11-15-1977 A regular meeting of the Council of the City of Hopkins, Minnesota, was held on Tuesday, November 15, 1977, at 7:30 p.m., in the Council Chambers in the City Hall. Present were Mayor Miller, Councilmen McDonald, Milbert, Slaton and Luhmann, also City Manager Craig, City Clerk Richardson, City Engineer Strojan, Asst. Engineer Anderson, Operations Director Beecher, Building Inspector Kohnen and City Attorney Vesely. Reel 128 Dr Slaton moved, and Mr. Milbert seconded the motion, that the one item Side 1 under the CONSENT CALENDAR, be approved: 1-4 1. Minutes of the November 1, 1977, Council meeting. A poll of the vote was as follows: Mr. Milbert, yea; Dr. Slaton, yea; Mr. Luhmann, yea; and Mayor Miller, yea. Notion carried unanimously. * * * * * * * Action: Mr. Hilbert moved, and Dr. Slaton seconded the motion, that the expenditures 4-29 dated November 15, 1977, under Warrant No. 520,in the amount of $102,379.72, and Warrant No. 521, in the amount of $136,555.88, be approved and authorized for payment. A poll of the vote was as follows: Mr. Luhmann, yea; Dr. Slaton, yea; Mr. Milbrt, yea; and Mayor Miller, yea. Motion carried unanimously. Note: At this time in the meeting (7:40 p.m.,) Councilman McDonald took his place at • the Council Table. Item: 77-149-0. Mr. Milbert moved, and Dr. Slaton seconded the motion, that Ordinance 29-34 No. 77-436, "AN ORDINANCE RELATING TO THE PREPARATION AND REVIEW OF ENVIRONMENTAL ASSESSMENT WORKSHEETS, ENVIRONMENTAL IMPACT STATEMENTS AND OTHER ENVIRONMENTAL DOCUMENTS", be continued to the December 13, 1977, Council meeting for the first reading. A poll of the vote was as follows: Mir. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Luhmann, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 77-150-0. Mr. Milbert moved, and Mr. Luhmann seconded the notion, that Ordinance 34-41 No. 77-437, "ORDINANCE AMENDING THAT PART OF CHAPTER 7, SECTION 700:169.34, OF THE 1977 HOPKINS CODE OF ORDINANCES PERTAINING TO SNOW REMOVAL PARKING REGULATIONS AND RESTRICTIONS", be accepted for the second reading thereof and according to law same to be ordered pub- lished. A poll of the vote was as follows: Mr. Lohmann, yea; Dr. Slaton, yea; Mr. Milbert, yea; Mr. McDonald, yea; and Mayor Miller, yea. Notion carried unanimously. Item: 77-152-R. Mr. McDonald moved, and Mr. Luhmann seconded the motion, that 41-84 Resolution No. 77-2641, ".RESOLUTION OBJECTING TO CONSIDERATION OF WASTE- 411 STE- WATER RESTRICTIONS AND LIMITATIONS TO THE METROPOLITAN WAST WATER TREATMENT PLANT AT PIG'S EYE LAKE IN THE MA'1TER OF NPDES AND STATE PERMIT HEARING DOCKET NO. PCA-78-006-EG", be adopted. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Luhmann, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 77-153-L. Mr. Luhmann moved, and Dr. Slaton seconded the motion, that the request 84-119 for transfer of license (On Sale Intoxicating Liquor, Restaurant, Sunday Liquor, Motel, Soft Drinks, Cigarettes, Milk, Dance Hall) from LODGINGS INC., dba HOPKINS HOUSE, to Harold R. and Carolyn J. Adolphsen, be approved. A poll of the vote was as follows: Mr. Luhmann, yea; Dr. Slaton, yea; Mr. Milbert, yea;. Mr. McDonald, yea; and Mayor Miller, yea. Notion carried unanimously. Item: 77-154-L. Mr. McDonald moved, and Mr. Milbert seconded the motion, that the 119-123 request for transfer of license (On Sale Non Intoxicating Malt Liquor, Off Sale Non Intoxicating Malt Liquor, Cigarettes) dba BLOCKHOUSE, to Ronny E. and Elliot M. Ruben, be stricken from the Agenda per request by the applicant. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Lohmann, yea; and Mayor Miller, yea. Mr. McDonald moved, and Dr. Slaton seconded the motion, that Ordinance 123-145 No. 77-438, "AN ORDINANCE CONTINUING POLICE CIVIL SERVICE COMMISSION AND DESCRIBING POWERS AND DUTIES THEREOF", be accepted for the first reading. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Luhmann, yea; and Mayor Miller, yea. Notion carried unanimously. Item: 77-156-L. Mr. Lohmann moved, and Mr. Milbert seconded the motion, that the list 145-237 of 1978 Liquor License Applications, as attached, be approved. A poll of the vote was as follows: Mr. McDonald, yea; Mr. Milbert, yea; Dr. Slaton, yea; Mr. Luhmann, yea; and Mayor Miller, yea. Notion carried unanimously. Item: 77-157-C. Mr. Hilbert moved, and Mr. Lohmann seconded the motion, that the request 237-280 for Council approval of cancellation of Condemnation Proceedings of taking and acquisition by the City of Hopkins, Hennepin County, Minnesota, of the south one-half of the southeast quarter of the south- east quarter of Section 25, Township 117, Range 22, and the approval of payment of appraisal fees and fees of the three Commissioners, as shown on attached, be granted. A poll of the vote was as follows: Mr. Lohmann, yea; Dr. Slaton, yea; Mr. Mi]bert, yea; Mt. McDonald, yea; and Mayor 410 Miller, yea. Motion carried unanimously. Item: 77-158-R. Mr. McDonald moved, and Dr. Slaton seconded the motion, that the request 280-360 for Council approval of appropriating $1700 from the Contingency Fund for HECO dues, be granted. (see attached) A poll of the vote was as follows: Mr. McDonald, yea; Mr. Hilbert, yea; Dr. Slaton, yea; Mr. Luhmann, yea; and Mayor Miller, yea. Motion carried unanimously. Item: 77-159-A. Request for Council action and direction of expenditures proposed by 361-877 the Community Development Citizens Advisory Commission. After lengthy discussion no formal action was taken by Council. Action: Mr. McDonald moved, and Mr. Milbert seconded the motion, that the meeting be adjourned.
