TRUTH IN HOUSING CODE FEES
ProDosed Action.
staff recommends the following motion: Move to approve resolution
No. 92-48 establishinq fees for the Truth in Housinq Code.
Approval of this motion will establish a fee of $30.00 per year
for a Certified Evaluator Certificate and a filing fee of $15.00
for filing of a Truth in Housing Disclosure Report.
Overview.
The City council approved Ordinance No. 92-705 in February of
1992 establishing a truth in housing code for the City of
Hopkins.
The code allows the city to certify evaluators and collect fees
to defray the associated administrative costs. The code further
requires evaluators to file a Truth in Housing Disclosure Report
4It and allows the City to charge a filing fee.
The code goes into effect on August 1st and the fees to be
charged must be set by resolution of the City Council.
The fees as proposed if adopted should generate approximately
$2,800.00 per year to defray the city's administrative costs of
the Truth in Housing Code program.

The city of Minneapolis which has a similar truth in housing
code, has set its fees at $50.00 for certification of evaluators
and $10.00 for filing the disclosure reports.
Since Hopkins has no experience administrating a program of this
type staff feels that fees based on Minneapolis, which has had
several years of experience, is a good starting point.
The fee for certification of evaluators is a cost that will be
born by the evaluators., This fee is needed to cover the costs
associated with verifying the information supplied by the
evaluators and maintaining a list. The city of Hopkins will not
be testing evaluators to determine competency like Minneapolis
but will accept a Minneapolis certification as proof of
competency. The administrative time necessary for certification
therefor will be less in Hopkins and a reduced fee of $30.00
. seems justified.
The work associated with filing the disclosure reports should be
similar to those experienced in Minneapolis so a comparable fee
is proposed. The city staff will need to review each document to
insure the hazardous items are addressed and each sale has a
corresponding report. Minneapolis is not requiring hazardous
items be corrected so we are recommending a $5.00 increase over
what Minneapolis charges.
The filing fee should not be confused with the fee the evaluator
charges the homeowner. The evaluations normally charge between
$100.00 to $125.00 to do an evaluation. The filing fee is
customarily include in his charge and-thereof directly passed on.
Alternatives.
1. Approve the staffs recommendation.
2. Disapprove the staff recommendation and establish another
more appropriate fee

HOPKINS TRUTH IN HOUSING CODE FEES
WHEREAS, The city of Hopkins has passed a Truth in Housing
code and it is scheduled to go into effect August 1st 1992,and,
WHEREAS, The Truth in Housing Code will have associated
costs to the City for its implementation and enforcement, and,
WHEREAS, The city code provides for certain fees to be
established by resolution from time to time to offset the
associated costs incurred by the city, and, ,
WHEREAS, The city staff has determined surrounding
communities have establ~shed similar fees,
NOW THEREFORE BE IT RESOLVED, that the City council of the
City of Hopkins hereby sets the truth in housing code fees as
follows:
Certified Evaluator certificates
and renewals $30.00/year'
. Truth in Housing Disclosure
Report Filing Fee $15.00/report
BE IT FURTHER RESOLVED, that the effective date of these fees be
upon the date of adoption,
Adopted by the City Council of the city of Hopkins this 16th day
of June, 1992.
