AUTHORIZE HEARING FOR CONDEMNATION PROCEEDINGS

proposed Aotion.
Staff recommends the following motion: Move that Council set a
hearinq date of Julv 7 to consider a resolution for condemnation
concerninq properties on Mainstreet between 9th and 10th Avenues
South. commonlY known as the Mashek. Martin and Senn properties.
overview
In 1988 the first alley underground electrical project was undertaken.
This involved the installation of trunk electrical conduit and cable
underground along the north edge of the alley south of Mainstreet
between 11th and 9th Avenues and the installation of undergrotind
services to the individual properties. It was 'necessary for the City
to obtain utility easements from owners of abutting property and
indeed most easements have been granted and all at no cost to the
City. The owners of three properties between 9th and 10th Avenues
have either refused to answer the City Attorney's letters and calls
. where this issue is discussed or have responded with a request for
compensation. In the meantime- the conduit has been installed on the
affected properties without the benefit of an easement document.

0 What is the purpose of a hearing?
The hearing will afford the property owners a forum for their
grievances should they have any. Council can act on the merits
of the grievances in any fashion, even to the extent that it can
approve a resolution authorizing condemnation proceedings to
begin.
0 Who will receive notification of this hearing?
The fee owners and tenants of the affected properties will
receive due notice from staff concerning the impending hearing.
In fact all parties involved have been notified of this staff
request for a hearing.
