2002-024 CITY OF HOPKINS HENNEPIN COUNTY MINNESOTA RESOLUTION NO. 2002-24 CITY POLICY ON STREET LOAD RESTRICTIONS WHEREAS, for the public safety and welfare, it is necessary to protect and preserve the public's investment in the streets and roads of the City of Hopkins from premature deterioration and break-up occasioned by the alternate thawing and freezing cycle experienced in the late winter and early spring, and WHEREAS, in order to minimize the aforementioned damage to our streets and roads, and pUrsuant to the authority contained in Section 169.87, the City posts load limits on certain of its streets and roads, and WHEREAS, in order to facilitate the movement of goods and materials, particularly those delivered to construction sites, it may be necessary to permit overweight vehicles on certain streets and roads. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Hopkins that it is the policy of the City of Hopkins that load limits shall be established at such times and on such streets and roads throughout the City of Hopkins as shall be determined by the City Engineer and Street Superintendent. BE IT FURTHER RESOLVED that in the event private parties desire to exceed these load limits, they shall obtain a permit from the City Engineer, and they shall be required to submit to the City cash or a certified check in an amount to be determined by the City Engineer, such amount to be based upon the anticipated potential damage which could be occasioned by such hauling, and BE IT FURTHER RESOLVED that the City Engineer shall be authorized to revoke any such overweight permits when, in his judgment, substantial damage is being caused to the street or road, and BE IT FURTHER RESOLVED that the City Engineer shall be authorized to deduct from paid cash deposit, any sums necessary to restore the street to its design standards in the event of damage, following the expiration or revocation of an overload permit, or the lifting of load limits, and BE IT FURTHER RESOLVED that it shall be the policy of the City of Hopkins to presume that any damages occurring on any street or road over which vehicles have permission to travel overweight, shall have been caused by said vehicles.
