4-19-1977 CC A regular meeting of the Council of the City of Hopkins, Minnesota, was held on Tuesday, April 19, 1977, at 7:30 p.m. , in the Council Chambers in the City Hall. Present were Mayor Miller, Councilmen McDonald, Milbert, Pokorny and Slaton, also City Manager Craig, City Engineer Strojan, Asst. Engineer Anderson, Building Inspector Kohnen, Operations Director Beecher, City Clerk Richardson and City Attorney Vesely. Reel 212 Mr. Milbert moved, and Mr. McDonald seconded the motion, that the five (5) Side 1 items under the CONSENT CALENDAR, be approved. 923- 1. Minutes of the April 5, 1977, Council meeting. 2. Additional 1977, license applications: B & C HEATING CO. , install gas burners; CITYWIDE PLUMBING & HEATING CORP. , install gas burners. 3. Request from Northern States Power Co. , for permit to extend underground lines and provide 150 KVA capacity to serve new Medical Clinic - 815 First St. So. 4. Request from Northern States Power Co. , for permit to place underground cable on First St. So. , and at Hopkins City Hall. 5. Request by Northwestern Bell Telephone Co. , for permit to install buried cable on 3rd Street No. , between 5th Avenue North & 7th Avenue No. , for growth. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Hilbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously. * * * * * * * * * Action: Mr. Pokorny moved, and Mr. Milbert seconded the motion, that expenditures dated -1013 April 19, 1977, under Warrant No. 502, in the amount of $140,652.77, be approved and authorized for payment. A poll of the vote was as follows: Mr. Pokorny, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. McDonald, yea; and Mayor Miller, yea. Motion carried unanimously. NEW BUSINESS: Item: 77-52-F. Dr. Slaton moved, and Mr. Milbert seconded the motion, that 1013-1065 Council so state that - BE IT RESOLVED THAT THE REQUEST FROM THE FIRE MARSHAL FOR DESIGNATED FIRE LANES AT BLAKE SCHOOL, AS OUT- LINED ON ATTACHED MAP, BE APPROVED. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously Item: 77-55-R. Mr. Pokorny moved,and Mr. Milbert seconded the motion, that the request by 1065-1119 Blunt & Carlson Carpeting for a permit to connect to Hopkins sewer and water from a site on the north side of Division Street, west of Color Tile • Store in St. Louis Park, be granted. A poll of the vote was as follows: Mr. Pokorny, yea; Dr. Slaton, yea; Mr. Hilbert, yea; Mr. McDonald, yea; and Mayor Miller, yea. Motion carried unanimously. (Subject to payment of fees) Item: 77-50-P. Mr. Pokorny moved, and Mr. McDonald seconded the motion, that the request 1119-1304 from Five Associates, Inc. , for Council approval of the division of plat to create three equal-sized double residential lots of 68' adjacent to and across the street from other double residences, known as SOUTH MEADOWS, be referred back to Zoning and Planning and the City Manager convey to the Zoning & Planning Commission the Councils feelings re this matter. A poll of the vote was as follows: Mr. McDonald yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously. BIDS: Pursuant to Notice, bids were opened on March 29, 1977, at 10:00 a.m. for One (1) 17 Cubic Yard Garbage Packer Body & Truck Cab & Chassis, and continued from the 4-5-77, Council meeting. (see tabulation attached) Action: Mr. Milbert moved, and Mr. Pokorny seconded the motion, that the Contract for 1304-1359 furnishing the City with One (1) 17 Cubic Yard Garbage Packer Body and Truck Cab & Chassis, be awarded to Midway Ford in the amount of $23,075.00, as recommended by staff. BIDS: Pursuant to Notice, bids were opened on March 31, 1977, for Painting of the Steel Surface Elevated Water Reservoirs, and continued from the 4-5-77, Council meeting. (see tabulation attached) • Action: Mr. Pokorny moved, and Mr. McDonald seconded the motion, that the Contract for 1359-1469 Painting of the Steel Surface Elevated Water Reservoirs, be awarded to the low bidder, Allied Painting, in the amount of $72,779.00, as recommended by staff. