2014-054 Approving a CUP for a Drive-Through Restaurant at 1728 MainstreetFoods; CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2014-054 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A CONDITIONAL USE PERMIT FOR A DRIVE-THROUGH RESTAURANT AT 1728 MAINSTREET WHEREAS, an application for Conditional Use Permit CUP14-2 has been made by Hoogland WHEREAS, the procedural history of the application is as follows: That an application for a conditional use permit was made by Hoogland Foods on September 2, 2014. 2. That the Hopkins Zoning and Planning Commission published notice, held a public hearing on the application and reviewed such application on September 30, 2014: all persons present were given an opportunity to be heard. 3. That the written comments and analysis of City staff were considered. 4. Legal description of the parcel is as follows: Lots 1 and 2, Block 2 Boulevard Manor Addition NOW, THEREFORE, BE IT RESOLVED that the application for Conditional Use Permit CUP 14-2 is hereby approved based on the following Findings of Fact: 1. That the Planning Commission reviewed the conditional use permit; 2. That the proposed drives -through meets the requirements for a conditional use permit. BE IT FURTHER RESOLVED that application for Conditional Use Permit CUP 14-2 is hereby approved subject to the following conditions: 1. That the site plan is approved for the remodeling of the former Kentucky Fried Chicken building at 1728 Mainstreet. Adopted by the City Council of the City of Hopkins this 7"' day of October 2014.
