ORDINANCE AMENDING SECTION 1200 SALE, CONSUMPTION AND DISPLAY OF
ALCOHOLIC BEVERAGES OF THE HOPHINS CITY CODE TO ALLOW ON-SALE
LICENSES ON PUBLIC PREMISES
THE COUNICL OF THE CITY OF HOPHINS HEREBY ORDAINS AS FOLLOWS:
Section l. That Section 1200.03 is hereby amended by deleting the st�ie-l�en material and adding
the double underlined material as follows:
1200.03. Licenses Required. Subdivision 1. General requirement. No person, except a wholesaler
or manufacturer to the extent authorized under state license, shall directly or indirectly deal in,
sell, or keep for sale in the City of Hopkins, any intoxicating liquor without a license to do so as
provided in this s��inaeee. Liquor licenses shall be limited to the a€-eig}3t kinds provided
in this secrion.:
Section 2. That Section 1200.06 is hereby created by adding the following double underlined
material:

Th itv Council mav issue to the holder of an on-sale intoxicatine liauor license issued bv the citv or a
municinalitv adiacent to the citv a license to allow the disnensine of intoxicatine liauor at anv convention.
banauet conference meetine or social affair conducted on the nremises of a snorts convention or cultural
facilitv owned by the citv The licensee must be eneaeed to disnense intoxicatine liauor at an event held bv
nerson or oreanization nermitted to use the nremises and mav disnense intoxicatine liauor onlv to nersons
attendine the event. The licensee mav not disnense intoxicatine liauor to anv oerson attendine or
narticinatine in an amateur athletic event. for nersons 18 vears of aee or vouneer. held on the nremises.
�ubd. 2. Communitv festivals. The Citv Council mav issue to the holder of aa on-sale intoxicatine
liouor license issued bv the citv a license to allow the disnensine of intoxicatina liauor off the licensee's
premises at a communitv festival held within the municioalitv The authorization shall soecifv the area in
which the intoxicatine liauor must be disnensed and consumed and shall not be issued unless the licensee
demonstrates that it has liabilitv insurance that meets the rec�uirements of state law
Subd 3 Aunlication nrocess Annlicants for an on-sale license on nublic nremises shall be subiect
o the followine nrocess:
a. Annual aonlication Annlicants for an�n-sale license on o bu lic n�mises shall annuallv
nnlv to the citv for such license The annlication shall set forth the annlicant's e ire
for such license and the nature and duration of its existina omsale int�xicatine liauor
license. The aonlication shall also contain the annlicable license fee. as set forth in the
i de.
b. Hearine not reauired No nublic hearine shall be reauired for the eran(ina of an on-sale
license on nublic nremises.
c. Annlication annrov 1 The Citv Council shall annrove the anolication if it determines the
a lie nt meets all reauirement�of this sectio� and if it further detercnines that the
annlicant is in eood stan ine with reeard to the annlicanPs undedvine on-sale
intoxicatine liauor license.
d. Duration The license eranted under this section shall remain in effect from its issuance
until the followina June 30 Licenses issued under this section are subiect to annual
renewal.
Subd 4 Other conditions In addition ro the reauirement� otherwise set forth in this section nublic
oremises licensees shall be subieet to the followine condi�io�S_
a. Even[ fees In addition ro the annual license fee a licensee shall nav an event fee as
established £rom time to time bv resoluCion of the Citv Council
b. Minnesota products If a liceng� under this section is sellina beer for consumntion on
nublic nremises the lieensee shall make nrovision for the sale of at least one Minnesota-
produced beer at each station on the1r�mises where beer is beine sold
Events snecial conditious Whenever the Citv Council determines that a snecific event for
which the licensee will be nrovidi�e on-sale intoxicatina liauor reouires snecial or
uniaue conditions the Citv Council mav imnose such conditions and the licensee shall
abide bv all such con itions.
Section 3. The effective date of this ordinance shall be the date of publication.
