RESOLUTION AUTHORIZING ACQUISITION BY THE
CITY OF HOPKINS OF CERTAIN LAND FORFEITED
TO THE STATE OF MINNESOTA FOR NONPAYMENT
OF REAL ESTATE TAXES IN PRIOR YEARS PURSUANT
TO M.S .A. CHAPTER 282 .
IT IS HEREBY RESOLVED by the City Council of the City of
Hopkins that the said City of Hopkins immediately acquire from the
State of Minnesota, pursuant to M.S.A. Chapter 282 , the following parcel
of land situated in Hopkins , Hennepin County, Minnesota, viz :
Lot 21, Block 77, West Minneapolis
Second Division (Plat 37690, Parcel 2960)
to be used by the City for public purposes .
• Passed and adopted by the Council of the City of Hopkins, Minnesota,
at a regular meeting held the 5th day of September, 1978.

Dear Mr. Craig:
Enclosed please find letters dated July 26 , 1978 and
February 26 , 1977 from the Bellgrove Community to the Metro-
politan Council opposing the establishment of a regional
trail through the Bellgrove Community for the reasons as
stated in the letters.
I thank you for sending the notice of the July 27 , 1978
410 public hearing on the proposed Regional Trails Policy Plan
to our attention. At this time, the Bellgrove Community would
like to request that you bring the fact of Bellgrove ' s opposi-
tion to the Regional Trails Policy Plan as stated in these
enclosed letters to the attention of the Hopkins City Council
requesting their support of the Bellgrove Community in their
opposition to the Regional Trails Policy Plan as stated.
It would be most appreciated if this could be heard at
the next meeting of the Council. The Bellgrove Community
would be pleased to send representatives to this meeting.

Community.

Dear Mr. Boland:
Regarding the public hearing scheduled for July 27 , 1978 ,
on the Regional Trails Policy Plan, attached is a letter dated
February 26, 1977 , setting forth the opposition of the Beligrove
Community to certain portions of that plan. It would be appre-
ciated if that letter together with the comments made herein,
could be recorded into the record for these public hearings.
IIPAs stated in the attached letters, the Beligrove Community
is not opposed to allowing canoeing and cross-country skiing in
the creek bed, but adamently opposes the usage of abutting
property for a regional trail. The land on each side of Minne-
haha Creek in the Beligrove Community is owned by the respective
Bellgrove residents. Thus, any trail would either have to be
built on this private land or on adjacent land. In the latter
case, it is forseeable that people using the trail would trespass
onto the private land of the Beligrove residents to obtain the
use of the Creek.
Part of the Quid Pro Quo for the Beligrove residents
buying these lots was the fact of having the private enjoyment
of Minnehaha Creek in their backyards by owning the land on both
sides of the Creek. This should be continued as it is.
Considering the fact that the Beligrove residents do not
object to canoeing and cross-country skiing in the creek bed,
the Bellgrove Community requests that the regional trail be
either restricted to these purposes in the Beligrove area, or
be rerouted to bypass the Bellgrove Community.

Dear Mr. Boland:
Regarding the Public Hearing on Thursday, March 3, Z977, on the
Regional Trail Policy Plan, the BeZZgrove Association is submitting
this letter for official recording at this hearing. The BeZZgrove
Association is a neighborhood of 89 home owners located in the
• "BeZZgrove Area" of Hopkins. This letter states our opposition to
the proposed Regional Trail Plans for that section of Minnehaha Creek
which flows through the properties owned by BeZZgrove homeowners. The
Regional Trail Plan has idientified this section of Minnehaha Creek
as a trail corridor for cross-country skiing, canoeing, biking and
\�'. hiking.
WHAT WE ARE OPPOSED TO:
Development of both a bicycle path and hiking trail
along that section of Minnehaha Creek which flows
through properties owned by Bellgrove residents.
WHAT WE ARE NOT OPPOSED TO:
Since we realize that Minnehaha Creek offers the
public excellent recreational activities, we are
not opposed to canoeing in high water months, and
cross-country skiing in the creek bed during winter
months. However, we would be opposed to signs placed
along the creek in the Bell-grove area designating the
•
canoeing and cross country routes within the creek.
We think signs are not pleasant to Zook at, and would
not fit into the natural environment of Minnehaha
Creek in BeZZgrove.
ALTERNATIVE RECOMMENDATION:
What we suggest as an alternative for proposed hiking
and biking trails, is to identify routes which would
-.rA by-pass the BeZZgrove residential area. That section

