plans will be provided for each signal. This will include the development of a
revised signal plan for each signal, wiring diagrams, and Special Provisions. An Interconnect Plan
will also be completed. Signal plans will follow MnDOT standards. The existing signal timings
will be evaluated and a coordination plan will be developed.
A Lighting Plan will be developed for the project along Mainstreet between Shady Oak Road and
5°i Avenue North. Existing pole spacing along the corridor appears appropriate to achieve the
desired lighting. Photometric analysis of the existing luminaires will be completed, however, to
confirm existing light levels aro sufficient. New LED lighting fixtures will also be evaluated
against the existing lighting levels and AASHTO guidance to determine the appropriate type of
lighting fixtures. As pole spacing is assumed adequate at this time, lighting and traffic signal pole
replacement and/or relocation is not anticipated. Should photometric analysis indicate pole
relocation would be beneficial, this proposal can be revisited to accommodate the City's needs.
Construction plans illustrating the final design of the signal and lighting improvements will be
prepared in CAD.
In conjunction with preparation of final plans, Bolton & Menk will lead and facilitate
coordination with owners of private utilities along Mainstreet and the impacted segment of 9s`
Avenue N. Where public underground utilities are to be installed potentially in conflict with
private utilities, Bolton & Menk will conduct a Gopher State One Call to have the utilities located
for inclusion in the plan. Where surface improvements or spot utility replacement work is
proposed, however, utility information presented on the plans will be limited to that provided by
utility owners in the form of maps. Final plans will be submitted for review and comment by
private utility owners and a required coordination meeting with these entities will be held.
Construction specifications, special provisions, and cost estimates will also be prepared. One
conceptual (CIP level), one preliminary, and one final cost estimate will be provided at
appropriate decision points for the City. The preliminary and final cost estimates will indicate the
proposed cost breakdown.
Required permit applications will be identified and completed. The project will be advertised,
bids will be taken, and recommendation will be made to accept or reject bids. Meetings included
during final design include three (3) City Staff meetings. for design review, two (2) City Council
workshops, and two (2) City Council meetings for final plan presentation and award of
construction bids.

Task 3: Consh-uction Services
Construction Staking
Construction staking of the proposed watermain replacement, adjustments to curb and gutter for
necessary pedestrian ramp improvements, and proposed storm sewer will be provided. It is
anticipated that the majority of the existing concrete curb and gutter will remain, which will
provide a guide for the contractor to construct the project thereby minimizing the need for
construction staking.
Construction Observation and Administration
The Mainstreet project is proposed to be constructed during the 2015 construction season. Full
time construction observation is proposed. Duties of the Construction Observer will include
attendance at the pre -construction meeting and all construction -related meetings, service as a
liaison between the City and the contractor, review of the completed work to determine if the
project is in general conformance with the plans and specifications, review of all materials
testing, maintenance of construction documentation, and communication with affected property
owners, as necessary, to address their construction -related concerns and issues. Administration
duties include a pre -construction meeting, weekly project meetings, review of shop drawings, and
preparation of pay estimates. Observation and administration services will be completed on an
hourly basis. The project fee estimate is based upon a 12 -week construction of Mainstreet
Improvements. Estimated weekly time spent for observation and administration is 60 hrs/wk and
25 hrs/wk, respectively. Estimated weekly time spent for the traffic engineer during construction
is 4 hrs/wk.
During construction Bolton & Menk will continue to complete the Federal Aid documentation
including weekly reports, verification of EEO requirements, and wage rate reviews. Coordination
will also be done with the State Aid Office and Federal Aid liaisons to assure the project meets
the necessary funding requirements. In addition to this proposal, the City will also be required to
secure the services of a qualified geotechnical testing firm for quality assurance testing of the
proposed materials. This work will be required to remain in compliance with Federal Aid
Requirements. The costs of this work are not included in this proposal. Bolton & Menk will,
however, lead the efforts to secure a qualified testing firm for the City.
Record Drawines
Record drawings detailing the completed improvements as recorded by the construction observer
and the City of Hopkins' contractor will be completed and furnished to the City in hard copy and
electronic format.
Task 4: Contracted Services
At various points in the tasks above, services external to Bolton & Menk are proposed to be
provided to the City. These include:
1. Geotechnical Evaluation of the pavement and underlying soil.
2. Traffic data collection to facilitate design of the signal improvements.
3. A tree assessment and condition survey
B. ADDITIONAL SERVICES
Consulting services performed other than those authorized under Section I.A. shall be considered
not part of the Contract Services and may be authorized by the CLIENT as additional services.
Additional Services consist of those services which are not generally considered to be Contract
Services; or exceed the requirements of the Contract Services; or are not definable prior to the
