A RESOLUTION APPROVING ORDINANCE 2016-1113 OPTING OUT OF THE
REQUIREMENTS OF MINNESOTA STATUTE, SECTION 462.3593, RELATED TO
TEMPORARY FAMILY HEALTH CARE DWELLINGS
WHEREAS, the Citt� of Hopkins inivared an applicauon to consider an ordinance opung out of the
requirements of �linnesota Statute, Section 462.3593, mlated to �emporarp famil�� health care
d�vellings;
WHEREAS, the procedural histor}° of the application is as follo�c°s:

Stature, Section 462.3593, related to remporar}' famil�• healdi care d�cellings was initiated b}'
the Ciq� of Hoplcins on June 23, 2016; and
2. That die Hopl;ins Planning & Zoning Commission, pursuant ro published notice, helci a
public hearing on the applicatioe� aad reviewed such application o� )ul�� 26, 2016, and all
persons pxescnt �aere given an opportuniq to be heard; and,
3. That the �vritten comments a�d anal}�sis of Citi• srxff �vere considered.
WHEREAS, on Ma}' 12, 2U16, Uovernor Daston signed into law the creation and regulation of
cemporai�- Eamilt� heal�h care dwellings, codified at hlinnesota Statutes, Section 462.3593, which
permits and regulates temporar}' familp health carc dwellings; and
WHEREAS, Subdivision 9 of Minnesota Stamces, Secuon 4623593, allo�vs cities to "opt ouc" of
those regalations.
NOW, THEREFORE, BE IT RESOLVED that the Ciq• Counci] of the Cit� of Hopkins hereb}•
approves Ordinance 2016-] 113 opting out of tl�e requirements of b4innesota Stacute, Seccion
462.3593, relared to temporarv familp l�ealch care d�vellings based on the follo�cing Fndings of fact:
]. Minnesota Stamce, Section 462.3593, would precmht local zoning control over temporam
famil}' heal[h care dwellings; and
2. Subdicision 9 of Minnesota Statures, Section 4623593, alloms cities to "opt ouc" of those
regulations.
