2016-011 Approving Ordinance 2016-1105 Vacating the Storm Sewer Easement within the Hopkins Village Plat for First Reading CITY OF HOPKINS HENNEPIN COUNTY, MINNESOTA RESOLUTION 2016-011 RESOLUTION MAKING FINDINGS OF FACT AND APPROVING ORDINANCE NO. 2016-1105, VACATING THE STORM SEWER EASEMENT WITHIN THE HOPKINS VILLAGE PLAT FOR FIRST READING. WHEREAS, an application for Vacation 2016-02-VAC has been made by Community Housing Development Corporation; and WHEREAS, the procedural history of the application is as follows: 1. That an application for a vacation of the storm sewer easement was made by Community Housing Development Corporation, on December 23, 2015; 2. That the Hopkins City Council, pursuant to mailed and published notice, held a public hearing on the application and reviewed such application on February 2, 2016: all persons present were given an opportunity to be heard; 3. That the written comments and analysis of City staff were considered; and 4. Legal description of the easement to be vacated is shown on Exhibit A, attached. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hopkins hereby approves Ordinance 2016-1105, vacating the storm sewer easement within the Hopkins Village plat for first reading based on the following Findings of Fact: 1. That the above-described easement is not needed for a public purpose. Adopted by the City Council of the City of Hopkins this 2nd day of February 2016.
