November 27, 2012
A regular meeting of the Hopkins Zoning and Planning Commission was held on Tuesday, November 27,
2012, at 6:30 p.m. in the Council Chambers of Hopkins City Hall.
Present were Commission members Doug Datta, Andrea Naef, Jennifer Allard, Scott Kerssen, Aaron
Kuznia, Charles Firth and Andrew Fisher.
Also present was staff inember Nancy Anderson.
CALL TO ORDER
Mr. Kuznia called the meeting to order at 6:30 p.m. in the Council Chambers.
APPROVAL OF MINUTES
Ms. Allard moved and Mr. ' rssen seconded the mot��n to approve the minutes of the October 22,
2012, regular meeting. The motion was approved unanimously.
CASE NO. CiTP12-5 DAYCARE— 12F BLAKE ROAD

Ms. Anderson reviewed the proposed day care. Rachel Sampong, representing the applicant, and
Abdulkadir Awale, the applicant, appeared before the Commission. Mr. Awale stated that they planned to
use the restaurant that he owns on the south side of the building for their food. The Commission also
asked about the fencing, number of employees, and how the children would get to the day care.
The public hearing was opened at 6:42 p.m. No one appeared at the public hearing. Mr. Kuznia moved
and Mr. Fisher seconded a motion to close the public hearing. The inotion was approved unanimously.
The public hearing was closed at 6:43 p.m.
Mr. Kerssen moved and Ms. Allard seconded a motion to adopt Resolution RZ12-20, recommending a
a conditional use permit to operate a daycare at 126 Blake Road. The motion was approved
unanimousl✓.
CASE NO. ZCR12-5 MAINSTREET SCHOOL FOR THE ARTS
Ms. Anderson stated that the applicant has requested that the item be tabled.
Mr. Aaron moved and Mr. Firth seconded a motion to table this item. The motion was approved
unaimously

VACATE UTILITY EASEMENT— GALLERY FLATS
Proposed Action
Staff recommends the following motion: Move to adopt Resolution RZ1�-l. recommendin�
a�proval of Ordinance 13-1060, approving the vacation of a utilitv easen�ent on the east side
of 31 Ninth Avenue South.
Overview
Last August the City Council approved a site plan to construct a 163-unit apartment complex
at 815 First Street South and 31 Ninth Avenue South. The property was also replatted into
one lot. When the plat was reviewed by Henn.�in County, the County noted that a utility
easement reinained. The plat was filed in December with the easement remaining. In order
for the development to proceed, the utility easement needs to be removed.

Primarv Issues to Consider.
• What is the zoning of the property, and how has the Comprehensive Plan
designated the subject site?
The zoning of the property is Mixed Use with an overlay zoning of Plaruled Unit
Developinent. The Comprehensive Plan designation is Mixed Use.
• Is the street needed for a public purpose?
The public works department reviewed the proposed vacation and detennined that there are
no utilities in the easement.
• What is the staff recommendation for the vacation?
Staff is recommending appr� al of the vacation.
• What were the responses from the utility companies regarding the vacation?
^ The utility companies were notified and none had an objection to the vacation of i�ie
easement.
Alternatives.
1. Recoirunend approval of the vacation of the easements. By recommending approval of
the vacation, the City Council will consider a recommendation of approval.
2. Recoinmend denial of the vacation of the easements. By recommending denial of the
vacation, the City Council will consider a recorrunendation of denial. If the Planning
Commission considers this alternative, findings will have to be identified that support this
alteinative.
3. Continue for further information. If the Planning Cominission indicates that fiu-ther
information is needed, the item should be continued.

RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING FOR
APPROVAL THE VACATION OF A UTILITY EASEMENT
WHEREAS, an application fot �acation VAC13-1 has been made by Klodt Development
LLC;
WHEREAS, the procedural history of the application is as follows:
1. That an application for a vacation of the alley was made by Klodt Development
LLC on January 3, 2013;
2. That the Hopkins Zoning and Planning Commission, pursuant to mailed and
published notice, held a public hearing on the application and reviewed such
application on January 29, 2013: all persons present were given an opportunity to
— be heard;
3. That the written comments and analysis of City staff were considered; and
4. Legal descriptions of the easement to be vacated is as follows:
The easterly 10 feet of Lots 22, 23 and 24, West Minneapolis
NOW, THEREFORE, BE IT RESOLVED that the application for vacation VAC13-1 is
hereby recommended for approval based on the following Findings of Fact:
1. That the above-describ easement is not needed for a public purpose.