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously. BIDS: Pursuant to Notice, bids were opened on March 31, 1977, at 11:00 a.m. , and continued from the 4-5-77, Council meeting, for Dual Glazing of the Hopkins City Hall. (see tabulation attached) . Action: Dr. Slaton moved, and Mr. Pokorny seconded the motion, that the Contract for 1469- to Dual Glazing of Hopkins City Hall be awarded the firm of De Vac, Inc., in the end of amount of $9789.00 as recommended by staff. A poll of the vote was as follows: tape. Mr. Pokorny, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. McDonald, yea; and Mayor Miller, yea. Motion carried unanimously. BIDS: Pursuant to Notice, bids were scheduled for opening on April 12th at 2:00p.m. then rescheduled for April 26th, 1977, for Labor and Materials to relocate a Commercial Building (Dahlberg Liquor - 10th Ave. No.) . • Action: Mr. Pokorny moved, and Dr. Slaton seconded the motion, that the item be continued Side 2 to the May 3, 1977, Council meeting. (see tabulation attached) Action: Dr. Slaton moved, and Mr. Pokorny seconded the motion, that the Contract for furnish- -39 ing of Labor and Materials to Construct a Tennis Lighting System for eight (8) Tennis Courts at Central Park, be awarded to the low bidder, Hilite Electric Co. , in the amount of $21,120.00, as recommended by our Consultant, W. J. Sutherland & Associates, Inc. , contingent upon HUD approval. A poll of the vote was as follows: Mr. Pokorny, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. Mc Donald, yea; and Mayor Miller, yea. Motion carried unanimously. BIDS: Pursuant to Notice, bids were opened on April 12, 1977, at 2:00 p.m. , for Labor and Materials to Construct a Battery of eight (8) Tennis Courts at Central Park. (see tabulation attached) . • Action: Mr. Pokorny moved, and Dr. Slaton seconded the motion, that the Contract for Labor 39-54 and Materials to Construct a Battery of eight (8) Tennis Courts at Central Park, be awarded to Carlson-LaVine, Inc. in the amount of $46,800.00, as recommended by staff, and contingent upon HUD approval. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller yea. Motion carried unanimously. BIDS: Pursuant to Notice, bids were opened on April 14, 1977, at 10:00 a.m., for the Removal of Trees for 1977. (see tabulation attached) Action: Mr. Milbert moved, and Mr. Pokorny seconded the motion, that this item be continued 54-59 to the May 3, 1977, Council meeting. Mr. Milbert, moved, and Mr. Pokorny seconded the motion, that 59-96 Ordinance No. 77-429, "ORDINANCE ESTABLISHING AN INDUSTRIAL USER STRENGTH CHARGE IN ADDITION TO THE CHARGE BASED UPON THE VOLUME OF DISCHARGE BY AN INDUSTRIAL USER AND ESTABLISHING AN INDUSTRIAL USER STRENGTH CHARGE FORMULA FOR THE COMPUTATION THEREOF TO RECOVER • OPERATION AND MAINTENANCE COSTS OF TREATMENT SERVICES ATTRIBUTABLE TO THE STRENGTH OF THE DISCHARGE OF INDUSTRIAL WASTE INTO THE SEWER SYSTEM AND ESTABLISHING TAX LIEN AGAINST PROPERTY SERVED IN CONNECTION WITH SUCH STRENGTH CHARGE", be accepted for the second Minutes of the April 19, 1977, Council meeting, cont. Mr. McDonald moved, and Mr. Pokorny seconded the motion, that the 96-106 request from Community Development for Council approval of the Housing Assistance Plan, (see attached), be granted. Dr. Slaton moved, and Mr. Milbert seconded the motion, that Resolution No. 106-119 77-2573, "RESOLUTION ORDERING ENGINEER'S REPORT ON PETITION FROM POWELL CANDY FOR AN IMPROVEMENT OF AN ASPHALT CURB FROM EXISTING CURB ON THE WEST SIDE OF POWELL ROAD BEGINNING APPROXIMATELY 600 FEET NORTH OF EXCELSIOR BOULEVARD", be adopted. Mr. Milbert moved, and Mr. Pokorny seconded the motion, that upon the • 119-128 request of St. John the Evangilist Church, the north side of Boyce Road from Oakwood Road to a point 125 feet west be posted for School Buses Only - 8 a.m. to 4 p.m. - Monday thru Friday, as recommended by staff. Mr. Milbert moved, and Mr. Pokorny seconded the motion, that the 1976-1977 128-136 Contract - Minnesota Teamsters Public Law Enforcement Employees' Union, Local No. 320, (Dispatchers and Community Service Officer) , be approved and the Mayor and Manager to sign same. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Pokorny, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 77-57-R. Mr. Milbert moved, and Mr. Pokorny seconded the motion, that the request by 136-155 Gerald C. Wille, 300 21st Ave. No., for removal of the 33 foot roadway easement from the plat of his property, (see letter attached) , be referred to the Zoning & Planning Commission for their recommendation.
