07-01-1980 A regular meeting of the Council of the City of Hopkins, Minnesota, was held on Tuesday, July 1, 1980 , at 7 : 30 p.m. , in the Council Chambers in the City Hall. 110 Present were Mayor Miller, Councilmembers Lohmann, Milbert, Slaton and Arimond, also City Manager Craig, City Clerk Richardson, City Engineer Strojan, Operations Director Beecher, Building Inspector Kohnen, and City Attorney Vesely. Reel 160 Before opening the regular meeting, Mayor Miller presented to Side 1 John Scott Renne, Hopkins Deputy Assessor, a Certificate of 8-13 Designation (Residential Evaluation Specialist) from the Inter- national Association of Assessing Officers, retroactive to May 1, 1980. Action: Mr. Milbert moved, and Dr. Slaton seconded the motion, that the 13-17 items under the CONSENT CALENDAR, be approved: 1. Minutes of the June 17 , 1980, Council meeting. 2. Licenses (none) 3. Request by Northern States Power Co. , for permit to relocate pole in alley between 13th and 14th Ave. , north of 7th Street South. • 4. Request by Northwestern Bell Telephone Co. , for permit to place buried cable on 3rd Street North between 12th Avenue and alley. A poll of the vote was as follows: Mr. Lohmann, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mrs. Arimond, yea; and Mayor Miller, yea. Motion carried unanimously. Action: Mrs. Arimond moved, and Mr. Milbert seconded the motion, that the 17-54 expenditures dated July 1, 1980, Warrant No. 596, in the amount of $232, 378 . 12, be approved and authorized for payment. A poll of the vote was as follows: Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion carried un- animously. Bid: Pursuant to notice bids were opened on June 24 , 1980, at 10: 00 a.m. , for Seal Coat for 1980, and the following bids were received: (see tabulation attached) Action: Mr. Milbert moved, and Dr. Slaton seconded the motion, that the 54-59 contract for furnishing Seal Coat for 1980, be awarded to Blacktop . Service Co. , in the amount of $50, 510. 00, as recommended by staff. A poll of the vote was as follows: Mr. Lohmann, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mrs. Arimond, yea; and Mayor Miller, yea. Motion carried unanimously. Hearing: Item: 79-128-P. Dr. Slaton moved, and Mrs. Arimond seconded the motion, that 59-223 the hearing to consider the making of an improvement between Excelsior Avenue and Minnetonka Mills Road on the following streets: 5th Avenue North; 6th Avenue North; 7th Avenue North; and 8th Avenue North by the installation of street lights thereon, be tabled until petitions are presented requesting this improvement. A poll of the vote was as follows : Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 79-51-0. Dr. Slaton moved, and Mr. Lohmann seconded the motion, that 223- Ordinance No. 80-473, "AN ORDINANCE RELATING TO BURGLARY, ROBBERY, AND FIRE ALARM SYSTEMS; REQUIRING ALARM USERS TO OBTAIN PERMITS; PROVIDING FOR ISSUANCE OF PERMITS AND REVOCA- TION THEREOF; PROHIBITING CERTAIN INTERCONNECTIONS AND AUTO- MATIC DIALING PRACTICES; AND ALLOCATING EXPENSES FOR FALSE ALARMS" , be amended as follows: Under Section 4, C-3 , delete the words "single family" ; and under Section 5, B. ,delete the word "hereinafter" and add "herein" . A poll of the vOte was as follows: Mr. Lohmann, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mrs. Arimond, yea; and Mayor Miller, yea. Motion carried unanimously. Dr. Slaton moved, and Mrs. Arimond seconded the -407 motion, to accept for the first reading as amended, Ordinance No. 80-473 . A poll of the vote was as follows : Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 80-90-Z. Dr. Slaton moved, and Mr. Lohmann seconded the motion, that 407- the application by Dominium Group, Inc. , for a Planned Unit Development to construct a 40 unit townhouse project on Lots 10 thru 16, Block 1, Stevens Oakwood Park, which was not recommended for approval by the Zoning & Planning Commission, be continued to the July 15, 1980, Council meeting at the request of the applicant. A poll of the vote was as follows : Mr. Lohmann, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mrs. Arimond, yea; and Mayor Milbert, yea. Motion carried un- animously. Item: 80-91-Z. Dr. Slaton moved, and Mr. Milbert seconded the motion, that -468 the application by the City of Hopkins for variances