RESOLUTION NO. 2005-032fl
RESOLUTION FOR VACATING SEVERAL UNIMPROVED ALLEY RIGHTS OF
WAY
BE IT RESOLVED BY THE CITY COUNCIL OF HOPKINS, MINNESOTA,
WHEREAS, the City Council of Hopkins has determined to vacate all or portions
of several alley rights of way (described below);
AND WHEREAS, a public hearing was held on March 15, 2005 before the City
Council in the city hall after due published and posted notice had been given by
the clerk, a reasonable attempt was made to give personal notice to all affected
property owners, and all persons interested were given an opportunity to be
heard;
AND WHEREAS, any person, corporation or city owning or controlling
easements contained upon the property vacated, reserves the right to continue
maintaining the same or to enter upon such way or portion thereof vacated to
maintain, repair, replace, remove or otherwise attend thereto;
AND WHEREAS, the City of Hopkins reserves public utility easements over the
vacated rights-of-way to enter upon such easement area to maintain, repair,
replace, remove, install or otherwise attend to public utilities;
AND WHEREAS, the City Council has adopted ordinance 2005-948, ordinance
vacating various alley rights of way;
AND WHEREAS, it appears that it will be in the best interest of the city to vacate
such alley rights of way;
AND WHEREAS, four-fifths of all members of the City Council concur in this
resolution;
NOW, THEREFORE, BE IT RESOLVED, that the following unimproved alley
public rights of way are hereby vacated:
The alley right-of-way segments located between Monroe Avenue South and
Harrison Avenue South and between 1 st Street South and Excelsior Boulevard as
shown and described on the attached exhibits. The areas vacated are those
areas legally described on the attached exhibits, which are incorporated into and
made a part of this resolution.
