Re: Streets & Utilities in the S.W. Corner of Hopkins
On February 9th I met with the Engineering Department in Minnetonka
regarding streets and utilities serving the Southwestern area of Hopkins
and adjacent land in Minnetonka. The City of Minnetonka has passed a
Resolution stating the need for improvements in the area and ordering an
Engineer's Report. They are in the process of preparing this report and
have asked if Hopkins is interested in a joint project.
Their proposal would be for a road along the south boundary of Hopkins,
connecting with Smentana Road at 11th Avenue. I would then join Shady Oak
Road at Dominick Drive. A second road would start at the southwest corner
of Hopkins and would go north along the west boundary and thence northeasterly
across the City Landfill, connecting with 7th Street South around 13th or 14th
• Avenue South. (See attached map) .
Minnetonka has a sanitary sewer trunk line that crosses through the very
southwest corner of Hopkins. This sewer has some capacity for Hopkins ' use.
Minnetonka will be preparing a watermain into the area from Shady Oak Road.
This also could serve this area of Hopkins on a reciprical agreement basis.
Storm sewer and storm water rentention is also a consideration at this time.
Minnetonka will be calling the official owners in for an informational
meeting within the next 10 days. They plan to have the Engineer's Report in to
the Council in time to hold a public hearing on March 20, 1978.
The action needed at this time would be a Council Resolution requesting
an Engineer's Report to start the legal procedures necessary to assess benefits.

Request: Approval of Conditional Use Permit for a P.U.D. for 8 - 4 plexs
STAFF COMMENTS
1. The property is zoned "R-2" residential, abutts Nine Mile Creek and
contains approximately 156,800 sq. ft. The "R-2" zone permits 2-4 family
homes with a density of 3500 sq. ft. or in this request 40 x 3500 or
140,000 sq. ft. Thus, the density conforms with the ordinance.
2. The required front yard is 35 feet while all of the building as shown on
the plan are 25 feet which in turn would require a variance or an additional
10 feet of yard. The applicant did not provide a statement as to the hard-
ship justifying a variance. Soil tests have been taken but a copy of the
results indicating the effect on each building was not submitted.
3. 427.50(1) (d) establishes the distance between buildings when more than one
building is on a parcel and it states that said distance shall be 12 the sum
411 of the heights. The buildings are approximately 24 feet in height and the
distance between buildings is 30 feet which conforms.
4. The minimum square footage for a 2 bedroom unit is 720 square feet and the
proposed units are 768 square feet.
5. A large portion of the parcel is within the designated flood plain - five
of the eight buildings. Hopkins, DNR and the Nine Mile Watershed have
established a joint venture to establish and monitor the flood plain of
Nine Mile Creek. The flood plain designation was made a part of the zoning
ordinance based on the best information available at the time of passage and
the Zoning Ordinance prohibits the construction of homes in the flood plain.
Should the Watershed, based upon a specific study of this land, find that the
plan would not jeopardize the flow of water or, in precising the flood plain
line, the building locations are not affected, this particular issue could be
approved by Hopkins. Appropriate action might be to table the request pending
a report from the Watershed.
6. Utilities for new construction are required to be underground. No statement or
plan was submitted as to how this provision is to be complied with.
• 7. It is assumed that 4 parking spaces are to be provided in the basement plus
at least 4 outside which is in conformance.
8. A landscape plan was submitted indicating where some 31 trees and 49 shrubs
are to be located. Along 7th Street, 466 feet, 7 trees are proposed on
approximately 66 foot centers. The typical street tree spacing is 40-45 feet,
it is suggested that at least one more tree be added to the 7th Street and
9th Avenue frontage. The treatment of Nine Mile Creek was not shown. It is
suggested that the banks be graded to a 3-1 slope and sodded with some plant-
ings to be included.

AN ORDINANCE TO AMEND CHAPTER 416
OF THE 1977 CODE OF ORDINANCES OF THE CITY OF HOPKINS
REGULATING THE LICENSING AND USE OF BICYCLES AND
REPEALING PREVIOUS ORDINANCES INCONSISTENT HEREWITH
BE IT ORDAINED by the Council of the City of Hopkins, that Chapter 416
of the 1977 Code of Ordinances of the City of Hopkins be and the same is hereby
repealed and there is hereby enacted in lieu and in place thereof the following
provisions which constitute Chapter 416 of said Code of Ordinances:
SECTION 416:01. BICYCLE LICENSES REQUIRED. No person shall ride, use or leave
a bicycle upon any public street, alley, highway, boulevard, or on any public
park, playground, parking lot, or other public grounds in the City of Hopkins,
unless the same be licensed and registered as herein provided.
SECTION 416:05. REGULATIONS GOVERNING BICYCLES. The provisions of Minnesota
Statutes Chapter from 168C.02 through 168C.10, including any and all rules and
regulations for the implementation and administration adopted and issued by
the Commissioner, are hereby enacted, passed, and adopted by reference
with the same force and effect as though said provisions were set forth herein
• verbatim.
SECTION 416:10. REGISTRATION. Every owner of a bicycle shall register it with
the Commissioner of Public Safety of the State of Minnesota in the manner pre-
scribed in M.S.A. Chapter 168C within 30 days from and after June 1, 1978, or
within 15 days from the date of any bicycle acquisition thereafter.
SECTION 416:15. EXISTING HOPKINS BICYCLE LICENSES CANCELED. Any and all bicycle
licenses and license plates heretofore issued by the City of Hopkins, shall
expire upon June 1, 1978, and from and after such date only bicycles being pro-
perly registered as in this Ordinance provided shall be deemed to be licensed
pursuant to this Ordinance.
SECTION 416:20. IMPOUNDING. Any bicycle operated or found on any public place
as hereinabove set forth within the City of Hopkins which is not registered as
required by this Ordinance, shall be impounded by the Hopkins Police Department
and held by such department until said vehicle is properly registered as here-
inabove set forth, and in addition, an impounding fee of $10.00 is paid to the
City of Hopkins. In the event any such bicycle is not claimed within three
months from the date of such impoundment, it shall be sold by the City of Hopkins
at public sale or auction as provided in Section 140 of the 1977 Code of Ordi-
nances of the City of Hopkins.
First read at a regular meeting of the Council of the City of Hopkins
held on April 18, 1978, and finally read, approved, adopted and ordered pub-
lished at a regular meeting of said Council of said City o, .y 2, 1978.