on the property at 22 - 7th Avenue North of four feet on the north side of the lot and variance for lot area of less than 5000 sq. ft. , due to the uniqueness of the property, be approved, • as recommended by Zoning & Planning. A poll of the vote was as follows: Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 80-92-Z . Dr. Slaton moved, and Mr. Lohmann seconded the motion, that 468- the recommendation from Zoning & Planning that application by Super Valu, Inc. , be denied for a change of zoning from R-1-A Residential to I-2 Industrial for the property formerly known as 20 thru 142 Monroe Ave . So. , be continued to the July 15, 1980, Council meeting at the request of the appli- cant. A poll of the vote was as follows: Mr. Lohmann, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mrs. Arimond, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 80-93-L. Mr. Lohmann moved, and Mrs. Arimond seconded the motion, that -480 the request by St. Joseph' s Church for a non-intoxicating malt liquor license for one day, September 1, 1980, for their Fall Festival, be approved. Mr. Lohmann moved, and Dr. Slaton seconded the motion, that 480-493 Resolution No. 80-2865, "RESOLUTION ENCOURAGING HENNEPIN COUNTY TO COMPLETE CROSSTOWN HIGHWAY NO. 62" , be adopted. (A copy of said resolution be sent to the Hennepin County Commissioners and to Mr. Higuchi, Minnetonka City Councilman) . A poll of the vote was as follows: Mr. Lohmann, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mrs. Arimond, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 80-95-A. Dr. Slaton moved, and Mr. Lohmann seconded the motion, that 493-566 the Agreement, as presented, with Town Taxi for Hop-A-Ride services for 1980, be approved and the Mayor and City Manager be authorized to sign same. A poll of the vote was as follows: Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion carried un- animously. Item: 80-96-E. Mr. Milbert moved, and Dr. Slaton seconded the motion, that lip 566-588 the driveway easement with Steiner & Koppelman over the northerly portion of Lot 1, Block 2, South Hopkins Industrial Park, be granted. Mr. Lohmann moved, and Mr. Milbert seconded the motion,that ill 588- Ordinance No. 80-474, "ORDINANCE AMENDING SECTION 1030 OF THE 1977 HOPKINS CODE OF ORDINANCES PERTAINING TO GARBAGE, RUBBISH, SANITATION, LITTER AND STORAGE REGULATIONS" , be amended as follows: that the Single Family, Multi-Family and Trailer Court rates be figured to round to the next 10G higher, but the Commercial rates stay as proposed. A poll of the vote was as follows: Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion carried unanimously. Action: Mr. Lohmann moved, and Mr. Milbert seconded the motion, to accept -731 for the first reading as amended, Ordinance No. 8-474. Dr. Slaton moved, and Mrs. Arimond seconded the motion, that 731-738 the Mayor' s appointments and reappointments to the various Boards and Commissions, be continued to the July 15, 1980, Council meeting, per Mayor' s request. A poll of the vote was as follows: Mrs. Arimond, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Motion IIIcarried unanimously. - Discussion Items: Councilman Milbert brought up for discussion the follow- ing items: 738-779 Donation of Flag Pole for the Downtown Park. Should it be referred back to Recreation & Park Board, or be on the next Council Agenda on July 15th? It was decided to refer this back to Parks & Recreation. 779-797 Replacement of shrubs in the Downtown Park and removal of trees at the Warrington site. City Manager to start litiga- tion on damaged shrubs. 797- Drug Paraphernalia Ordinance - City of Burnsville. This was referred to the City Attorney for recommendation and possible draft. -808 Bloomington' s Ordinance on Laudromats. Hopkins needs such and ordinance. This was referred to the City Attorney for recommendation and possible draft. This would cover both • laundromats and laundry facilities in multiple buildings. 808- 50 foot mobile homes being parked on walkways between the curb and lot lines. Would like to have our ordinance on this enforced and have these removed because of visability and safety. Also it be referred to the City Attorney for some sort of recommendation and a possible draft of permanent parking of vehicles on city property which is other than street.