Ai
ly of Minnehaha Creek which flows through the Bellgrove
area is a short distance in the overall Regional Trail
Network. Moreover, a section of Zand East of the
Bellgrove area through which Minnehaha Creek meanders,
is low swampland which is not readily suitable to
economic development of both biking and hiking trails.
OPPOSITION REASONS:
(1) The establishment of the proposed hiking and biking
trails would deprive Bellgrove residents of our
riparian rights such that we could no longer effectively
control litterbugs, public nuisance offenders, and
public damage to the environment along Minnehaah Creek
in Bellgrove.
(2) Hiking and biking trails will have a detrimental
effect on the investments we have in our homes and
properties: presently we pay a property tax that is
higher than the "average base" within the Metropolitan
area.
IIP (3) Hiking and biking trails will infringe on our present
privacy which we value highly.
(4) Hiking and biking trails will offer Bellgrove residents
t'/ greater exposure to burglars, vandalism and othe nuisances.
(5) Danger to little children wiZZ be increased by the
establishment of biking trails.
(6) Development of hiking and biking trails along the
creek will destroy natural habitat for ducks, raccoons,
muskrats, song birds, rare wild flowers and other forms
of wildlife which presently inhabit the area.
(7) Hiking and biking trails will increase public traffic
through Bellgrove, disturbing the serenity and beauty
of the heavily wooded properties owned by Bellgrove residents.
Finally, the Bellgrove residents will not grant any easements or sell
any land parcels for the development of ;liking and biking Trails.
411 We hope the Metropolitan Council appreciates our opposition to the
proposed hiking and biking trails, and looks favorably on selecting
an alternate route which would by-pass t"ze Bellgrove area. We also
wish to extend an invitation to all Metropolitan Council Members to
come and visit our Bellgrove area. We think that such a "viewing"
would be most beneficial for your Regional Trail Program.

Re: Petition for Alley Paving on N-S alley
in Block 1, West Minneapolis
On October 3, 1978, the Council received a petition from three property owners
on 5th Avenue South to pave the N-S alley in their block. The Council ordered
an Engineer's report on this request.
The report recommends the consideration of the upgrading by concrete paving of
the N-S alley and also the two east-west alleys in the block. The N-S alley is
unsurfaced and requires frequent grading. We have had complaints on the existance
of chuckholes and dust. The E-W alleys have had a bituminous surfacing but it is
in need of repair.
41/ The City Council in 1975 initiated action on a similar proposal to pave the alleys
in Block 1. Hearings were held and the project was dropped as there was a question
raised as to the possibility of that block being included in some type of urban
renewal project which would change the alley grades, etc. It does not appear at
this time that there will be any major development in the block that would result
in a change in the grades. Therefore it is possible to reconsider the proposal at
this time.
The following is an estimate of cost to the benefitted properties in the Block
based upon the City policy in regard to alley assessments.
Cost/Front Foot Cost/50' Lot
1. Lots fronting on Fifth Avenue $ 13.00 $ 650.00
2. Lots fronting on Sixth Avenue 13.00 650.00
3. Lots fronting on Second Street 9.81 490.50
The action required if the Council wishes to proceed with further consideration of
this project would be to adopt a Resolution Ordering a Public Hearing.
The cost to the City owned Dow Towers would be approximately $3,900.00.
